- 00:00:55on and I was in big law which means that
- 00:01:00I was at the top of my game I was doing
- 00:01:01highlevel intellectual property
- 00:01:05cases and I started seeing
- 00:01:08double and then getting confused and
- 00:01:11felt like I had been hit by a truck I
- 00:01:14had this intense inner ear pain rashes
- 00:01:17that wouldn't go away suddenly I had
- 00:01:20migraines things that I had never had
- 00:01:22before but they were getting worse and
- 00:01:24worse and I started going to a series of
- 00:01:25doctors as you do and they said um
- 00:01:29reduce stress in your life eat better
- 00:01:32exercise more and I did all those things
- 00:01:35so I was gluten-free sugar- free dairy
- 00:01:37free I was Christina 2.0 I got a
- 00:01:40government job and then they sent said
- 00:01:44um go quarantine at
- 00:01:45home and it got worse
- 00:01:50and my son started running into
- 00:01:53walls and regressing in his
- 00:01:54developmental
- 00:01:56milestones and I just couldn't function
- 00:01:59I couldn't see SE straight and I I
- 00:02:01thought I was going to die but I didn't
- 00:02:02know
- 00:02:04why and I finally went to a doctor who
- 00:02:06gave me a Mot toxin test and I had never
- 00:02:09heard the word mot
- 00:02:11Toxin and they said go test your house
- 00:02:15for toxic mold again not something I'd
- 00:02:18ever heard of my husband and I have five
- 00:02:21IV leag degrees between us we had never
- 00:02:24heard toxic mold we' never heard status
- 00:02:28and we can talk about that with that's
- 00:02:29intentional right there's a massive
- 00:02:31cover up in this country and we didn't
- 00:02:33we didn't even know we didn't know that
- 00:02:35this was a thing and we started
- 00:02:37investigating and we found the tip of
- 00:02:40the iceberg and we got out
- 00:02:44and it was a
- 00:02:48nightmare as you started to peel back
- 00:02:51the layers of the onion and it wasn't
- 00:02:52just you experiencing these mystery
- 00:02:55symptoms it was your family as well you
- 00:02:58mentioned your son what were the
- 00:03:01foundational things you started to learn
- 00:03:03about mold and what it was doing to you
- 00:03:07and your family I couldn't figure it out
- 00:03:09at
- 00:03:10first because if you just Google it you
- 00:03:13get a lot of conflicting
- 00:03:15information so I went to the source I
- 00:03:18went to PubMed and I just started
- 00:03:19reading the medical literature myself
- 00:03:22and what does mold do to your body and
- 00:03:25it causes a cyto kind storm that's a lot
- 00:03:28like long Co this is iic inflammation it
- 00:03:30affects every aspect of your body but it
- 00:03:33can especially attack your brain and it
- 00:03:36started making sense my daughter who was
- 00:03:40eight at the time had started beating up
- 00:03:44her big brother and it just become
- 00:03:46violent
- 00:03:47overnight and then my 2-year-old was
- 00:03:49running into walls regressing and
- 00:03:51developmentmental Milestones and then I
- 00:03:54felt like I was going crazy I
- 00:03:56contemplated driving into oncoming
- 00:03:57traffic I'd never had had any thoughts
- 00:04:00like that in my whole life
- 00:04:03and I just understood for the first time
- 00:04:06that there was something else going
- 00:04:10on
- 00:04:11and it started making sense and then we
- 00:04:15started peeling back the onion on the
- 00:04:17house and I had a mold inspector come to
- 00:04:20our house and he
- 00:04:22said tell me about your family and he
- 00:04:25sat down on my living room couch I mean
- 00:04:28I it's like Pest Control comes in and
- 00:04:30says can I sit down that just doesn't
- 00:04:31even happen and I I didn't really
- 00:04:34understand and I but I started telling
- 00:04:36him about my daughter because I'd
- 00:04:37started reading about mot toxins and
- 00:04:39maybe this is what was going on with her
- 00:04:41and he said I often find it behind the
- 00:04:44wall of the kid most affected so he took
- 00:04:46a flashlight to her wall and he found
- 00:04:50faint water
- 00:04:52damage and he took an air sample right
- 00:04:56next to the wall and he found stacky Bas
- 00:04:58which is a black mold incredibly
- 00:05:00dangerous it's used in biological
- 00:05:02warfare I learned later and we opened
- 00:05:05the wall and it was
- 00:05:09black and a roofer had failed to flash
- 00:05:12the chimney at the roof and so water had
- 00:05:14been coming into that wall for nine
- 00:05:16years wow my poor little girl was
- 00:05:18quarantining and was at home you know
- 00:05:21everyone was out of school so she wasn't
- 00:05:23getting an escape and she was just in
- 00:05:25her room coloring for hours at a time
- 00:05:28next to a substance that's used in
- 00:05:31biological
- 00:05:32warfare and um you know it's
- 00:05:35heartbreaking because you have this
- 00:05:37guilt as a
- 00:05:38parent why didn't we know why didn't I
- 00:05:41figure it out
- 00:05:42sooner but I'm just so thankful that we
- 00:05:44got out because I think I think we would
- 00:05:46have died I think I would have died by
- 00:05:48the time I left I had a tumor I
- 00:05:50collapsed and went to the emergency
- 00:05:52room um I had extreme anemia and I had
- 00:05:57my my heart was beating so fast as my
- 00:06:00body was detoxing and again I just I
- 00:06:03just thought I was going to die and you
- 00:06:05know you start kind of making plans like
- 00:06:07what happens
- 00:06:08if what happens if I don't make
- 00:06:13it you know all the while you're living
- 00:06:16in this house which was in Austin
- 00:06:19Texas thinking you've created a home a
- 00:06:22protective safe haven for your family
- 00:06:24and little did you know your house was
- 00:06:27actually poisoning you and during that
- 00:06:31time and we later got to tell this story
- 00:06:34to a jury and and we asked the jury you
- 00:06:36know tell what does home mean to
- 00:06:39you it means
- 00:06:41Sanctuary
- 00:06:43safety Comfort family what did it mean
- 00:06:46to you during
- 00:06:48covid it meant
- 00:06:51Health
- 00:06:53Oasis
- 00:06:55protection so we were in this home that
- 00:06:58was supposed to be keeping keeping us
- 00:06:59safe at the time we wouldn't I wouldn't
- 00:07:03let us go out to the grocery store and
- 00:07:05we learned that it was our home that was
- 00:07:07killing us not this pathogen that was
- 00:07:09out there but a pathogen that was right
- 00:07:11here and we had nowhere to
- 00:07:13go because who's going to take a family
- 00:07:16of
- 00:07:17six two of wh three of whom have like
- 00:07:20serious neurological problems I mean my
- 00:07:23my kids were not okay and I couldn't
- 00:07:25just subject someone else to that so we
- 00:07:28didn't feel like we had anywhere to go
- 00:07:31um and it's very confusing when you're
- 00:07:32in a house that's poisoning you because
- 00:07:34you don't want to believe it and it
- 00:07:36takes you a little while to to
- 00:07:38understand you you H you have to get out
- 00:07:41you have to get out and thankfully we
- 00:07:45did and then I started building the case
- 00:07:47um and just for people who are following
- 00:07:49along you're a lawyer I'm a lawyer and
- 00:07:52at the time I was a personal injury
- 00:07:55lawyer for the first time I had grown up
- 00:07:57in patent litigation but when I started
- 00:08:00not feeling well I went to the
- 00:08:01government to the Department of Justice
- 00:08:03and I was an assistant us attorney and I
- 00:08:06was doing personal injury defense for
- 00:08:08the United States of America so I was on
- 00:08:11the defensive side and I know a good
- 00:08:13case I know what to look for and here we
- 00:08:17were a family of six we had lost our
- 00:08:20house and everything in it and we had
- 00:08:23six very sick people because of the
- 00:08:26clear negligence of the Builder the roer
- 00:08:30and ultimately the hvat company um they
- 00:08:33had created an incredibly unsafe house
- 00:08:35that was poisoning my family and I
- 00:08:37learned later was
- 00:08:38intentionally um
- 00:08:42intentionally
- 00:08:44defective let's talk about that for a
- 00:08:47second you know you lived in a nice home
- 00:08:50right it was beautiful it was beautiful
- 00:08:52we're not talking about uh washed up
- 00:08:57remodel that you guys were just getting
- 00:09:01by in this was a nice home and I mention
- 00:09:05this because a lot of people who don't
- 00:09:08hear about mold and its
- 00:09:11potential harm on the human body and
- 00:09:14you've mentioned that that's partially
- 00:09:16intentional and that we'll get to that
- 00:09:17in a second there's a little bit of a
- 00:09:19coverup that's there a lot of people
- 00:09:21think well sure you find some mold
- 00:09:24whether you're renting or you own a home
- 00:09:27it's no big deal you know my landlord
- 00:09:30might come in and paint over it or make
- 00:09:33it go away or you find some mold by the
- 00:09:36SL sink you clean it
- 00:09:38up why was this different and how did
- 00:09:42the mold exposure that you guys had this
- 00:09:45black mold which you mentioned is used
- 00:09:47in biological
- 00:09:48warfare how did it not only cause these
- 00:09:50symptoms but lead to in some instances
- 00:09:53with your family's health some permanent
- 00:09:56damage we're building these houses now
- 00:09:59now to be energy efficient and my house
- 00:10:02was one of the first on the cusp of that
- 00:10:04it was built in 2011 with spray foam
- 00:10:07insulation and the idea is if we build
- 00:10:10it to be energy efficient um we're going
- 00:10:12to spend less on
- 00:10:14energy air conditioning is going to work
- 00:10:16better all of that but the problem is if
- 00:10:20the house becomes
- 00:10:21toxic then you're in an energy efficient
- 00:10:25toxic bubble and hvat companies are not
- 00:10:29used to dealing with these houses with
- 00:10:31spray foam you have to be very very
- 00:10:33meticulous about how you set up the
- 00:10:35system so that it can be safe for the
- 00:10:37inhabitants the tenants and they they
- 00:10:40didn't do that in my case so two things
- 00:10:43happened
- 00:10:45one the roofer fla didn't Flash the
- 00:10:49chimney which means that he didn't put
- 00:10:50in the waterproofing at the
- 00:10:52chimney so you have to work with the
- 00:10:55Mason the roofer and the Mason have to
- 00:10:56work
- 00:10:57together and
- 00:10:59when you build when you put the the
- 00:11:01bricks together to build a chimney the
- 00:11:03roofer wasn't there when the mason built
- 00:11:05the chimney and he told the Builder and
- 00:11:08the Builder's Foreman hey the chimney is
- 00:11:11not
- 00:11:13flashed it needs to be
- 00:11:16redone and the foreman said don't worry
- 00:11:18about it just rig it and that's what
- 00:11:22they did they just put the metal on the
- 00:11:23outside to make it look like it had been
- 00:11:25flashed but it hadn't been flashed but
- 00:11:28with the spray foam does is it it hides
- 00:11:30water damage so it had been leaking into
- 00:11:33that wall for 9 years nine straight
- 00:11:37years but we couldn't see it because of
- 00:11:38the spray foam and then when we opened
- 00:11:41the wall and saw the black I had an
- 00:11:44expert come over to look at you know
- 00:11:46what's going on here and he said this is
- 00:11:49not just a flashing problem you have a
- 00:11:52humidity
- 00:11:53problem because we learned that our HVAC
- 00:11:56had not been connected to dehumidify
- 00:11:59so there was a wire that was intended to
- 00:12:03be connected so that it would have extra
- 00:12:06dehumidification which is required in a
- 00:12:08spray foam house and they hadn't
- 00:12:11connected it so it was a combination of
- 00:12:14the roofer the Builder and the HVAC that
- 00:12:17had created this toxic bubble that we
- 00:12:19were then quarantining in and this and
- 00:12:22we are not alone there are millions of
- 00:12:24Americans who were quarantining in
- 00:12:26houses that were making them sick
- 00:12:28because the indoor air quality in our
- 00:12:30country is so bad right now and it's bad
- 00:12:33because these Builders don't care they
- 00:12:35don't care they don't care about mold
- 00:12:37they don't care really about the health
- 00:12:39of the tenants who are going to live in
- 00:12:41the houses and to be fair in some
- 00:12:44circumstances they just don't know they
- 00:12:46either don't care or they don't know
- 00:12:48either one is a
- 00:12:49problem you know we have you on the
- 00:12:52podcast today not just to tell your own
- 00:12:53story and it's a powerful story we have
- 00:12:56you on here because you have made this a
- 00:13:01mission in your life to fight for the
- 00:13:04underdog step one by telling your story
- 00:13:07and raising awareness but step two you
- 00:13:10went on to which we'll chat about
- 00:13:12later you went on to found a law firm
- 00:13:17that was and can be an advocate for
- 00:13:21families like yours you know you
- 00:13:23mentioned millions of families are going
- 00:13:25through this even though we're done
- 00:13:27quarantine in the days of covid still if
- 00:13:29you live at home if you sleep six to8
- 00:13:32hours a night which almost everybody
- 00:13:33does you are regularly in a house that
- 00:13:37could be exposing you to all sorts of
- 00:13:40environmental toxins mold being one of
- 00:13:42the biggest problems that are there in
- 00:13:44fact the World Health Organization
- 00:13:46estimates Bas estimates based on their
- 00:13:49guidelines that at least onethird of the
- 00:13:52buildings in North America have some
- 00:13:55form of significant mold exposure due to
- 00:13:58the way that we build and those sound
- 00:14:00like conservative estimates to me just
- 00:14:03having friends even in a place like La
- 00:14:06that it doesn't rain that often I know
- 00:14:08mold has been a big problem for a lot of
- 00:14:10individuals so I'm highlighting because
- 00:14:13number one anybody who follows along
- 00:14:16with this podcast is not only going to
- 00:14:18learn how to protect themselves and
- 00:14:20their family and what to be on the
- 00:14:21lookout for but those individuals that
- 00:14:24have been impacted maybe your law firm
- 00:14:28and what you guys are to could be a
- 00:14:30potential advocate for them or a larger
- 00:14:32group that they're part of anything you
- 00:14:35want to add to that we we have to hold
- 00:14:38the builders
- 00:14:39accountable you know we we talk about
- 00:14:42how to make the world a safer place and
- 00:14:45the jury system in our country is
- 00:14:47actually one way we do that the jurors
- 00:14:50are charged with the safety rules in the
- 00:14:53United States of enforcing the safety
- 00:14:54rules and that's a privilege and an
- 00:14:57honor that a jury of your peers gets to
- 00:15:00do that and so there you and others and
- 00:15:06so many have been focusing on on the
- 00:15:10health aspects and education aspects of
- 00:15:15changing the food and the environment we
- 00:15:18live in but there's this piece that's
- 00:15:20missing I think or this this piece to
- 00:15:23add add to those tools which is the
- 00:15:25legal piece because the legal system is
- 00:15:29another way
- 00:15:31to Advocate to educate and to bring
- 00:15:37accountability and
- 00:15:38change so that's what that's what I'm
- 00:15:40hoping we can add to the conversation
- 00:15:43let's talk about that accountability you
- 00:15:44know accountability in the legal system
- 00:15:46are often used and historically have
- 00:15:49been used in the face of a David and
- 00:15:52Goliath's story that there are powers
- 00:15:55that are entrenched who don't want to
- 00:15:58disrupt the status quo talk about the
- 00:16:01status quo that exists out there that's
- 00:16:05part of what led to the unique
- 00:16:07circumstance where your family ended up
- 00:16:10getting sick well there's a vast
- 00:16:12conspiracy as there is so so often in so
- 00:16:15many of these things but what happened
- 00:16:18was in Texas there was a case called the
- 00:16:19Ballard case and there was a woman like
- 00:16:21me Melinda Ballard whose family got
- 00:16:23incredibly sick she went on to win a
- 00:16:26case against the insurance company at a
- 00:16:29jury trial that awarded $38 million huge
- 00:16:33award insurance companies didn't like
- 00:16:36that so they went and started excluding
- 00:16:40mold from their insurance policies so
- 00:16:43now your Builder's insurance policy
- 00:16:47doesn't include
- 00:16:48mold which is the most catastrophic
- 00:16:51thing that can happen to a house other
- 00:16:53than a fire mold is the most
- 00:16:55catastrophic thing that can happen
- 00:16:56because it can overtake the entire house
- 00:16:58you can lose your entire house and be
- 00:17:01uninsured so that was one of the things
- 00:17:03that happened to us we realized that we
- 00:17:04were uninsured for this catastrophic
- 00:17:07event that we didn't even know could
- 00:17:08possibly happen and we had all the best
- 00:17:11insurance we cared about our house we
- 00:17:14loved our house we had the best
- 00:17:16insurance money could buy but it didn't
- 00:17:18cover this catastrophic event which was
- 00:17:23a toxic
- 00:17:24mold event nor did the insurance
- 00:17:27policies of the defendants of the
- 00:17:30Builder and the roofer and the at
- 00:17:35company so you had this situation
- 00:17:39where no one's responsible because no
- 00:17:41one has coverage so personal injury
- 00:17:44lawyers stopped taking these cases and I
- 00:17:47couldn't find anyone to help me I called
- 00:17:50around to Texas lawyers and no one took
- 00:17:52no one returned my
- 00:17:54call I was another lawyer I was at the
- 00:17:56US attorney's office I was I was a smart
- 00:17:59you know
- 00:18:01educated I thought nice person emailing
- 00:18:04them saying hey can you spend 15 minutes
- 00:18:05with me to talk about this kind of case
- 00:18:08and they didn't return my emails didn't
- 00:18:10return my calls and one of them in San
- 00:18:13Antonio had molded on his website but he
- 00:18:16said he did wrongful death
- 00:18:18cases and I thought well surely he can
- 00:18:20talk to me and he didn't return my call
- 00:18:25and I emailed him didn't you know got
- 00:18:27his personal Direct email he didn't
- 00:18:29return my email didn't even have a
- 00:18:31paralal call me back and I just thought
- 00:18:34you know what he can take all the dead
- 00:18:37people and maybe I'll start a firm and
- 00:18:39I'll represent the people who are
- 00:18:41alive who need to
- 00:18:44recover and I don't care if insurance
- 00:18:47companies don't cover
- 00:18:49it I'm going to do it
- 00:18:51anyway and that's what we did in our own
- 00:18:54case we carried on and they said well
- 00:18:57our policy doesn't cover it I said said
- 00:18:58well see you tomorrow we've got a
- 00:19:01deposition on Tuesday and we just kept
- 00:19:03going and by the way every one of those
- 00:19:07insurance policies ultimately ended up
- 00:19:10paying because they have to pay the
- 00:19:13lawyers so these lawyers these Insurance
- 00:19:15lawyers end up spending hours and hours
- 00:19:17and hours they ring up this enormous
- 00:19:20Bill and then the insurance policy says
- 00:19:23that they don't they're not going to
- 00:19:24cover it anyway and then on the eve of
- 00:19:27trial that insurance lawyer who's being
- 00:19:30paid who's been paid hundreds of
- 00:19:32thousands of dollars to defend the case
- 00:19:33doesn't actually want to go to trial on
- 00:19:35the case because they know that you're
- 00:19:36going to win so they ultimately end up
- 00:19:38paying anyway it's the most insane
- 00:19:42system and the insurance companies are
- 00:19:46one of the
- 00:19:48culprits one of the other layers that
- 00:19:50it's part of this vast conspiracy is
- 00:19:54that I'll hear from
- 00:19:56people that hey I just moved into a
- 00:19:59place and I've had issues with mold in
- 00:20:02the past but don't worry they had an
- 00:20:06inspector go and look at the property
- 00:20:09whether you're renting and it was
- 00:20:11inspected before you came in whether
- 00:20:13you're buying and there was an inspector
- 00:20:16sent over by the the uh sell's side and
- 00:20:22the place got a thumbs up there's no
- 00:20:23mold tell us why that is part of this
- 00:20:27conspiracy
- 00:20:29well landlords don't care they don't
- 00:20:31they don't care they want to make money
- 00:20:33and they either again don't care or
- 00:20:35don't know so when they are told that
- 00:20:38there's a mold
- 00:20:41problem one they've been brainwashed to
- 00:20:43believe that mold isn't real so they
- 00:20:46they haven't actually gone to the
- 00:20:47scientific literature in red Pub met
- 00:20:49like I have so they they think well this
- 00:20:51is just a crazy person who thinks that
- 00:20:52there's a problem and there isn't really
- 00:20:54so they treat the person as crazy that's
- 00:20:56one step but then they'll come in and
- 00:20:58just paint over it or they'll call a
- 00:21:00mold inspector and the mold inspector
- 00:21:02will come and take an air sample in the
- 00:21:04middle of the room and they'll be like
- 00:21:06you're you're good no
- 00:21:08worries I love to take the deposition of
- 00:21:10that mold inspector I say now sir where
- 00:21:14is mold likely to be
- 00:21:16found in the
- 00:21:18wall well if you're looking for mold are
- 00:21:21you more likely to find it close to the
- 00:21:24wall or in the middle of the
- 00:21:27room
- 00:21:28uh he doesn't want to answer the
- 00:21:30question right because they're testing
- 00:21:33in the place Le least likely to find
- 00:21:37mold as my mold inspector Tim Taylor who
- 00:21:40saved our life as as he said you find it
- 00:21:44behind the wall of the kid most affected
- 00:21:47so if you're looking for mold you
- 00:21:48actually start you have to start with
- 00:21:50health ask about health you have to
- 00:21:54actually want to find it but if you're
- 00:21:58you're working for the landlord you
- 00:22:00don't want to find it so the incentives
- 00:22:02are just so off and jurries care and
- 00:22:07that's why we have a lot of cases
- 00:22:09against those landlords because if you
- 00:22:12paint over a toxic substance that's the
- 00:22:15intentional infliction of bodily harm
- 00:22:17I'm going to I'm I'm going to call that
- 00:22:19out and juries
- 00:22:22think that could happen to
- 00:22:25me the tenant didn't know
- 00:22:29what if your house is slowly killing you
- 00:22:30and you don't know but your landlord
- 00:22:34did can't we all agree that the
- 00:22:36landlord's main responsibility is to
- 00:22:39provide you a home that's safe a home
- 00:22:43with safe
- 00:22:44eror it's absolutely unacceptable for
- 00:22:47the landlord to provide you a home that
- 00:22:49doesn't have safe air and these are just
- 00:22:52intuitive things let's just say them out
- 00:22:54loud and for reasons I've just explain
- 00:22:58that no one has been saying it out loud
- 00:23:00in the legal context for a while now and
- 00:23:03that has to change well you've been a
- 00:23:04big part of that change give us a little
- 00:23:07summary of your final arguments to the
- 00:23:10jury and what helped them put themselves
- 00:23:14in your shoe and what was the verdict in
- 00:23:18your case well it was painful that I
- 00:23:20couldn't bring my own closing argument
- 00:23:22because I couldn't be a lawyer in my own
- 00:23:24case so I had to watch Bob mcke and
- 00:23:27Kevin taz's do it and they're fabulous
- 00:23:29lawyers and Bob mck started with the
- 00:23:33basic premise that your
- 00:23:34[Music]
- 00:23:36home is your safe haven it's supposed to
- 00:23:40be
- 00:23:42safe and there are these safety rules
- 00:23:47that a builder must create a safe
- 00:23:53house and we have to exercise care we
- 00:23:57when we do something when we undertake
- 00:23:59to do something we have to do it in a
- 00:24:02way that doesn't cause harm to
- 00:24:04others and what the hvat company because
- 00:24:08we ultimately went to trial against the
- 00:24:09hvat company what they did here
- 00:24:13was they knew in that case how dangerous
- 00:24:17mold was and they knew that humid
- 00:24:21humidity could cause
- 00:24:23mold and they didn't connect the
- 00:24:26dehumidification system
- 00:24:29and then they came to trial and tried to
- 00:24:31blame it on the
- 00:24:33victim and that didn't go well and the
- 00:24:38jury the jury believed the jury saw
- 00:24:40right through it and saw that this HVAC
- 00:24:42company hadn't connected the wires
- 00:24:45properly and had caused harm now was
- 00:24:48that
- 00:24:51intentional no a lot of this is not
- 00:24:53intentional some of it's intentional If
- 00:24:55a landlord paints over the toxic
- 00:24:57exceptions it's intentional but often
- 00:25:00it's negligent and here it was gross
- 00:25:03negligence and I will never forget I'm
- 00:25:05sitting we're sitting in the jury in the
- 00:25:08we're sitting in the waiting room and of
- 00:25:12course dying for that verdict to come
- 00:25:14back and the jury sends back a note and
- 00:25:18the question
- 00:25:21was is
- 00:25:24incompetence a deceptive Act
- 00:25:28according to the jury
- 00:25:30instructions you know I I ultimately the
- 00:25:34jury determined yes they found the
- 00:25:37defendant liable for gross negligence
- 00:25:40and found that that was in fact uh that
- 00:25:42their conduct was a deceptive act
- 00:25:48and I it was it was it was a beautiful
- 00:25:51thing it was um it was a really really
- 00:25:53beautiful thing and the defense the
- 00:25:56defendants closing was also really
- 00:26:00telling the defense the defense
- 00:26:04said the Bears are
- 00:26:09clearly he didn't say rich but he
- 00:26:11basically said they have
- 00:26:13resources and when something happens to
- 00:26:18you you need to be thankful for what you
- 00:26:25have and he implied that because we
- 00:26:28brought this case that we weren't
- 00:26:30thankful for what we do
- 00:26:32have and that really bothered me for a
- 00:26:34long
- 00:26:38time and then I it actually brought
- 00:26:41Clarity to me because ultimately you can
- 00:26:44be thankful for what you have and also P
- 00:26:47pursue Justice for what you lost and
- 00:26:50often you have to do that because you
- 00:26:52have no other choice financially or
- 00:26:56ethically and the pursuit of gratitude
- 00:27:01and Justice at the same
- 00:27:03time is
- 00:27:06Shalom that is they're United that is it
- 00:27:10is it is it's
- 00:27:12it's not only can It coincide but it
- 00:27:16should
- 00:27:17coincide when families like yours go
- 00:27:20through these horrific experiences and
- 00:27:23many of them never get Justice and you
- 00:27:27mention that's for a bunch of reasons
- 00:27:29including the fact that a lot of lawyers
- 00:27:32don't pick up these cases they find them
- 00:27:36very hard to get financial restitution
- 00:27:40out of so they're not
- 00:27:42incentivized and they're undereducated
- 00:27:44on these topics but you guys went up
- 00:27:48against Goliath and you won now part of
- 00:27:54this is
- 00:27:55also trying to get some
- 00:27:59finances out of the parties that are
- 00:28:02responsible because your life has been
- 00:28:04upended by this and the secondary aspect
- 00:28:08so besides Justice and sometimes Justice
- 00:28:11takes a financial reward to make up for
- 00:28:14all the losses that are there I don't
- 00:28:16know the details of exactly your case
- 00:28:17but I'm sure you had so many
- 00:28:20expenses getting out of the house
- 00:28:22staying somewhere else finding a new
- 00:28:24place not to mention the thousands May
- 00:28:27hundreds of thousands of dollars that
- 00:28:29were spent on your health and luckily
- 00:28:31you guys had some of those resources but
- 00:28:34for any family that's going to be a big
- 00:28:36Financial
- 00:28:37impact so this is recouping
- 00:28:41time effort money that was spent to get
- 00:28:44you healthy and safe but it also lets
- 00:28:48other people know and it places
- 00:28:51companies on
- 00:28:53notice that hey you can't just hide from
- 00:28:58this so what was the financial judgment
- 00:29:00in your case and have you seen that set
- 00:29:04new precedent in the law it was $3.1
- 00:29:08million and it has absolutely sent
- 00:29:12precedent because injury is hard to
- 00:29:15prove and in our case our judge would
- 00:29:17not even let us prove bring an injury
- 00:29:20case so she we we showed up with the
- 00:29:23best experts in the field and she
- 00:29:24wouldn't even let us do it um we could
- 00:29:26get into that
- 00:29:28but what my case showed
- 00:29:31is so be it we won
- 00:29:35anyway we had a million dollars in
- 00:29:38Damages economic damages we lost our
- 00:29:41house and everything in it we spent
- 00:29:44$700,000 trying to fix the house because
- 00:29:46we found more and more and more we were
- 00:29:49so bankrupt that my father-in-law took
- 00:29:52out a loan on his house I mean we we we
- 00:29:56borrowed all the money we could could
- 00:29:57and then our family borrowed as much
- 00:29:59money as they could to help us get well
- 00:30:03and I say that when you're in this place
- 00:30:07you spend all that you have getting well
- 00:30:09it doesn't matter how much money you
- 00:30:11have you spend it all getting well
- 00:30:13because you are desperate to get well
- 00:30:16and I called my firm just well because I
- 00:30:19just want people to be well and that's
- 00:30:21what I said at the time and that's what
- 00:30:23all my clients ultimately want is just
- 00:30:25to be well so that's the financial piece
- 00:30:29of it why my case really matters in the
- 00:30:32world is that we
- 00:30:35showed that juries care not just about
- 00:30:39the injury but about the bad acts their
- 00:30:44job is to enforce the safety rules in
- 00:30:46this country their job is to make sure
- 00:30:49that the that the companies are on
- 00:30:51notice that they have to they have to
- 00:30:54exercise good care right they if there
- 00:30:57is a dehumidification system you have to
- 00:30:59connect the wire and if you don't you're
- 00:31:03going to be liable for whatever happens
- 00:31:05after that's the that's responsibility
- 00:31:08that's the way the world should be and
- 00:31:09that's what juries are going to do so in
- 00:31:12all my other cases we're proving injury
- 00:31:14right there's no other case where we
- 00:31:16haven't proven injury we're always
- 00:31:17proving injury but I get to say to
- 00:31:20defendants okay you think we have a
- 00:31:22causation injury problem
- 00:31:25sure if a jury in my case gave $3.1
- 00:31:28million for not connecting a wire what's
- 00:31:31a jury going to do in your case when you
- 00:31:35came in and painted over a toxic
- 00:31:38substance or you took off the vent of an
- 00:31:41HVAC system and you cleaned it in front
- 00:31:43of the clients and you said this is it's
- 00:31:45perfect now don't worry and you put it
- 00:31:47back knowing full well that behind that
- 00:31:50vent was a system full of toxic
- 00:31:54mold that's those are the kinds of cases
- 00:31:56I have have so you know bring it is kind
- 00:32:01of our attitude bring it whatever you
- 00:32:03have bring it because we will hold these
- 00:32:07companies responsible and we will get
- 00:32:10compensation and recovery for our
- 00:32:12clients tell us about what it was like
- 00:32:14to hear that jury verdict on your
- 00:32:17end it was such a
- 00:32:19relief it was such a
- 00:32:22relief to be
- 00:32:25believed that's ultimately what ites
- 00:32:27comes down to
- 00:32:28because these defendants whoever they
- 00:32:31are honestly and and we can talk about
- 00:32:33the government too which is part of the
- 00:32:34problem but these defendants make you
- 00:32:37feel like you're crazy they hired an
- 00:32:40expert to say that I had a somatic
- 00:32:43disorder I've never had a I mean I've
- 00:32:45never been psycho I
- 00:32:48mean they hired Evan and I went to
- 00:32:50Princeton they hired a Princeton PhD to
- 00:32:54say that my parenting was unconscionable
- 00:32:56and that I should have have had my
- 00:32:57daughter admitted to a psych Institute
- 00:33:03Institution but they didn't end up
- 00:33:05bringing any of those people to
- 00:33:07trial and and at trial I will never
- 00:33:10forget when opposing Council this very
- 00:33:12cocky jerk very cocky jerk pulls
- 00:33:16up our map of of our diagram of all the
- 00:33:21mold in our house we had we basically
- 00:33:22took a floor plan we labeled all the
- 00:33:25places where there was mold
- 00:33:27I'll I'll show you a picture
- 00:33:30and he put it up there and he said to
- 00:33:32the jury I'm not going to tell you that
- 00:33:35there wasn't mold in the
- 00:33:37house and he used my diagram to say that
- 00:33:40because when it comes down to it when
- 00:33:42the when the rubber hits the road
- 00:33:45they're they can't look at the jury and
- 00:33:47lie they can't take that evasive cover
- 00:33:51up approach they're not going to get up
- 00:33:54there and actually say that the victim
- 00:33:56has a somatic dis order but they're
- 00:33:58going to do
- 00:33:59it every day until the end so this
- 00:34:03notion that the jury believed me
- 00:34:06believed us was
- 00:34:09everything and that's what I try to give
- 00:34:11to our clients this notion that you're
- 00:34:15believed you came to the right place we
- 00:34:16believe you it starts with that you know
- 00:34:20to pull on that thread of belief at the
- 00:34:22beginning of your journey you had
- 00:34:25doctors again any well-intentioned but
- 00:34:28undereducated on the impact that mold
- 00:34:32and other environmental toxins can have
- 00:34:34on the
- 00:34:35body they didn't believe that something
- 00:34:38was going on they said you were stressed
- 00:34:41that you were depressed again they were
- 00:34:43doing the best that they knew and they
- 00:34:45were undereducated and that's really
- 00:34:47goes to our larger medical system and
- 00:34:50getting the word out about mold which
- 00:34:52this podcast is doing many other
- 00:34:54podcasts that you've been on are doing
- 00:34:55as
- 00:34:55well
- 00:34:58and then you go to
- 00:35:01court even before that I'm sure you
- 00:35:03tried to have discussions with the
- 00:35:04parties that were responsible the
- 00:35:07roofers the HVAC the builders and you
- 00:35:10weren't believe
- 00:35:11there and then finally to have a jury of
- 00:35:14your peers
- 00:35:16say not only do we believe you but
- 00:35:19you've been wronged and we need to make
- 00:35:21this
- 00:35:22right I can feel the relief just as you
- 00:35:26explained it but the other thing that
- 00:35:29was there is I saw an Instagram video
- 00:35:32that you made where you were talking
- 00:35:33about the verdict that was given to you
- 00:35:37and your family and how the opposing
- 00:35:39Council had said you know what sometimes
- 00:35:42things happen in life that are bad and
- 00:35:44we need to pick oursel up and be
- 00:35:45grateful you hinted at it a little bit
- 00:35:47earlier when you were talking about this
- 00:35:49and you said I am grateful because even
- 00:35:52though all these other people didn't
- 00:35:53believe me you had to build your own
- 00:35:56almost underground Network and
- 00:36:00team to not only believe you but show
- 00:36:05you that you weren't Crazy by pointing
- 00:36:09to the evidence that was there just talk
- 00:36:11a little bit about some of those team
- 00:36:14members that were part of helping you
- 00:36:17realize you weren't crazy and there was
- 00:36:20something physiologically going on in
- 00:36:23your body and that your house was slowly
- 00:36:25poisoning you so I believe you mentioned
- 00:36:27the first one who was the original mold
- 00:36:30inspector well the first one was the
- 00:36:33Doctor Who Doctor her name's Gabriella
- 00:36:36picardo Dr picardo in Austin and I was
- 00:36:40actually the first person that she
- 00:36:41diagnosed with mold
- 00:36:43illness I give her so much credit
- 00:36:46because
- 00:36:48she it could have been a host of things
- 00:36:50they were running a battery of tests
- 00:36:51Lyme disease
- 00:36:53parasites heavy metals whatever it is
- 00:36:56they there was a whole host of things
- 00:36:58and she
- 00:36:59included mot toxins and mold on her
- 00:37:02differential diagnosises trying to
- 00:37:04figure out what's going on with me and
- 00:37:06she thought that I had all the symptoms
- 00:37:09so she's my first hero I think she saved
- 00:37:11my life and then Tim Taylor who came
- 00:37:13into my house and sat on my couch
- 00:37:15because I had had a mold inspector
- 00:37:17earlier who came in and looked around
- 00:37:19said looks good didn't do a single test
- 00:37:21he he just was like yeah this actually
- 00:37:23looks like great construction great
- 00:37:25house it's a beautiful house house I
- 00:37:27don't think you're being exposed
- 00:37:29here and Tim Taylor wasn't supposed to
- 00:37:32come that day because I I had cancelled
- 00:37:34the appointment because I already had
- 00:37:35the other guy and he didn't get my
- 00:37:37message that he had been cancelled wow
- 00:37:40so that that was just divine
- 00:37:42intervention because I we never would
- 00:37:44have figured it out we would have
- 00:37:45carried on so Tim
- 00:37:48Taylor um and then
- 00:37:51I I started trying to really figure out
- 00:37:53what was going on with my
- 00:37:55kids and
- 00:37:57there's this woman named um Dr Emily
- 00:38:00Gutierrez who who helped me with their
- 00:38:05care but my
- 00:38:08son he's never been diagnosed with
- 00:38:11autism but he had a lot of
- 00:38:14delays and one of the places that we
- 00:38:17escaped to was Upstate New
- 00:38:20York and I tried to take a time off
- 00:38:23work and I tried to get everybody
- 00:38:26healthy
- 00:38:28and I reached out to this underground
- 00:38:32kind of Network on on Facebook this
- 00:38:34group of families and a woman had posted
- 00:38:38about a kid who had been cured of the
- 00:38:44symptoms that had led that kid to have
- 00:38:47an Autism
- 00:38:49diagnosis her name was Emily
- 00:38:51Rachel and she was my next Lifeline
- 00:38:56because she's the one who told me that
- 00:38:59healing was
- 00:39:01possible and she introduced me to Josh
- 00:39:04Rachel her husband who came in and he's
- 00:39:07a mold inspector and works all over the
- 00:39:09country so he became my next hero and
- 00:39:12then there was an HVAC expert I mean I
- 00:39:14can go on and on all day but when we
- 00:39:19think about bad things happening I tell
- 00:39:21my kids to look for the helpers look for
- 00:39:24the
- 00:39:25helpers and be one if you
- 00:39:27can
- 00:39:29and those were my those were our helpers
- 00:39:33and oh there were so many and they were
- 00:39:35so good they were so good Bob mcke was a
- 00:39:38lawyer in
- 00:39:39Florida again I couldn't find anyone in
- 00:39:41Texas who know anything about this Kevin
- 00:39:43Tzus is a great Texas lawyer but he's
- 00:39:45not a personal injury lawyer by training
- 00:39:48and I paid him hourly um as a friend to
- 00:39:50do this with me um but Bob mcke was the
- 00:39:54only other mold old experienced lawyer
- 00:39:57who took my call and he just consulted
- 00:40:00for free and he just picked up the phone
- 00:40:02when I called whenever it was and he
- 00:40:03would talk to me for an hour about
- 00:40:05whatever was going on in the case and
- 00:40:08ultimately I invited him to join our
- 00:40:10team but there was a long time in there
- 00:40:12where he was just doing it for
- 00:40:14free and um and that's what it was it
- 00:40:17was this Village of people who cared
- 00:40:19about our family and you when this
- 00:40:22happens to you and and toxic exposure
- 00:40:25generally this is my other case
- 00:40:27too you become part of a club that you
- 00:40:29never wanted to
- 00:40:31join but there are people who cannot
- 00:40:35wait to help you and you just have to
- 00:40:38believe that they're there and you have
- 00:40:39to find them and I'm so thankful we
- 00:40:42found ours not only did you guys find
- 00:40:46yours and many of those people you're
- 00:40:48still in touch with some of them you now
- 00:40:49work with as you mentioned but you made
- 00:40:53a commitment to pay it forward and be
- 00:40:55that person for other families give us
- 00:40:58the big picture on the current case that
- 00:41:02you're going through where no longer is
- 00:41:06it just one
- 00:41:08Builder uh one HVAC company but it's
- 00:41:11actually you versus the
- 00:41:15government I was working for doj when I
- 00:41:17started this Law Firm Department of
- 00:41:19Justice the Department of Justice I left
- 00:41:21the Department of Justice where I was
- 00:41:23doing personal injury defense for the
- 00:41:24United States to start this law firm and
- 00:41:27I called it just well I had one paralal
- 00:41:31it was just Pam and me I told her I
- 00:41:33could pay her for a year that was that
- 00:41:35was as as much as I could do right and
- 00:41:38we didn't know where our first case was
- 00:41:40going to come from but the week after we
- 00:41:43launched our little website CNBC did a
- 00:41:46story on my family that we had not
- 00:41:49planted by the way that was just they
- 00:41:50had reached out to us and but the story
- 00:41:54linked to my website and I got a
- 00:41:57thousand calls in two weeks incredible
- 00:41:59because there is such a need for this
- 00:42:02kind of Law and there were so many
- 00:42:04others who like me were just desperate
- 00:42:07for help and one of those calls was from
- 00:42:09Hawaii and they said I've been poisoned
- 00:42:12can you help and I had just been with
- 00:42:14some military families advocating to
- 00:42:15Congress about military housing so I
- 00:42:18knew what had happened in Hawaii the
- 00:42:20government had an enti a huge the
- 00:42:23government had a huge jet fuel blast
- 00:42:27the jet fuel contaminated the water
- 00:42:30system the government
- 00:42:32knew that it had gotten into the water
- 00:42:34they had hundreds of reports of the fuel
- 00:42:36was in the water and they told people
- 00:42:40that the water was safe they issued a
- 00:42:43press release that there's no indication
- 00:42:45the water was not safe so people
- 00:42:47continued to use this contaminated water
- 00:42:49they got very sick so I fly over to
- 00:42:52Hawaii I
- 00:42:54mean I had d I had my personal credit
- 00:42:57card and my cowboy boots I mean we had
- 00:43:00nothing right and I held my first town
- 00:43:04hall and I got on social media and I
- 00:43:07started speaking out about what was
- 00:43:09happening because I saw it in real time
- 00:43:11the government was saying people weren't
- 00:43:13sick and this was not a problem it was
- 00:43:15just in and out of people's bodies and
- 00:43:16don't worry it's just a little jet fuel
- 00:43:19and I was seeing sick people and I
- 00:43:22recognized them because that was me I
- 00:43:25was still on my own Rec recovery Journey
- 00:43:27so I passed them the mic and I would
- 00:43:29hold these town halls and I would invite
- 00:43:31the media and I would broadcast them
- 00:43:34publicly and I'd say you know come and
- 00:43:37listen to their stories these people are
- 00:43:39sick this is real and there was a group
- 00:43:42of people in Hawaii who said we are
- 00:43:44going to make this stop never again and
- 00:43:48we filed what I believe to be the first
- 00:43:50successful environmental toxin case
- 00:43:54against the United States um um and the
- 00:43:56government has now admitted
- 00:43:58liability and we're fighting about
- 00:44:00damages right now this little law
- 00:44:04firm with me and one paralal has now
- 00:44:07grown to 18 and we represent
- 00:44:127,500 people who were poisoned by the
- 00:44:14United States of
- 00:44:16America just in this one case this one
- 00:44:20jet fuel explosion incident this one
- 00:44:23case this one case yeah and these are
- 00:44:26people who are saying never again
- 00:44:29because just like me they're not just
- 00:44:31doing it for their own families they're
- 00:44:33doing it for all the other families
- 00:44:34they're doing it for all the other
- 00:44:37people who are on Navy water lines all
- 00:44:40the other people who live in military
- 00:44:41housing they're saying we we cannot
- 00:44:44poison our own people we cannot be
- 00:44:47Mission ready if we're sick we have to
- 00:44:50enforce the safety rules in this country
- 00:44:52and the only way you do that is or
- 00:44:55should say one of the ways you do that
- 00:44:58is the justice
- 00:45:00system and that's what we're doing and
- 00:45:03we're we're going to change the system
- 00:45:06you talked about how your own health was
- 00:45:08impacted by exposure to environmental
- 00:45:10toxins specifically
- 00:45:11mold are there stories that came back to
- 00:45:14you about these families and what was
- 00:45:17happening with them with this exposure
- 00:45:19to the contaminated water that you had
- 00:45:21mentioned that the government knew that
- 00:45:23they were exposed to from this jet fuel
- 00:45:25blast
- 00:45:26we talked earlier about the cyto kind
- 00:45:28storm that happens when you're exposed
- 00:45:30to toxins and that
- 00:45:35happens really no matter what the toxin
- 00:45:38is so yes it's a little bit different if
- 00:45:41it's jet fuel um or if it's Roundup or
- 00:45:46whatever it is there's slightly
- 00:45:47different slight differences but
- 00:45:49ultimately it's that same chronic
- 00:45:52systemic inflammation that occurs and
- 00:45:55and it attacks the brain so I saw
- 00:45:58clients who had exactly the same
- 00:46:00symptoms that I had the brain fog the
- 00:46:03feeling like they had been hit by a
- 00:46:05truck the confusion the attention
- 00:46:08challenges the vestibular dysfunction
- 00:46:11was a big one me short-term memory loss
- 00:46:15um and then of
- 00:46:16course the GI system right because they
- 00:46:20ingested the jet fuel unlike toxic
- 00:46:23exposure for toxic mold you you you
- 00:46:26smell it and of course you get dermal
- 00:46:29exposure and everything but in this case
- 00:46:32they
- 00:46:32ingested
- 00:46:34fuel so their esophagus and their GI
- 00:46:38system has been wrecked in many cases
- 00:46:41and then they had babies with Burns
- 00:46:45there
- 00:46:46were there were Military Officers on
- 00:46:49November 28th of 2021 texting pictures
- 00:46:54of babies with
- 00:46:56severe burns or
- 00:46:58rashes
- 00:47:00and receiving hundreds of reports of
- 00:47:04fuel in the water people called from all
- 00:47:06over the water
- 00:47:07line and yet those same people issued
- 00:47:11the press release that said there's no
- 00:47:13indication the water is not
- 00:47:15safe so there were they knew that there
- 00:47:18were babies that were affected and yet
- 00:47:21they had the audacity to say publicly
- 00:47:24don't worry pure water is fine there is
- 00:47:27no indication it's not safe it's it's
- 00:47:31outrageous and we have to hold them
- 00:47:34accountable and we can't continue to
- 00:47:37Gaslight our
- 00:47:38people if you uh watch the news or the
- 00:47:42tweets from Pol politicians and
- 00:47:46legislators you would feel that there's
- 00:47:49nothing more patriotic than having the
- 00:47:51backs of our military and military
- 00:47:54families
- 00:47:57what circumstances led to the
- 00:47:59situation that the government would say
- 00:48:04knowing that it wasn't true that the
- 00:48:06water was
- 00:48:08safe every institution wants to protect
- 00:48:11itself you saw that with the insurance
- 00:48:13companies they they go into
- 00:48:15self-protective mode and the same was
- 00:48:18true with the government they wanted to
- 00:48:20protect this military asset to them the
- 00:48:22asset of the jet fuel tanks this facil
- 00:48:25called Red Hill was more important than
- 00:48:28the people just that's the answer they
- 00:48:32had to protect itself the government had
- 00:48:34to protect itself the Navy had to
- 00:48:36protect itself they didn't want people
- 00:48:39to know that there had been this huge
- 00:48:41blast which was by the way because of
- 00:48:43their own negligence because of their
- 00:48:46own failures they wanted to protect
- 00:48:48their own reputations and they wanted to
- 00:48:50protect the asset and
- 00:48:53ultimately asset over people
- 00:48:56is what it came down
- 00:48:57to and it I I've had the benefit the
- 00:49:01pleasure really of deposing all these
- 00:49:03government officers many of them and and
- 00:49:07deposing I've had the the pleasure and
- 00:49:10benefit of
- 00:49:12deposing military
- 00:49:15doctors and good people who work for the
- 00:49:19government and if you ask them do you
- 00:49:22agree that if the government provides
- 00:49:25water it must provide Safe Water they'
- 00:49:28all of course of course of course yes do
- 00:49:31you agree that if the government
- 00:49:32contaminates the water which should
- 00:49:35never do see the first
- 00:49:36rule it must let you know right away
- 00:49:39must let us know right away to protect
- 00:49:42all of us from Mayhem illness cancer
- 00:49:45death every one of them of
- 00:49:49course well the government was providing
- 00:49:52the water there was fuel in the water
- 00:49:55the government government contaminated
- 00:49:56the water and then didn't tell people
- 00:49:59not to use
- 00:50:01it this case is not rocket science it's
- 00:50:05and and for that reason it's it's such a
- 00:50:08blessing to be a part of
- 00:50:11um it's a pretty simple case the
- 00:50:14government contaminated the water people
- 00:50:17used enough water to get
- 00:50:19sick the government didn't tell them not
- 00:50:21to use it because the government was
- 00:50:22protecting
- 00:50:24itself it's it's not hard and now the
- 00:50:28government what needs to make it right
- 00:50:30and the case is really about giving the
- 00:50:33government the opportunity to make it
- 00:50:35right so I'm a patriot I'm I'm patriotic
- 00:50:39I think that this is
- 00:50:41actually what the law is for and what
- 00:50:44this is what the tort
- 00:50:46law is for for the federal tort claims
- 00:50:49act that allows you to bring cases
- 00:50:51against the United
- 00:50:53States how much does the as ECT of it's
- 00:50:57not my job play
- 00:51:01into
- 00:51:03the component that you already mentioned
- 00:51:05which is a Big Driver which
- 00:51:07is we need to make sure we don't get
- 00:51:09into trouble we need to protect the
- 00:51:11asset how much of lack of responsibility
- 00:51:15is
- 00:51:17hey that's not our job that was somebody
- 00:51:19else's job does that play into this at
- 00:51:22all absolutely because every government
- 00:51:25off officer wants to say it was somebody
- 00:51:26else's job somebody else had the
- 00:51:29obligation to tell the
- 00:51:31people somebody else had the obligation
- 00:51:34to go check to see if this huge blast
- 00:51:37that leaked for 36 hours got into the
- 00:51:39water
- 00:51:40source somebody else had the O
- 00:51:43opportunity or the obligation to shut
- 00:51:45down the water how easy would that have
- 00:51:48been there was this huge blast on
- 00:51:50November 20th 36 hours of spew in jet
- 00:51:57fuel how easy would it have been to just
- 00:51:59turn off the water source just protect
- 00:52:02the water from that fuel this is not
- 00:52:05hard people and they they didn't do it
- 00:52:08because they didn't want to admit that
- 00:52:09it
- 00:52:10happened so it's it's very upsetting
- 00:52:14it's very upsetting and what's very
- 00:52:17upsetting now is that the government is
- 00:52:18still gaslighting people because the
- 00:52:21government is still saying okay we we we
- 00:52:23take responsibility for what happened
- 00:52:26there was a
- 00:52:27spill it got into the
- 00:52:30water but in the case itself the
- 00:52:33government lawyers are claiming that
- 00:52:35there wasn't even enough fuel to make
- 00:52:37people sick in the short
- 00:52:41term that's
- 00:52:43insane 4600 people had medical
- 00:52:46encounters before the government
- 00:52:48admitted that the water line was
- 00:52:50contaminated 4600
- 00:52:53people clearly it caused short-term harm
- 00:52:56that and and and the government is
- 00:52:58making the same claim that this was just
- 00:53:00a somatic response people had a somatic
- 00:53:03response to maybe the fuel
- 00:53:07smell I show them the picture of the
- 00:53:11baby is are those Baby Burns a somatic
- 00:53:16response so this is gaslighting at the
- 00:53:18highest levels and it
- 00:53:20continues and that's what's so upsetting
- 00:53:23because when when are we going to start
- 00:53:26to deal with the reality of what
- 00:53:28happened at Red Hill when are you going
- 00:53:31to acknowledge what
- 00:53:33happened the harm when are you going to
- 00:53:36acknowledge the harm what happened at
- 00:53:38Red Hill is a representation of a much
- 00:53:40bigger
- 00:53:42problem that I'd love for you to talk
- 00:53:46about these may seem like isolated
- 00:53:49incidents both your own home and we
- 00:53:51mentioned that millions of homes
- 00:53:56especially under the new building
- 00:53:57standards that are highly energy
- 00:54:00efficient that are keeping you in a
- 00:54:03energy efficient toxic
- 00:54:06chamber and again based on the World
- 00:54:08Health organization's own estimates
- 00:54:10which are on the conservative side that
- 00:54:12onethird of buildings have some form of
- 00:54:15toxic mold inside of them or mold that
- 00:54:18can be problematic to Health in that
- 00:54:21same way there are also potentially
- 00:54:24other military bases and housing
- 00:54:27bases that have their own challenges can
- 00:54:31you talk a little bit about this case
- 00:54:33and how it's
- 00:54:36really a canary in the coal mine of
- 00:54:39what's going on out there well the
- 00:54:41secretary of defense was asked about
- 00:54:44mold and housing you know what he
- 00:54:48said I don't have a mold problem I have
- 00:54:51a soldier problem he blamed it on the
- 00:54:54people who are
- 00:54:56sick so this is coming from the very
- 00:55:00very
- 00:55:01top and there's this sense of
- 00:55:06well these people are a little bit
- 00:55:09crazy really that that's what it is it's
- 00:55:12these people are just making a a
- 00:55:15mountain out of a mole hill they're
- 00:55:21somatic we cannot be Mission ready in
- 00:55:24this country
- 00:55:27if our military and our military
- 00:55:28families are
- 00:55:32sick we have a war in Israel right now
- 00:55:36the Middle East is very we're on the
- 00:55:39precipice
- 00:55:41right we have to have a fit and healthy
- 00:55:48military and they cannot be fit and
- 00:55:50healthy if we are poisoning them this is
- 00:55:52not rocket science they need at the
- 00:55:55minimum clean air and clean
- 00:55:58water that is a basic human right for
- 00:56:00all of us but it's a especially
- 00:56:03essential for our military and our
- 00:56:05military families and it's a problem on
- 00:56:08every military base either the water or
- 00:56:11the heir or both and the military
- 00:56:15leadership turns a blind eye because
- 00:56:19they're committed to just saying this is
- 00:56:20just a somatic
- 00:56:22problem it's deeply upsetting and it's
- 00:56:25gaslighting it's gaslighting but what I
- 00:56:28am trying to
- 00:56:29do is point to the
- 00:56:31facts
- 00:56:33and in Hawaii at the time I would hold
- 00:56:37these town halls and I'd invite the
- 00:56:38media and I'd pass the mic to my clients
- 00:56:42hear from them
- 00:56:43directly because they can no longer be
- 00:56:47silenced and that's what we need to
- 00:56:50continue to
- 00:56:51do tell the stories but also provide the
- 00:56:57actual evidence in the medical
- 00:56:59literature and for mold in particular I
- 00:57:02went to PubMed
- 00:57:04right there are 2022 2021 2023 I'm sure
- 00:57:09they're going to be 2024
- 00:57:11peer-reviewed articles about the dangers
- 00:57:15of toxic mold and toxic water and we
- 00:57:19have to we have to point to them and
- 00:57:22show government leadership the facts and
- 00:57:26say this is what is happening
- 00:57:28scientifically to people this is not
- 00:57:30this is not somatic this is
- 00:57:34real after uh MSNBC did that story on
- 00:57:37your family you had mentioned you got a
- 00:57:38call and one of those calls LED you to
- 00:57:41be an advocate and represent the
- 00:57:44families that are part of this case in
- 00:57:47Hawaii since that time period you guys
- 00:57:50have expanded the type of cases that
- 00:57:52you're going to be involved in and
- 00:57:55you're spreading the word and part of
- 00:57:56that is coming on this podcast and
- 00:57:58telling your
- 00:57:59story which is exciting for me because
- 00:58:01so many families truly feel like there's
- 00:58:03no hope and they don't know who to turn
- 00:58:05to they don't know what resources are
- 00:58:07out there for them and they end up
- 00:58:10suffering in silence and sort of giving
- 00:58:12up on having anybody be accountable if
- 00:58:13there was somebody to be
- 00:58:15accountable give us an idea just big
- 00:58:18picture of some of the other
- 00:58:20areas that you guys will be
- 00:58:23tackling I want to help anyone
- 00:58:28who is sick because somebody else made
- 00:58:32them sick right somebody else made a
- 00:58:35choice that led to and and mostly
- 00:58:40families to this family becoming sick
- 00:58:42right and that can be that is mostly
- 00:58:45toxic air and toxic
- 00:58:47water but it can be any toxic
- 00:58:51substance it can be red food food die
- 00:58:55right I I want us to hold the companies
- 00:59:01accountable for poisoning our
- 00:59:03bodies whatever that
- 00:59:06is and what we're finding when you dig
- 00:59:09in is that these companies
- 00:59:13know almost always they know whether
- 00:59:16it's the government or the whoever it is
- 00:59:19whoever the wrongdoer is whether it's a
- 00:59:21company or the government they know what
- 00:59:23they're doing
- 00:59:26and we need to say as a
- 00:59:31society no
- 00:59:33more you cannot get away with it anymore
- 00:59:37you cannot make this financial calculus
- 00:59:39that you're just going to do it anyway
- 00:59:41because we're going to be there and
- 00:59:44we're going to be there this is and this
- 00:59:46is how my firm is changing it okay in
- 00:59:48the in the day you would tell clients
- 00:59:51don't go on social media you know don't
- 00:59:53be careful what you say don't put
- 00:59:55yourself out there I'm like here's a mic
- 00:59:58here's here's a connection to Fox News
- 01:00:02here's you know CNBC I I want my clients
- 01:00:05to tell their stories because that's one
- 01:00:08way we bring
- 01:00:09accountability that's why I believe
- 01:00:13that's why the Navy is now defueling
- 01:00:15that Red Hill facility
- 01:00:18because the public the the public got
- 01:00:22involved so we have to fight these
- 01:00:24things in court and we have to find
- 01:00:26fight them in public and we have to
- 01:00:29fight them on social and when we do all
- 01:00:31those things at once I think we will
- 01:00:33bring real change and that's what we're
- 01:00:35about but if you're if you're listening

- 01:00:46call so we we have this philosophy that
- 01:00:50we will return your call no matter what

- 01:01:01want to raise up a network an army of
- 01:01:05lawyers to take these cases for people
- 01:01:07who have been harmed by environmental
- 01:01:08toxins or others and we we want to
- 01:01:13help well Christina even coming on this

- 01:02:41did not leave the house I told her to
- 01:02:42leave and she died at the age of 31 in
- 01:02:45the house I told her to leave
- 01:02:47environmental toxins are very dangerous
- 01:02:49and they can kill you ultimately so do
- 01:02:52not subject yourself or your family to
- 01:02:54talk toxic water or toxic
- 01:02:56air it will slowly kill you or it'll
- 01:02:59leave you close to
- 01:03:01De and my prayer for you if you're in
- 01:03:05that place is that you would get out
- 01:03:08that you would get help that you would
- 01:03:10find your helpers and that you would get
- 01:03:12well and that a year from
- 01:03:15now you would be well enough to help
- 01:03:19somebody
- 01:03:20else and it's by helping somebody else
- 01:03:25that our creator redeems our
- 01:03:29stories and I have the privilege of
- 01:03:32helping others and my Creator is
- 01:03:35redeeming our family
- 01:03:37story
- 01:03:40through the work that we can do
- 01:03:42now so that's really the message that I
- 01:03:45want to leave get out of
- 01:03:48contamination find your
- 01:03:50helpers and get well enough to help
- 01:03:53others m
- 01:03:55a powerful reminder you are super active
