- 00:00:36One of the witnesses people watching the
- 00:00:38Karen Reed trial have wanted to hear
- 00:00:40from the most is Jennifer McCabe. And
- 00:00:42they got to hear from her during the
- 00:00:44second week of Karen Reed's retrial.
- 00:00:46McCabe has been a key figure in the case
- 00:00:48because Karen Reed's defense has honed
- 00:00:51in on her as a key figure in their
- 00:00:53conspiracy theory that Reed was framed
- 00:00:55for the murder of Boston police officer
- 00:00:57John O'Keefe, who was Reed's boyfriend.
- 00:01:00The Commonwealth says that Reed was
- 00:01:02drunk that night in January of 2022 and
- 00:01:05that she and O'Keeffe argued outside of
- 00:01:07the Albert's house on Fair View Road and
- 00:01:09then Reed backed her SUV into O'Keeffe
- 00:01:11in a drunken rage and left him to die in
- 00:01:14the snow after a night of drinking. Reed
- 00:01:17has focused on Jen McCabe because she
- 00:01:19was with Karen Reed that morning when
- 00:01:21Reed found O'Keefe's body covered in
- 00:01:23snow in the yard along with Carrie
- 00:01:25Roberts. But more importantly, Reed has
- 00:01:27claimed that McCabe was part of the
- 00:01:29cover up because of a 2:27 a.m. Google
- 00:01:32search on Mabe's phone that reads, "How
- 00:01:35long to die in the cold?" Experts for
- 00:01:37the Commonwealth say that search
- 00:01:39actually happened after 6:00 a.m. and
- 00:01:41that McCabe Googled it at Reed's
- 00:01:43request. But to Karen Reed supporters,
- 00:01:45Jen McCabe is public enemy number one.
- 00:01:49Special prosecutor Hank Brennan started
- 00:01:51the questioning of McCabe by asking her
- 00:01:53to tell the jury about herself.
- 00:01:56Yeah. So, I um was a teacher and then
- 00:01:59once I had children, I stayed at home
- 00:02:01with them and basically was just kind of
- 00:02:04like your typical I don't know, small
- 00:02:08town mom. Um I was the room parent. I
- 00:02:12coached them. I
- 00:02:15I'll allow it, but why don't we Yes.
- 00:02:19Um, when I coached, I drove the kids
- 00:02:21back and forth on my team, would take
- 00:02:23them places, etc. McCabe then explained
- 00:02:26how she became friends with John
- 00:02:27O'Keefe. Share with us meeting John
- 00:02:29O'Keefe. Sure. When um my third daughter
- 00:02:33was in kindergarten, she became friends
- 00:02:35with John's niece. And um during that um
- 00:02:39kindergarten school year, um
- 00:02:42unfortunately, Kayle's um mother and
- 00:02:45father both passed away. and John uh
- 00:02:48moved in the house and became Mr. Mom.
- 00:02:52When John took over guardianship of the
- 00:02:54children, did you assist in an active
- 00:02:57role in helping him? Yes. Um Kaylee and
- 00:03:00my daughter were very close. So um she
- 00:03:03would come over and play. My daughter
- 00:03:05would go over there. Um Kaylee would
- 00:03:08come and have sleepovers. Um, a lot of
- 00:03:11times it would be on Friday nights I
- 00:03:14would have Kaye and then um, another
- 00:03:16individual would have Patrick.
- 00:03:19Had you known John O'Keefe well before
- 00:03:21he took over guardianship of the
- 00:03:23children? No.
- 00:03:25During the time when he was the guardian
- 00:03:27of the children, did your relationship
- 00:03:29not just with his niece and nephew but
- 00:03:30with him grow any closer? Yes, we became
- 00:03:33very good friends. U, how close of
- 00:03:36friends did you become over the years?
- 00:03:38Um well throughout the years obviously
- 00:03:40when they were younger um you know we
- 00:03:43talked more you know just about the
- 00:03:45logistics of CCD pickup drop off
- 00:03:47basketball
- 00:03:49um sports but then he would also call me
- 00:03:52you know about you know as the girls got
- 00:03:54older oh the girl drama or you know the
- 00:03:57hormones and things like that. This is a

- 00:04:40night when John O'Keefe and Karen Reed
- 00:04:42arrived and she said she was happy to
- 00:04:44see them. Then they all planned to go
- 00:04:46back to her sister's house on Fair View
- 00:04:48Road. Despite seeing Karen Reed's SUV
- 00:04:50out front, she says they never came
- 00:04:52inside. Then McCabe said she and her
- 00:04:55husband left. And your husband and you
- 00:04:58you passed by the front of the house?
- 00:05:00Yes. Did you pass by the flag pole? Yes.
- 00:05:03Were you looking at the flag pole? No.
- 00:05:07And uh how dark was it at that point? It
- 00:05:10was dark. Snow? Yes.
- 00:05:13As you're passing the flag pole, do you
- 00:05:16hear or see anything remarkable?
- 00:05:19No, I'm not really paying attention. And
- 00:05:20I'm just chatting to the girls and
- 00:05:22Matt's just focusing on driving. When
- 00:05:25you're talking to the girls and they're
- 00:05:26making fun of you, what's the mood in
- 00:05:27the car? We're all laughing and joking.
- 00:05:30Where do you go next? We drive um Julie
- 00:05:33Nagel home. Jen McCabe then explained
- 00:05:35what she did after she got home around
- 00:05:382:27 a.m. When you go to bed, do you
- 00:05:41stay up at all? Yes. Do you use your
- 00:05:43iPhone? Yes, I do. What were you doing?
- 00:05:47Um, I texted a few people and then I did
- 00:05:52a couple of Google searches. And what
- 00:05:54were the searches for? Um, one, my
- 00:05:56daughter had played in a basketball game
- 00:05:58earlier in the night and it was a very
- 00:06:01good game, so I went and I read the
- 00:06:03report on it. And then my other daughter
- 00:06:06had an offer to play um on a basketball
- 00:06:09um team. So, uh, we had to make a
- 00:06:12decision about whether or not we were
- 00:06:13going to accept the spot. So, I was just
- 00:06:15looking up that um basketball club.
- 00:06:18Other than those regular searches that
- 00:06:21one would do, was there anything
- 00:06:22remarkable about what you were searching
- 00:06:24at 2 227 that time frame? No.
- 00:06:30After you were looking at websites for
- 00:06:33your child's sports, what did you do? I
- 00:06:36put my phone down and went to sleep. And
- 00:06:38up to that point, had there been
- 00:06:41any discord or fighting or arguments in
- 00:06:45your world? No.
- 00:06:47Peaceful night? Yes. Did you go to
- 00:06:50sleep, Miss McCabe? Yes. Then McCabe
- 00:06:53told the jury about being awakened by a
- 00:06:55phone call.
- 00:06:58At
- 00:06:594:53, my phone rings and I look at my
- 00:07:02caller ID. I look at the phone and it's
- 00:07:05Kaye. John's niece. John's
- 00:07:08niece. Um, and I say hello and she said,
- 00:07:13"Yeah, well, basically she related to me
- 00:07:15that um,
- 00:07:18next question. When you pick up the
- 00:07:20phone, could you hear a voice on the
- 00:07:22other end?" I heard a voice and a lot of
- 00:07:24screaming. And the voice you heard, is
- 00:07:26that Kaylee, John's niece? Yes. In the
- 00:07:29screaming, was it a man or a woman
- 00:07:31screaming? It was a woman. How loud was
- 00:07:34that person screaming? very loud. Could
- 00:07:38you make out anything that person was
- 00:07:40saying as they were screaming? Um, my
- 00:07:42name was screamed a lot. Um, and then I
- 00:07:48the other individual ended up getting on
- 00:07:50the phone with me. And And who was that
- 00:07:52person that was screaming in the
- 00:07:55background? Miss Reed. How long was she
- 00:07:58screaming for while you were speaking to
- 00:08:00your niece before you spoke to her?
- 00:08:04Um, the entire time I was speaking to
- 00:08:07Kaye, she was screaming. Describe her
- 00:08:09demeanor.
- 00:08:11Miss Reads. Yes. Um, Jen,
- 00:08:16Jen. Um, and then she's screaming that
- 00:08:19John didn't come home. Um, she left him
- 00:08:22at the waterfall. She was hysterical. I
- 00:08:25was very hard to follow what she was
- 00:08:27saying.
- 00:08:29How long did that first call last for?
- 00:08:34I'm not sure how long. Um may possibly a
- 00:08:37few minutes. Um but it was loud enough
- 00:08:40and long enough that my husband shot up
- 00:08:42in bed thinking one of my kids had come
- 00:08:44in the room screaming.
- 00:08:48When without saying what your niece
- 00:08:50said, could you describe your niece's
- 00:08:52demeanor when you first spoke to her? I
- 00:08:54mean John's niece's demeanor.
- 00:08:57I would say Kaye sound concerned,
- 00:09:00uneasy. Okay.
- 00:09:04During that phone call, other than the
- 00:09:06screaming and the screaming of your
- 00:09:07name, did the defendant give you any
- 00:09:09information other than she had dropped
- 00:09:12John off at the waterfall. They had
- 00:09:14gotten into a fight. She had left him
- 00:09:15there and he didn't come home. But
- 00:09:17McCabe said Karen Reed then said
- 00:09:19something different after she revealed
- 00:09:21some information to her. I had told her,
- 00:09:24Karen, I saw you guys outside of u my
- 00:09:27sister's house. And then she told me she
- 00:09:30didn't remember being there. And then
- 00:09:34she went on to say, she started saying,
- 00:09:36"Could I have hit him? Did I hit him? I
- 00:09:38don't." And then she just
- 00:09:41was just all over the place, like
- 00:09:44screaming my name, screaming so many
- 00:09:46different things. She was hard to follow
- 00:09:48or understand. When she was saying to
- 00:09:51you, "Did I hit him? Could have I hit
- 00:09:53him." Was that before or after you
- 00:09:56informed her that you had seen her out
- 00:09:58front of your sister's house? It was
- 00:10:00after I told her that. She also informed
- 00:10:02me that she had cracked her tail light.
- 00:10:05And what about the howl long to die in
- 00:10:07the cold Google search? McCabe said that
- 00:10:09Karen Reed asked her to do that search
- 00:10:12after they found John O'Keefe's body on
- 00:10:14Fairview Road. And then at one point we
- 00:10:18saw um them moving John towards the um
- 00:10:22ambulance. And at that point um Miss
- 00:10:25Reed started yelling to Miss Robbins,
- 00:10:27"Go check on him. Are they working on
- 00:10:29him? Is he Is he dead? Is he dead?" And
- 00:10:32at that point, myself and Miss Reed got
- 00:10:34out of the car and um she started
- 00:10:37yelling and pulling on me to um Google
- 00:10:40hypothermia and Google how long it takes
- 00:10:43for somebody, you know, to die in the
- 00:10:44cold.
- 00:10:46When the defendant first asked you to
- 00:10:48Google an inquiry about hypothermia,
- 00:10:51were you still inside the police cruiser
- 00:10:54or were you outside? Um outside.
- 00:10:58What was the weather? I know it's an
- 00:11:00obvious question, but how cold was it?
- 00:11:02Um, it was very cold, windy, the snow
- 00:11:05was blowing. Um, as I stated, I have um
- 00:11:08multiple scerosis. So, when I am out in
- 00:11:11either extremely hot or cold
- 00:11:12temperatures, I lose um the feeling and
- 00:11:15sensation in my fingers. Um, which
- 00:11:18obviously made the googling very hard
- 00:11:20for me to do because of my, you know,
- 00:11:22motor skills. So when you were outside
- 00:11:25of the car with the defendant and she
- 00:11:27had asked you to do a search regarding
- 00:11:30hypothermia, did you try to do that?
- 00:11:32Yes, I did. Do you know the exact time
- 00:11:35from your memory? Not from reading or
- 00:11:37learning, but from your memory. Do you
- 00:11:38remember the exact time you did that?
- 00:11:40No. Um, was it after the police came
- 00:11:43that morning? Yes.
- 00:11:46Had you ever ever attempted to search
- 00:11:50about hypothermia any time before that
- 00:11:53moment? that morning? No. Or that day?
- 00:11:57No. That week? No. Was this the first
- 00:12:00time that morning after the defendant
- 00:12:02asked you to search that you searched
- 00:12:04that phrase? Yes, it was. And did you
- 00:12:07complete your search and get a result?
- 00:12:09So, I think I don't know what came up
- 00:12:11because I think as I entered it, I don't
- 00:12:13I think I misspelled things. Um, and so
- 00:12:17then I think I tried a second search.
- 00:12:20Um, and again, I don't think I even paid
- 00:12:24attention to what came up because we
- 00:12:26were already on to the next thing. Karen
- 00:12:28was already moving and screaming about,
- 00:12:30you know, the next thing to Carrie. As I
- 00:12:33mentioned, Karen Reed supporters say Jen
- 00:12:35McCabe is public enemy number one. Not
- 00:12:37only because of that Google search, but
- 00:12:39Mabe's supporters will tell you it's
- 00:12:41because she saw Karen Reed outside of
- 00:12:43Fair View Road that night and ruined her
- 00:12:46cover story. On cross-examination, Alan
- 00:12:48Jackson pointed out instances where he
- 00:12:51claims McCabe lied to federal
- 00:12:53investigators. Did reviewing those
- 00:12:55paragraphs refresh your recollection as
- 00:12:57to whether or not as to what you told
- 00:12:59those agents initially? I'm sorry, what
- 00:13:01you told those officers initially from
- 00:13:02that other law enforcement agency. Uh
- 00:13:05that about who you contacted in that
- 00:13:0710-minute interval.
- 00:13:10Yes, I told them. And you told them that
- 00:13:12you you had contacted your husband, Matt
- 00:13:14McCabe. Yes. And Carrie Roberts.
- 00:13:16Correct. I want to stick with that for
- 00:13:17just a quick second. One of the first
- 00:13:19calls you made after being contacted by
- 00:13:22this other law enforce these other law
- 00:13:24enforcement officers from a different
- 00:13:26agency. Uh, one of the first calls you
- 00:13:28made was to Carrie Roberts. Is that
- 00:13:29right?
- 00:13:32She was the first one. I That's what I'm
- 00:13:34asking. One of the first two calls you
- 00:13:36made, your husband, right? Come home.
- 00:13:39There's law enforcement outside my door.
- 00:13:41I'm guessing is what you said. Correct.
- 00:13:42I don't remember my exact words now. But
- 00:13:44I did ask him to come home. Correct. And
- 00:13:47Carrie Roberts. Okay. Yes. You wanted to
- 00:13:49let Miss Roberts know that you had been
- 00:13:51contacted by certain officers from a
- 00:13:54different agency. Correct.
- 00:13:57I was curious if I was curious as if
- 00:14:00they had already been to her. That was
- 00:14:02my that was my next question. You also
- 00:14:05wanted to find out had the have these uh
- 00:14:07law enforcement officers from this
- 00:14:09different agency contacted her? Correct.
- 00:14:12Yes. Cuz typically if you enter a town,
- 00:14:14she's Miss McCabe. Yes or no? Oh, sorry.
- 00:14:17I was just trying to explain. I'm sorry.
- 00:14:18Is that why you contacted her to find
- 00:14:20out if in fact they had contacted her
- 00:14:23before you? Yes or no? Yes. And you also
- 00:14:28wanted to find out what she told them if
- 00:14:31she had been contacted by them. Correct.
- 00:14:33That was your motive in calling her. No.
- 00:14:36So, you just wanted to find out had she
- 00:14:38been contacted. But if she had said yes,
- 00:14:41you weren't going to say, "And what the
- 00:14:43hell did they say? What' they ask you?"
- 00:14:46Well, I can't I most I can't say what I
- 00:14:49would have answered, what I would have
- 00:14:51asked her, but I know I was calling to
- 00:14:54see if they had been there. Yes. That
- 00:14:57was your intent. I called to ask her if
- 00:14:59they had been there. Yes. So, that was
- 00:15:01your intent? Yes. Yes. Okay. Jackson
- 00:15:04claims McCabe was trying to coordinate
- 00:15:06stories.
- 00:15:07Your motive in calling Carrie Roberts at
- 00:15:09that moment before your interview was to
- 00:15:13ensure that your story would line up
- 00:15:16with her story, Miss McCabe. Isn't that
- 00:15:18right? No, that is not.
- 00:15:22You wanted to find out if she had talked
- 00:15:24to these particular law enforcement
- 00:15:26officers and what she had told them so
- 00:15:29that your story could somehow align or
- 00:15:32it could inform how you responded to
- 00:15:34questions that they asked you. Isn't
- 00:15:36that true? That's not true. We both know
- 00:15:39what happened. We don't have to have a
- 00:15:40story. There is no story. There's what
- 00:15:43happened and that's it. So, if that's
- 00:15:45true, Miss McCabe,
- 00:15:48you have no reason to call Carrie and
- 00:15:51ask her if she had been contacted by the
- 00:15:53law enforcement agents because it's just
- 00:15:55the truth. Correct. We're going through
- 00:15:58this whole experience together. We call
- 00:16:00each other about everything. That's
- 00:16:02nothing more than that. I'm sorry. Let
- 00:16:04her finish her answer. Go ahead, Miss
- 00:16:06McCabe. You can finish that. There's
- 00:16:08nothing more than me calling and saying,
- 00:16:10"Hey, did they come to your house?"
- 00:16:11That's what we did when the media showed
- 00:16:13up. When Miss Reed's private
- 00:16:15investigator showed up, we just give
- 00:16:17each other the heads up. Hey, somebody's
- 00:16:19coming cuz we're just like normal moms.
- 00:16:21We're not used to this. Jackson
- 00:16:23continued his attack on Jennifer
- 00:16:24McCabe's credibility by using her grand
- 00:16:26jury testimony against her to imply her
- 00:16:29recollection of the night's events could
- 00:16:31be wrong. actually recounted to the
- 00:16:35grand jurors a conversation that you
- 00:16:38said my client had with a female EMT
- 00:16:43standing right there exactly as you
- 00:16:46testified to today. Female EMT. You see
- 00:16:50that? I do. Yes.
- 00:16:54And what did you say my client's
- 00:16:57statements were in front of that female
- 00:17:00EMT in this? I say that she said, "Could
- 00:17:03I have hit him? Is he dead?" It's
- 00:17:06actually, "Did I hit him?" Oh, sorry. I
- 00:17:08missed that part. I apologize. Did I hit
- 00:17:10him? Could I have hit him? Is he dead?
- 00:17:12Is he dead? Is he dead? And that was at
- 00:17:15the scene in front of the female EMT.
- 00:17:19Exactly the scene that you're
- 00:17:21describing. You attributed the three
- 00:17:23statements to my client to to death.
- 00:17:26Correct. There was many different times
- 00:17:28when we were talking to different EMTs.
- 00:17:31The female EMT, the men, police
- 00:17:34officers.

- 00:18:46believe, an EMT, a female, standing
- 00:18:48right next to me, listening to her,

- 00:19:03it was. And that was April
- 00:19:0626th, 2022. Correct. Correct. At one
- 00:19:10point, Jackson puts Trooper Proctor's
- 00:19:12report in front of McCabe. Let's take a
- 00:19:14look. Okay. Is there something specific
- 00:19:17I should be looking for? I don't think
- 00:19:19you're going to find it, Miss McCabe.
- 00:19:20It's for I hit him. So, again, jurors,
- 00:19:22disregard the comments. So, it's
- 00:19:25question answer format only. My question
- 00:19:28is, do you see the phrase I hit him as
- 00:19:32it's attributable to my client in that
- 00:19:35report? Objection.

- 00:19:58recall that?
- 00:20:00Yes, I told him.
- 00:20:03He was taking notes at the time. He was
- 00:20:06taking notes. Correct. Alan Jackson
- 00:20:08presses even harder. Trooper Proctor was
- 00:20:10taking notes.
- 00:20:12Yes. About your conversation?
- 00:20:15Yes, he was. He reviewed those notes. As
- 00:20:16a matter of fact, simple. I didn't
- 00:20:19review his notes. I think I've seen a
- 00:20:20report at one point or another.
- 00:20:26On that very day, January 29th,
- 00:20:302022, when you were asked to recount
- 00:20:32what happened at the scene,
- 00:20:35who was doing what and who said
- 00:20:37what? You never told Trooper Proctor
- 00:20:40that my client said I hit him either.
- 00:20:42Did you? Oh, I told him. Yes, I did. He
- 00:20:45just leave that out of his report.
- 00:20:48I'm not responsible for his report. No,
- 00:20:50you're not. But you have read his
- 00:20:52report. So again, no comments, Mr.
- 00:20:54Jackson.

- 00:20:58seen it before. Yes. Now, Karen Reed
- 00:21:01never seems to be at a loss for words,
- 00:21:03and she wasn't after McCabe's second day
- 00:21:05of testimony. What do you think today,

- 00:21:13about her change of demeanor?

- 00:21:31I we know all the details. We know all
- 00:21:33the changes in statements. It's just
- 00:21:35what will her reaction be? And
- 00:21:38uh it's just more of the same
- 00:21:40inconsistencies. Every statement's
- 00:21:42different under oath, not under oath
- 00:21:44with the cops are all wrong. Um this is
- 00:21:47this is very similar to what we saw a
- 00:21:48year ago. Do you think that she colluded
- 00:21:50with Carrie Roberts? Why is she so
- 00:21:52insensitive? Because she's lying. Do you
- 00:21:53think she colluded? Do you think she
- 00:21:55colluded with Carrie Roberts?
- 00:21:58There was there was influencing going
- 00:21:59on. The cross of Jen McCabe continued on
- 00:22:03Friday with Alan Jackson asking Jen
- 00:22:06McCabe about group text messages between
- 00:22:08her and her family. Julie said channel 4
- 00:22:11is in DNA. And that's from whom? Brian.
- 00:22:16So Brian Albert is explain what that
- 00:22:19text means.

- 00:22:23channel that Julie told him channel 4 is

- 00:22:56take that?
- 00:22:58I took that as John never came in the
- 00:23:01house. Who's the guy? John. John
- 00:23:05O'Keefe. Yes. And the beginning of that
- 00:23:07sentence is tell
- 00:23:09them that the guy never came in the
- 00:23:12house. Correct. Yes. That is a textbook
- 00:23:15example what we've just seen of
- 00:23:17witnesses colluding with one another
- 00:23:20about a subject matter that's under
- 00:23:21investigation. Correct. And move for
- 00:23:24instruction. All right. Jurors disregard
- 00:23:27that comment. Completely disregard that
- 00:23:30question. Then Alan Jackson turned his
- 00:23:32attention to the house long to die in
- 00:23:34the cold Google search. You Google
- 00:23:37searched the phrase house long to die in
- 00:23:40cold. Yes or no? Yes. on January 29th.

- 00:23:50So, you agree that you were on Google,
- 00:23:52correct? Yes. You agree that there was a
- 00:23:55search done at 2:27 a.m. Correct. I
- 00:23:58don't recall doing a search at 2:27. The
- 00:24:01paper says it. I don't. Okay. And you
- 00:24:03also agree that at some point that
- 00:24:05morning, you plugged into that phone
- 00:24:08host long to die in cold. Is that right?
- 00:24:10Yes. after we found John O'Keefe. Now,
- 00:24:13you claim that that was at 6:23 and at
- 00:24:166:24 in the morning. Two iterations of
- 00:24:19how long to die in the cold. How long to

- 00:24:26truth is what happened. On redirect,
- 00:24:29prosecutor Hank Brennan asked about that
- 00:24:31disputed Google search. Do you think

- 00:24:37night before or around that time when
- 00:24:40you were looking up Hakamok before you
- 00:24:42went to bed, were you of the same state
- 00:24:45of mind of fear and panic or were you in
- 00:24:47a very different state of mind?
- 00:24:48Objection. Strike the fear and panic
- 00:24:51part. You can answer that though. Were
- 00:24:52you of the same mind or different?
- 00:24:55Different. What was your state of mind
- 00:24:56at that time? I was relaxed. Just
- 00:25:00playing on my phone looking things
- 00:25:02before I went to bed. Do you think your
- 00:25:04heartbeat was as elevated that evening
- 00:25:06as it was the next morning? Sustained.
- 00:25:12When
- 00:25:13you made a search for how long to die in
- 00:25:17the cold or how's long to die in cold?
- 00:25:19Is that something that you thought of
- 00:25:21for yourself? Objection.
- 00:25:24No. Why did you do it? Miss Reed asked
- 00:25:27me to Google it. And when was that? That
- 00:25:31was in the morning after we found him.
- 00:25:34And had you
- 00:25:35ever attempted either of those searches
- 00:25:37before Miss Reed asked you to do that?
