there that do not want me to publish
  • 00:00:27
this video but for the rest of you let's
  • 00:00:35
go life is full of conflict and that's
  • 00:00:37
    normal builders and homeowners disagree
  • 00:00:40
all the time again that's normal and in
  • 00:00:42
Australia we have a system to help
  • 00:00:44
    resolve these conflicts that system
  • 00:00:46
    includes the government the regulators
  • 00:00:49
the courts the law and the police now
  • 00:00:52
I'm the first to admit that the system
  • 00:00:54
is flawed i see that every day working
  • 00:00:58
as an inspector but does that mean you
  • 00:01:00
can ignore it and do whatever you want
  • 00:01:02
    isn't that
  • 00:01:04
called chaos what you're about to see is
  • 00:01:07
a conflict between the builder and the
  • 00:01:09
homeowner that seems to go completely
  • 00:01:12
off the grid of civilized society and
  • 00:01:15
    into lawlessness
  • 00:01:18
we're going to share some footage so you
  • 00:01:20
guys can make your own mind but before
  • 00:01:22
    we do here's the
  • 00:01:28
backstory last December I was engaged by
  • 00:01:30
a homeowner in Strathmore to do what we
  • 00:01:32
call a construction stage inspection on
  • 00:01:35
their home to see how things were
  • 00:01:36
    progressing the homeowner was concerned
  • 00:01:39
they believed things were going wrong
  • 00:01:41
and the builder wasn't cooperating to
  • 00:01:43
rectify them they had already spent over
  • 00:01:46
$3 million the homeowner has asked a
  • 00:01:50
    representative from the cladding
  • 00:01:52
manufacturer to attend the site to check
  • 00:01:54
the cladding installation he'd given it
  • 00:01:58
a thumbs down the builder was not happy
  • 00:02:00
with this i then attended site and
  • 00:02:02
conducted my own inspection i found a
  • 00:02:05
    number of non-compliant items that
  • 00:02:07
needed rectification and I submitted my
  • 00:02:09
report to the homeowners the builder
  • 00:02:11
then claims later on that the job has
  • 00:02:15
been rectified so then I show up but
  • 00:02:18
before I can even get out of my car I
  • 00:02:20
get a text message from the homeowner
  • 00:02:22
saying "Hi Zaha do not approach site
  • 00:02:24
today at 2 p.m." So I pack up and I go
  • 00:02:28
then last week the homeowner decides to
  • 00:02:31
terminate the contract with the builder
  • 00:02:34
and on the day of termination the
  • 00:02:36
homeowner comes to the job site to
  • 00:02:39
retake possession of their own property
  • 00:02:41
as is their right that is until he his
  • 00:02:44
colleagues and some of his trades have
  • 00:02:47
removed what they believe is still
  • 00:02:50
theirs now we haven't seen the contracts
  • 00:02:52
    transactions or communications between
  • 00:02:54
the homeowner and the builder so I'm not
  • 00:02:57
making any claims about any of those
  • 00:02:59
things but when you watch this footage
  • 00:03:01
just ask yourself is this really how
  • 00:03:04
conflict should be resolved and is our
  • 00:03:06
system working is this sort of thing
  • 00:03:08
allowed to happen with no consequences
  • 00:03:11
for anyone and this gentleman in the
  • 00:03:14
black t-shirt who's trying to access his
  • 00:03:16
    own home is the other
  • 00:03:19
homeowner the clip starts when the
  • 00:03:21
police first attend site to supposedly
  • 00:03:24
resolve the conflict but you won't
  • 00:03:26
    believe what happens next
  • 00:03:33
again like I'll say it's still very
  • 00:03:36
civil and this will still go through a
  • 00:03:38
civil litigation as to what hasn't
  • 00:03:40
hasn't been paid for okay so I've got
  • 00:03:43
proof that I've paid for every item he's
  • 00:03:45
taken he probably has proof as well he
  • 00:03:46
doesn't i've got Please move your car
  • 00:03:49
okay first of all please move your car i
  • 00:03:51
will a sec what is he actually removing
  • 00:03:52

  • 00:03:54
remove whatever I want i was working can
  • 00:03:56
we be told what he was construction i
  • 00:03:57
    don't need to it's a construction site
  • 00:03:59
there's nothing in there look at the
  • 00:04:01
photos photos there's nothing in there
  • 00:04:05
he just needs reason why can't we go in
  • 00:04:06
there it's just draining the process
  • 00:04:08
that's all he's doing hindering of the
  • 00:04:10
real issue move your car let us do our
  • 00:04:12
job and we'll leave with no problems
  • 00:04:17
whatever at this stage of the job move
  • 00:04:20
my car move my car i'm protesting i'm
  • 00:04:23
going to lie down here no all right
  • 00:04:25
sorry do not do not it's getting to the
  • 00:04:28
point where we're going to end up
  • 00:04:29
breaching you for peace okay and I'm
  • 00:04:32
going to give you a lawful direction to
  • 00:04:34
move on okay if you give us a lawful
  • 00:04:35
direction yeah give us a lawful
  • 00:04:38
direction you're saying this is a civil
  • 00:04:39
matter yeah yeah but you're and he's
  • 00:04:41
entitled He's entitled to remove his
  • 00:04:44
stuff as he leaves he's not allowed to
  • 00:04:47
remove my stuff what he's doing right
  • 00:04:49
now is he's dismantling the property
  • 00:04:51
that we've paid $3.5 million to him for
  • 00:04:54
and he's removing it why is it against
  • 00:04:56
me not against him okay so my car will
  • 00:04:58
stay here he can leave the stuff there
  • 00:04:59
and if he's entitled to the driveway
  • 00:05:01
which is against the law against road
  • 00:05:03
    but he's terminated
  • 00:05:06
right now it's being a traffic
  • 00:05:07

  • 00:11:35
corner or something [ __ ] so what
  • 00:11:36
happened here what happened i whacked my
  • 00:11:37
    head
  • 00:11:38
[ __ ] man ah so so what did they take
  • 00:11:42
i'll show you so we we we made a lot of
  • 00:11:44
    noise to stop video
  • 00:11:48
they Well what about here so they took
  • 00:11:50
all the cabinetry off yeah yeah well
  • 00:11:52
they trying to get the joiners they're
  • 00:11:54
trying to get the joiners they had the
  • 00:11:55
joiners outside but we wouldn't let the
  • 00:11:57
joiners in i left yep far out man so
  • 00:12:01
they had all the joiners here they lined
  • 00:12:03
up the joiners and everybody else they
  • 00:12:04
had all these cars lined up at the front
  • 00:12:06
to take everything but but you guys
  • 00:12:07
didn't know about that no you guys
  • 00:12:09
didn't know that they were doing this no
  • 00:12:10
no cuz they making out that and there
  • 00:12:12
wasn't any agreement that hey man all
  • 00:12:14
right we're going to end the contract
  • 00:12:15
you could take this no yeah yeah okay
  • 00:12:18
all of this was fitted off as you know
  • 00:12:20
oh this is all those lights were in this
  • 00:12:23
is how he's left them we got lights we
  • 00:12:24
got power here wasn't that all fitted
  • 00:12:26
    when I was here
  • 00:12:27
    doors cabinets um lights switches
  • 00:12:30
everything we paid for these direct we
  • 00:12:33
paid ENS direct for all this stuff we
  • 00:12:35
paid Harvey Norman so bad are you
  • 00:12:37
disappointed with that building you seen
  • 00:12:39
something like this what about the down
  • 00:12:40
    lights were they connected
  • 00:12:43
    my goodness
  • 00:12:45
so you caught them in time yeah pretty
  • 00:12:47
much and where's the light switches now
  • 00:12:50
they're gone they're not here in the
  • 00:12:51
garage no no took them we're telling the
  • 00:12:53
cops they're not taking tools we're
  • 00:12:55
telling the police they're not taking
  • 00:12:56
    tools they're They're dismantling the
  • 00:12:57
plate they wouldn't believe it they They
  • 00:12:59
tried to take this 100% yeah they took
  • 00:13:01
the Yeah look look see that look yeah
  • 00:13:04
    look it's um Look it's off it's
  • 00:13:06
disconnected all these taps were fitted
  • 00:13:08
so yeah all these taps were fitted the
  • 00:13:10
showers were fitted all of these were
  • 00:13:12
    fitted we stole them all
  • 00:13:18
that's I've never ever seen that in my
  • 00:13:20
    life
  • 00:13:22
finally it was time for me to do what
  • 00:13:25
I've been waiting to do for over a month
  • 00:13:28
reinsspect the house it was pretty weird
  • 00:13:31
feeling walking around the house that
  • 00:13:33
had been recently stripped by the
  • 00:13:35
builder as you can see beautiful view
  • 00:13:37
guys really nice location here in
  • 00:13:39
    Strathmore massive home this is
  • 00:13:42
basically a reinspection of the stuff
  • 00:13:45
that we picked up last time from our
  • 00:13:47
    initial inspection the builder denied
  • 00:13:49
access as you know and I couldn't
  • 00:13:51
actually came to the job here a
  • 00:13:52
homeowner said "Hey we don't want to
  • 00:13:53
escalate this please leave the job." So
  • 00:13:55
we cancelled the job when I was
  • 00:13:56
literally here so we couldn't reinspect
  • 00:13:58
the works that he's done so this is the
  • 00:14:00
first time that I've come to the job
  • 00:14:02
after our initial inspection so this is
  • 00:14:04
like just the raw findings of what I'm
  • 00:14:07
about to show you guys and I'm going to
  • 00:14:08
show you screenshots of how the job was
  • 00:14:10
before and what they've done now i'm
  • 00:14:12
going to show you some of the things
  • 00:14:13
that they said they've rectified in
  • 00:14:15
terms of the non-compliant works and I'm
  • 00:14:17
going to start with the roof when we
  • 00:14:18
initially came to the job we found a lot
  • 00:14:21
of roofing items and some of the things
  • 00:14:22
that I've never seen before we look at
  • 00:14:23
this sump here at the start of an
  • 00:14:25
inspection when we done it there was an
  • 00:14:28
a high capacity overflow setup like this
  • 00:14:30
you can see what's going on here he's
  • 00:14:32
got this and he's also got a side duck
  • 00:14:34
overflow this was undersized so they've
  • 00:14:36
increased the length of it uh and and
  • 00:14:38
looks like the width my complaint was
  • 00:14:40
about hey man this is never seen this
  • 00:14:43
before can you please explain what's
  • 00:14:44
going on so these guys just uh chucked
  • 00:14:46
in this uh oversized overflow left this
  • 00:14:49
    high capacity overflow setup which
  • 00:14:51
discharges into the rain head and I said
  • 00:14:54
"Hey look there's an overflow here
  • 00:14:55
that's discharging into the rain head
  • 00:14:57
how's the homeowner going to know that
  • 00:14:58
this is blocked?" They've just changed
  • 00:15:00
this have a look at this finish guys
  • 00:15:03
they just smashed it like that put it on
  • 00:15:05
we had some spreaders that were not half
  • 00:15:08
capped so they were spreading to the
  • 00:15:10
opposite direction of flow and it wasn't
  • 00:15:12
sealed they've sealed it they've done
  • 00:15:13
that condensation drain there that was
  • 00:15:15
not discharging into the drainage outlet
  • 00:15:18
they fixed that there's another section
  • 00:15:19
as well this is actually incorrect and
  • 00:15:21
    it's in breach of
  • 00:15:23
    AS3500.3 they've modified this overflow
  • 00:15:27
to obviously make it longer and the high
  • 00:15:29
capacity setup this is this is not
  • 00:15:31
compliant it's got to be 600 mil minimum
  • 00:15:33
and it's undersized so this whole
  • 00:15:35
section and you utilizing this is not
  • 00:15:37
compliant extending this to the rain
  • 00:15:39
head as well not seeing it discharge
  • 00:15:41
    atmosphere is also non-compliant you've
  • 00:15:43
got this slide duct overflow has to be
  • 00:15:46
installed to a measurement that is
  • 00:15:48
within the sump so now you can see the
  • 00:15:50
sump is about 500 mil so this has to be
  • 00:15:54
central to it so this setup here the
  • 00:15:57
    whole thing is still non-compliant
  • 00:15:59
another issue that we picked up on the
  • 00:16:00
previous report is that uh the capping
  • 00:16:03
did not have enough grade towards the
  • 00:16:05
roof line it has to be minimum of 5°
  • 00:16:09
angle to the roof these guys have lifted
  • 00:16:11
this lip up which caused like a little
  • 00:16:13
dip here and water is still ponding and
  • 00:16:16
you can see it's at three degrees here
  • 00:16:18
and you can see the water ponding where
  • 00:16:20
the penetration is here that's still
  • 00:16:22
non-compliant you can see all the dirt
  • 00:16:23
as well have a look guys i said to them
  • 00:16:26
also you got to put a expansion joint
  • 00:16:28
between two fixing point of 6 m anything
  • 00:16:31
over 6 m between two fixing points which
  • 00:16:33
is lump as well you got to put put an
  • 00:16:35
expansion joint these guys have done
  • 00:16:37
    this
  • 00:16:38
i'm guessing I don't even know what the
  • 00:16:40
hell is this guys but they've done that
  • 00:16:41
so still the expansion joint requirement
  • 00:16:43
has not been attended to yet so still
  • 00:16:46
non-compliant if we measure the fall of
  • 00:16:50
    this overflow duct 3500.3 it's got a
  • 00:16:55
detail that a lot of people don't know
  • 00:16:56
about and uh sometimes I measure this
  • 00:16:59
    sometimes I don't because I can't fit my
  • 00:17:02
level inside but the thing is this one I
  • 00:17:04
could you can see that it's 17 mil out
  • 00:17:07
there's a fall towards the sump like
  • 00:17:10
backwards down there 17 mil down instead
  • 00:17:13
of towards atmosphere so that's also
  • 00:17:16
non-compliant as we look at the lower
  • 00:17:18
roof these rain heads are supposed to be
  • 00:17:20
installed to the other side of the wall
  • 00:17:22
it's kind of like a design thing where
  • 00:17:25
the homeowner probably didn't want to
  • 00:17:26
see these rain heads when they're
  • 00:17:28
sitting around here um so I picked up on
  • 00:17:31
that they haven't fixed that they didn't
  • 00:17:32
come back and tell me why they why they
  • 00:17:34
did that the rain heads were non
  • 00:17:35
compliant so you can see how they've cut
  • 00:17:37
them out to attempt to make them
  • 00:17:38
compliant and we're going to see if they
  • 00:17:39
are the box gutter projects into the
  • 00:17:42
rain head basically when it's projecting
  • 00:17:44
like that it can activate the overflow
  • 00:17:47
that's why the standard shows that it's
  • 00:17:50
supposed to be folded all the way around
  • 00:17:52
and stitched every 40 mil that wasn't
  • 00:17:54
done like that and it's still
  • 00:17:55
non-compliant you can see that they
  • 00:17:57
    haven't sealed the bottom it's a
  • 00:17:59
requirement to seal the bottom as well
  • 00:18:00
they've just put silicon it's supposed
  • 00:18:02
to be flashed properly overlapped so
  • 00:18:04
they haven't done that so all we all we
  • 00:18:06
want to do is hey I came to the job
  • 00:18:08
before we didn't do any videos we picked
  • 00:18:10
up a a bunch of items we forward it to
  • 00:18:13
the builder for him to fix he's
  • 00:18:15
attempted to fix a lot of the items and
  • 00:18:17
that's what we're showing now and uh all
  • 00:18:20
he had to do was let us through back
  • 00:18:21
here to have a look at everything and
  • 00:18:23
keep going it's simple we always we
  • 00:18:25
always come across homes that have
  • 00:18:27
    defects non-compliant items sometimes
  • 00:18:29
you don't follow the plans and you just
  • 00:18:31
got to attend to it it's really simple
  • 00:18:33
not trying to stuff anyone up but now
  • 00:18:36
this guy here has escalated the it went
  • 00:18:38
out of control and now it's going to go
  • 00:18:40
to court it's a massive battle now now
  • 00:18:42
if we look at the capping here supposed
  • 00:18:44
to be five degree fall i can tell
  • 00:18:47
already it's not even five it's one they
  • 00:18:49
haven't done this they haven't done this
  • 00:18:50
one as well 1.75 so there's a lot of
  • 00:18:53
things that they haven't attended to
  • 00:18:54
here here 4.85 all right so big box
  • 00:18:59
cutter as well you can see how they've
  • 00:19:01
tried their best and cork the rest here
  • 00:19:04
let's have a look underneath as well
  • 00:19:06
same thing not sealed same thing over
  • 00:19:08
there non-compliant as well so the box
  • 00:19:12
cutters on this side are all still
  • 00:19:13
non-compliant they're not sealed to the
  • 00:19:16
rain head we've already forwarded our
  • 00:19:18
report to the VBA so the VBA have got
  • 00:19:20
our report now and uh let's see what
  • 00:19:23
they're going to do we got this as well
  • 00:19:25
here where the water just ponding
  • 00:19:26
instead of running off to the drainage
  • 00:19:28
system here the box cutter and then to
  • 00:19:30
the sump the sump here is also
  • 00:19:34
    non-compliant no performance solution
  • 00:19:36
has been provided reverse pop going on
  • 00:19:40
here now if we look behind this massive
  • 00:19:42
shroud here that looks really nice let's
  • 00:19:45
have a look what's going on under here
  • 00:19:47
    guys look piece of
  • 00:19:51
    timber another piece of timber
  • 00:19:53
    there have a
  • 00:19:56
    look look at that guys
  • 00:19:59
so the homeowner should be really
  • 00:20:01
careful just about 70 mil which is
  • 00:20:04
non-compliant at the high end uh
  • 00:20:07
    according to
  • 00:20:10
AS3500.3 so this whole box cutter needs
  • 00:20:13
to be lower that this uh section or they
  • 00:20:15
have to get a performance solution to
  • 00:20:16
tell us how this is going to perform the
  • 00:20:18
    flashing is still non-compliant here
  • 00:20:20
doesn't extend past the reveal they've
  • 00:20:22
extended the condensation drain all the
  • 00:20:25
way to here but it has to go to the
  • 00:20:27
    downpipe so that's also non-compliant
  • 00:20:29
let's have a look what they've got under
  • 00:20:30
here check it out guys you can see a
  • 00:20:32
    timber frame
  • 00:20:38
wow one of the main issues that the
  • 00:20:41
    homeowner was complaining about
  • 00:20:42
regarding this home is that the cladding
  • 00:20:45
installation here did not meet the
  • 00:20:48
requirements of the manufacturer and I'm
  • 00:20:51
going to show you some shots of how the
  • 00:20:53
cladding was before it is still
  • 00:20:55
defective by the way but have a look at
  • 00:20:57
the way they've installed it this was
  • 00:20:59
the actual finished product until we
  • 00:21:02
came on site that would that's what
  • 00:21:04
triggered the whole inspection the whole
  • 00:21:06
inspection was triggered by the cladding
  • 00:21:08
did not look like what was intended to
  • 00:21:11
it looked so bad like just us looking at
  • 00:21:13
it right now like you can see all these
  • 00:21:16
butt joints how they're how they're
  • 00:21:18
being patched up and painted i mean look
  • 00:21:21
at this guys really bad workmanship and
  • 00:21:24
you might you might be saying like "Yeah
  • 00:21:26
man that's normal." But it's not as per
  • 00:21:29
    the manufacturer's installation manual
  • 00:21:30
the way they've advised to install it
  • 00:21:32
i'm going to go through the items that
  • 00:21:34
we picked up so let's get right into
  • 00:21:36
it so the cladding that you see behind
  • 00:21:39
    me it's actually a hardwood product it's
  • 00:21:42
silver top ash and it's an Australian
  • 00:21:45
hardwood product often used for cladding
  • 00:21:49
because of its durability and aesthetic
  • 00:21:51
grain now they've painted it white as
  • 00:21:54
you can see but uh the homeowner just
  • 00:21:57
wanted a nice hardwood home you know
  • 00:22:00
painted it white that that's what they
  • 00:22:01
wanted now if they would have followed
  • 00:22:03
the installation manual they would have
  • 00:22:06
installed it as per the standards and
  • 00:22:09
    the manufacturers's installation manual
  • 00:22:10
now the manufacturer did come to site
  • 00:22:12
and he deemed it defective and I'm going
  • 00:22:15
to show you an extract from some of his
  • 00:22:16
stuff that he said there hi Iran thanks
  • 00:22:20
for your time on site yesterday after
  • 00:22:22
seeing the job here are some points that
  • 00:22:25
I have taken away item one screw fixing
  • 00:22:29
still unsure how this was fixed 110 mm
  • 00:22:33
should be a face fix with either one and
  • 00:22:36
one secret fix screw or two screws
  • 00:22:39
across the face as per installation
  • 00:22:41
guide item two batterns in behind the
  • 00:22:45
cladding are these spaced at 450 mm
  • 00:22:49
centers and do you have a spacer in
  • 00:22:52
behind the bats and in between the
  • 00:22:54
sacking to allow for air to travel
  • 00:22:56
freely and moisture to escape from in
  • 00:23:00
behind the boards item three flashings
  • 00:23:04
required 10 mm minimum gap from end
  • 00:23:07
grains to flashing to allow any moisture
  • 00:23:10
in behind the boards a way to escape
  • 00:23:12
from in behind the building item four
  • 00:23:16
joins on each join a filler has been
  • 00:23:19
used which is leaving a bump box ray
  • 00:23:22
section which really shows up when the
  • 00:23:24
light hits it joints should have been
  • 00:23:27
done as per the below recommendation
  • 00:23:29
using sealer and not a filler item four
  • 00:23:34
paint when painting timber cladding this
  • 00:23:37
should always be done prior to
  • 00:23:39
    installation to completely seal the
  • 00:23:41
    boards when painting after installation
  • 00:23:44
there will be areas especially after
  • 00:23:46
seasonal movement that will be exposed
  • 00:23:49
with no paint and moisture can get in
  • 00:23:52
behind the paint and cause issues such
  • 00:23:55
as warping excessive movement or peeling
  • 00:23:58
paint i have cut back boards and
  • 00:24:00
attended to items however there is no
  • 00:24:03
    movement or moisture getting into
  • 00:24:06
boards i think you have missed the point
  • 00:24:08
    and issue with the boards
  • 00:24:11
when the sun hits at a particular time
  • 00:24:14
of day all filler shows up where the
  • 00:24:16
    boards but
  • 00:24:18
join you mentioned that that is the way
  • 00:24:20
it is with the boards when paint is
  • 00:24:22
applied to them especially white you
  • 00:24:26
also mentioned that had you known we
  • 00:24:29
were painting them you wouldn't have
  • 00:24:31
sold us the product hi Imran with all
  • 00:24:35
due respect some of these things I have
  • 00:24:37
seen on site can cause issues with
  • 00:24:40
    excessive movement and poor performance
  • 00:24:42
of the boards i said I would always
  • 00:24:46
recommend another product not that I
  • 00:24:48
wouldn't sell you the product just due
  • 00:24:50
to the cost when it's being painted as a
  • 00:24:53
flat white but some people prefer timber
  • 00:24:56
as it's a natural product things to do
  • 00:24:59
    to try rectify
  • 00:25:01
one fix flashings with correct opening
  • 00:25:04
two carefully sand back joints to the
  • 00:25:08
raw timber no filler bumps being careful
  • 00:25:12
not to make noticeable gouges in the
  • 00:25:14
timber and repaint three might be worth
  • 00:25:17
scraping off any excess paint in the
  • 00:25:19
joints and making sure this is
  • 00:25:21
completely sealed painted again with no
  • 00:25:24
drip lines and excess paint which can
  • 00:25:27
create water traps hi Luke I met with
  • 00:25:30
Ned and Cat my clients and owners of the
  • 00:25:33
property and they mentioned they have
  • 00:25:35
been in touch and that the issue with
  • 00:25:37
boards is an installation issue is this
  • 00:25:41
correct can you please confirm what you
  • 00:25:43
mentioned is the same issues as you
  • 00:25:46
identified below however we both know
  • 00:25:48
that it is not the case and that this is
  • 00:25:50
just the nature of the product none of
  • 00:25:53
the items identified relate to carpentry
  • 00:25:56
or install method and the install was
  • 00:25:59
done as per install guide and done by
  • 00:26:02
    experienced carpenters the boards have
  • 00:26:04
not come and undone and are perfectly
  • 00:26:06
flush and intact there is no splitting
  • 00:26:09
and there is no movement in boards or
  • 00:26:11
    cracks in butt
  • 00:26:12
joints below is what you identified to
  • 00:26:15
be issues on site i have put comments in
  • 00:26:18
brackets one fix flashings with correct
  • 00:26:22
opening this has been now cut back and
  • 00:26:25
was only done this way as we were
  • 00:26:27
advised to put boards to windows with no
  • 00:26:29
stops two carefully sand back joins to
  • 00:26:34
the raw timber no filler bumps being
  • 00:26:37
careful not to make noticeable gouges in
  • 00:26:39
    the timber and
  • 00:26:40
repaint this has been refilled sanded
  • 00:26:44
and painted and has never been the issue
  • 00:26:46
    or an issue
  • 00:26:48
the paintwork has been finished to above
  • 00:26:50
standard and we have done everything we
  • 00:26:53
can to achieve the right finish if you
  • 00:26:55
want no filler then every single butt
  • 00:26:58
    join will show
  • 00:26:59
correct three might be worth scraping
  • 00:27:03
off any excess paint in the joints and
  • 00:27:05
making sure this is completely sealed
  • 00:27:07
and painted again with no drip lines and
  • 00:27:09
excess paint which can create water
  • 00:27:11
traps this has also been done and can
  • 00:27:14
still be done however natural timber is
  • 00:27:16
always going to expand and contract due
  • 00:27:18
to its nature i may again definitely
  • 00:27:21
disagree and your response is a
  • 00:27:24
deflection glad you agree that white
  • 00:27:26
paint shows all imperfections would be
  • 00:27:29
good to see you agree on your comment on
  • 00:27:31
site when you chuckled and said "If you
  • 00:27:33
knew this would be painted white you
  • 00:27:36
would not have sold us the product." I
  • 00:27:38
    would have recommended another product
  • 00:27:40
we have done many painted projects and I
  • 00:27:43
will always recommend a panel style
  • 00:27:45
product as it's a lot less labor cost
  • 00:27:49
when the timber is just going to be
  • 00:27:50
painted anyway and it will be more
  • 00:27:53
stable item one you wrote incorrect
  • 00:27:57
    flashing setup which has caused
  • 00:27:59
    excessive swelling around all windows
  • 00:28:01
agreed to this and we were told to
  • 00:28:03
install flush with no stops and have
  • 00:28:06
since cut back and can cut the rest it's
  • 00:28:09
not only linked to the bottom of boards
  • 00:28:11
but this does raise the moisture of the
  • 00:28:13
total board as it sucks it up through
  • 00:28:16
the end grains just because you can't
  • 00:28:18
see any movement up top dosent mean it's
  • 00:28:22
not having an adverse effect on the
  • 00:28:24
boards we have done testing on this in
  • 00:28:26
our yard by putting lengths in a bucket
  • 00:28:29
and measuring moisture at the top of the
  • 00:28:32
board and it can raise the moisture
  • 00:28:34
    content which can cause excessive
  • 00:28:36
    movement and possible degradation of
  • 00:28:39
boards item two you wrote 110 by 19 mm
  • 00:28:45
board is recommended to be face fixed we
  • 00:28:47
have face fixed on joins and secret
  • 00:28:50
screwed if you want every screw to show
  • 00:28:53
i will go over each board and ensure two
  • 00:28:56
screws are installed and all filler will
  • 00:28:58
again show which will also prove my
  • 00:29:00
point of the board is not suited for a
  • 00:29:02
seamless finish would love to see your
  • 00:29:05
response then please let me know if you
  • 00:29:08
would like me to do this your
  • 00:29:11
recommendation also shows it can be
  • 00:29:13
secret fixed those decisions aren't up
  • 00:29:15
to me all we can do is recommend it's up
  • 00:29:19
to you guys to work out the best course
  • 00:29:21
of action and raise issues when things
  • 00:29:24
    go against the supplers's
  • 00:29:26
    recommendation most people would leave
  • 00:29:28
the screws showing or choose a profile
  • 00:29:31
that is a better option for concealed
  • 00:29:34
fixing item three you wrote paint or
  • 00:29:38
    finish should be done pre-installation
  • 00:29:40
on all sides of the board for a nice
  • 00:29:42
clean finish and to seal the whole board
  • 00:29:45
    properly the paintwork is finished
  • 00:29:47
correctly and is not causing any issues
  • 00:29:50
to the board which is evident on
  • 00:29:52
site this is not the issue and we have
  • 00:29:55
certification from Dulix to back this
  • 00:29:59
up all boards are sealed and painted
  • 00:30:01
correctly and this is evident as there
  • 00:30:04
is no sign of bleeding again we can
  • 00:30:06
agree to disagree but I have seen this
  • 00:30:09
exact problem many times when you paint
  • 00:30:12
after install as soon as the timber
  • 00:30:14
shrinks slightly there is raw timber
  • 00:30:16
lines which can cause water trap issues
  • 00:30:19
plus is just dosent give you a nice
  • 00:30:23
finish the paint job was also pretty
  • 00:30:26
poor in the grooves which wasn't giving
  • 00:30:29
you clean lines and also not allowing
  • 00:30:32
proper water runoff is that item four
  • 00:30:35
you wrote joins filled with py rather
  • 00:30:37
than a flexible sealant if we do it as
  • 00:30:40
you are suggesting the every single butt
  • 00:30:42
join will show please confirm that no
  • 00:30:45
join will show once this method is
  • 00:30:47
applied and then I will do accordingly
  • 00:30:51
you are always going to see a join line
  • 00:30:54
i think you are missing the point here
  • 00:30:57
the join line isn't the issue to my
  • 00:31:00
knowledge it's the massive amount of
  • 00:31:02
putty used that's causing a huge bubble
  • 00:31:06
like look on every join like the timber
  • 00:31:08
is raised when done properly you should
  • 00:31:11
just have a small seam running
  • 00:31:13
horizontally not a raised section item
  • 00:31:17
five you wrote no confirmation on
  • 00:31:20
whether there is a spacer in behind the
  • 00:31:22
bats on the wall to allow for proper air
  • 00:31:24
flow and moisture dissipation yes all
  • 00:31:27
done correct and the boards are not
  • 00:31:29
swelling or moving or cracking the
  • 00:31:31
issues are only relating to swelling
  • 00:31:33
where they butt into windows and boards
  • 00:31:35
butt into each other you had some photos
  • 00:31:38
of the boards going up with the cavity
  • 00:31:39
setup showing is it possible you can you
  • 00:31:42
    send those
  • 00:31:46
through now when we came to site we
  • 00:31:49
wanted to document further defects what
  • 00:31:50
we can find for example for uh the
  • 00:31:54
product for 110 mil boards as per the
  • 00:31:57
installation manual it says that you
  • 00:31:59
have to go maximum of 450 mil battens in
  • 00:32:04
terms of the spacing behind it and not
  • 00:32:07
only that behind the ben between the ben
  • 00:32:10
and the sacking there's supposed to be a
  • 00:32:12
packer to allow for ventilation cuz if
  • 00:32:14
you don't do that there's going to be a
  • 00:32:15
lot of moisture buildup and because this
  • 00:32:17
is hardwood on the back it's going to
  • 00:32:19
start swelling and cause all sorts of
  • 00:32:22
issues now I've taken some measurements
  • 00:32:25
here and there's a BN right here and
  • 00:32:29
then 450 up is here now if we look
  • 00:32:32
inside here the BN actually terminates
  • 00:32:34
around 600 mil right there so that's
  • 00:32:36
already in breach of the manufacturer's
  • 00:32:38
    installation manual they've um they've
  • 00:32:41
breached that so they got to rip out all
  • 00:32:43
the cladding and start again just
  • 00:32:45
because of this item now the other item
  • 00:32:47
that I've picked up as well when we were
  • 00:32:49
here that uh flashing installed here
  • 00:32:52
when we were here last time the flashing
  • 00:32:55
was hard up on the cladding so the
  • 00:32:58
cladding extended all the way down and
  • 00:33:00
all the joints were just swelling up and
  • 00:33:03
the painting was all just deteriorating
  • 00:33:05
so they've cut that however if we if we
  • 00:33:09
take a closer look look what happened
  • 00:33:11
let me show you you can see
  • 00:33:14
where the flashing finishes supposed to
  • 00:33:16
be 110 mil past the opening and then
  • 00:33:20
have a closer look guys didn't I mention
  • 00:33:23
that the cladding was hard up so they've
  • 00:33:26
actually grinded it and you can see
  • 00:33:30
how they grinded it well they use some
  • 00:33:32
kind of mechanical tool i'm not sure if
  • 00:33:34
it's a reciprocator or something like
  • 00:33:36
that but the fleshing is all scratched
  • 00:33:40
up which can lead to rust have a
  • 00:33:47
    look have a look
  • 00:33:56
guys so we don't know if the fleshing is
  • 00:33:59
actually cut have a look it's all that's
  • 00:34:02
from the blade or the reciprocator which
  • 00:34:04
can lead to rust so we don't know if
  • 00:34:06
they've cut it right through but you can
  • 00:34:08
see there they've actually damaged the
  • 00:34:10
flashing and they kind of just wanted to
  • 00:34:13
smash it and yeah man let's go have a
  • 00:34:16
look guys really just the poor
  • 00:34:18
    workmanship here
  • 00:34:20
overall this part of the home when we
  • 00:34:23
came and inspected the job before there
  • 00:34:26
was swelling occurring to the bottom of
  • 00:34:28
    those boards
  • 00:34:30
now we listed that as a defect because
  • 00:34:34
    the manufacturer for this hardwood
  • 00:34:35
states that there's supposed to be a
  • 00:34:37
clearance and there was no clearance and
  • 00:34:40
from the photos you can see the actual
  • 00:34:41
damage that happened before and the way
  • 00:34:44
to fix this what these guys have done is
  • 00:34:45
they've just slapped on some membrane
  • 00:34:47
class 2 waterproofing uh the problem
  • 00:34:50
with this is that now the moisture is
  • 00:34:53
going to be sealed behind the
  • 00:34:55
cladding it's not going to escape
  • 00:34:56
anymore and you can see here how it's a
  • 00:34:59
bit squishy here in this section um not
  • 00:35:02
sure if it's actual corking or something
  • 00:35:04
but you can see from the prior photos
  • 00:35:06
that there was evidence of swelling and
  • 00:35:08
deterioration of the timber because of
  • 00:35:10
the contact to the ground listed that as
  • 00:35:13
a defect and this is how they rectified
  • 00:35:15
it now the top of the membrane here is
  • 00:35:16
unprotected and check at the grooves as
  • 00:35:18
well if this gets damaged later on water
  • 00:35:21
can bypass the waterproofing and start
  • 00:35:23
to delaminate so there's a lot of
  • 00:35:24
problems with this setup here they
  • 00:35:26
didn't address it properly they just
  • 00:35:28
    kind of did a band-aid
  • 00:35:29
job manufacturer has to be consulted
  • 00:35:33
with prior to the acceptance of this
  • 00:35:36
    rectification method like I wouldn't
  • 00:35:39
agree on it the other thing is that
  • 00:35:41
    there's supposed to be a 300 by300
  • 00:35:43
drainage pit here they haven't installed
  • 00:35:46
that i've picked that up before and you
  • 00:35:48
can see it they haven't attended to this
  • 00:35:50
and then there's supposed to be also a
  • 00:35:52
pit here which I've picked up on it as
  • 00:35:54
well 300 by 300 mil pit here as well and
  • 00:35:58
then we go around this section here
  • 00:36:01
there's supposed to be a pit there now I
  • 00:36:03
know the builder hasn't finished but I
  • 00:36:05
just wanted to make them aware of it so
  • 00:36:07
they don't do any mistakes during the
  • 00:36:09
build and we've notified them about
  • 00:36:13
it so the retaining wall here you can
  • 00:36:15
    see it hasn't been finished
  • 00:36:17
yet hasn't been core filled a drain is
  • 00:36:21
not installed a lot of incomplete works
  • 00:36:24
here cladding has to all come off lost
  • 00:36:27
    manufacturers's um warranty
  • 00:36:31
already have a look guys a lot of work
  • 00:36:34
    to be done
  • 00:36:43
here now other items that we found here
  • 00:36:46
are all the bathrooms did not have any
  • 00:36:49
    water stops installed
  • 00:37:10
and these tiles are really expensive
  • 00:37:12
    it's they're actually 20 mil 20 mil
  • 00:37:15
tiles have a look guys and what they've
  • 00:37:18
done to rectify this is that they
  • 00:37:20
retrofitted the actual uh water stop now
  • 00:37:25
    and they've actually removed they
  • 00:37:28
removed a couple of tiles and they've
  • 00:37:30
installed it now the bad thing about
  • 00:37:33
that is that when you remove this tile
  • 00:37:35
the tile has is has got glue that's
  • 00:37:36
stuck on the waterproofing and what
  • 00:37:39
happens with that is that as soon as you
  • 00:37:41
remove that it's going to rip the
  • 00:37:42
membrane off and it might compromise the
  • 00:37:44
waterproofing to the adjacent tile and
  • 00:37:46
it's a continuous effect throughout the
  • 00:37:48
whole bathroom that's why they always
  • 00:37:49
recommend to remove everything and start
  • 00:37:51
again there was no water stop in the
  • 00:37:53
shower area as well they retrofitted one
  • 00:37:56
as well like this have a look
  • 00:37:58
    guys have a
  • 00:38:00
look so that's what's going on here
  • 00:38:04
they've done that to all the bathrooms
  • 00:38:06
and you can see how they've just removed
  • 00:38:09
all the fixtures and fittings even
  • 00:38:10
though the homeowner has paid fixing
  • 00:38:13
stage payment they've taken it off have
  • 00:38:16
a look even the Oh my god they've even
  • 00:38:21
taken the fan and the down lights have a
  • 00:38:24
look guys light switches they just cut
  • 00:38:30
it every single bedroom's like that
  • 00:38:34
    this is a big home
  • 00:38:37
    guys have a look at
  • 00:38:41
this the laundry was non-compliant as
  • 00:38:43
well i don't even know what they did
  • 00:38:46
here i don't know if they removed the
  • 00:38:48
tile or just slapped on an angle like
  • 00:38:50
    this but so
  • 00:38:52
    far I would
  • 00:38:54
not this is actually still non-compliant
  • 00:38:57
you can see the actual uh door jamb is
  • 00:39:00
still embedded into the tiles and it's
  • 00:39:02
not connected to the perimeter flashing
  • 00:39:03
so that's still non-compliant rip all
  • 00:39:05
    the tiles
  • 00:39:07
out mate a lot of items all the switches
  • 00:39:10
are gone you can see no barrier you can
  • 00:39:14
fall more than 2 m where's work safe
  • 00:39:16
mate where is work safe mate look at
  • 00:39:19
these guys every single outlet they've
  • 00:39:21
just taken it they're taking it man
  • 00:39:24
    every dollar counts
  • 00:39:26
bro every dollar counts look at this wow
  • 00:39:31
oh my god lucky they didn't take the
  • 00:39:34
sink oh my goodness i've never ever in
  • 00:39:37
my life guys seen something like this a
  • 00:39:40
    registered building practitioner with
  • 00:39:42
his trades on site taking everything
  • 00:39:45
    taken whatever they
  • 00:39:47
can you can see this bathroom as well
  • 00:39:50
the heated tower rails take a look guys
  • 00:39:53
they've taken that they've taken the
  • 00:39:55
taps here and the mixer have a look
  • 00:40:00
    the attraction
  • 00:40:03
    fan down
  • 00:40:05
light the shower rail oh my god let's
  • 00:40:09
    check the
  • 00:40:10
    waterproof
  • 00:40:14
actually so light switches and the
  • 00:40:19
craziest thing about this whole thing
  • 00:40:22
which I don't understand is that this
  • 00:40:24
    LED strip lighting
  • 00:40:26
here they have just pulled it out from
  • 00:40:29
his track these are pretty cheap LEDs
  • 00:40:34
like why would you cut it like
  • 00:40:36
this and just you know look it's like
  • 00:40:39
they've just caused damage like it's
  • 00:40:41
literally not that expensive they just
  • 00:40:43
wanted to cause damage that's that's
  • 00:40:44
what it looks like like they just
  • 00:40:45
smashed it out look at these guys
  • 00:40:49
    see that pulled it
  • 00:40:52
out like why would you do that i don't
  • 00:40:54
understand like all right if you want to
  • 00:40:56
take some things uh because you didn't
  • 00:40:58
get paid for it whatever but when you
  • 00:41:00
start causing damage it's a different
  • 00:41:02
story here and now this is the main on
  • 00:41:06
suite here really nice view check it out
  • 00:41:08
guys have a look guys beautiful bathtub
  • 00:41:12
here and there was no water stop here so
  • 00:41:15
obviously they couldn't fit a water stop
  • 00:41:17
    here
  • 00:41:19
um so they've installed one here in this
  • 00:41:22
shower area and they installed Oh
  • 00:41:24
    there's nothing there so they've
  • 00:41:25
    installed it
  • 00:41:26
here they retrofitted it that wasn't
  • 00:41:28
there before and you can see look check
  • 00:41:30
out the gap there i'm really curious
  • 00:41:32
about how they've actually uh did this
  • 00:41:35
how they've connected the water stop
  • 00:41:38
because it has to connect to the
  • 00:41:40
perimeter flashing i would not trust the
  • 00:41:43
    way this is fixed at
  • 00:41:45
all like they're going to get leaks for
  • 00:41:47
    sure these
  • 00:41:50
guys taking every single one have a look
  • 00:41:55
guys they've taken all the lights
  • 00:41:58
extraction fans wow they've taken this
  • 00:42:03
    tap as
  • 00:42:05
well whatever was laying around they had
  • 00:42:08
to get it done unbelievable guys
  • 00:42:13
um the water stopped to the door opening
  • 00:42:16
was non-compliant as well and if we look
  • 00:42:18
    at
  • 00:42:20
    it it's still
  • 00:42:23
    non-compliant because the water stop
  • 00:42:26
    finishes
  • 00:42:28
below around five uh around 5 mil it
  • 00:42:32
finishes around 5 mil below the finished
  • 00:42:35
floor level so that's non-compliant you
  • 00:42:37
got to remove all the tires to fix this
  • 00:42:38
    sorry you can't do that
  • 00:42:41
these are some of the things that we
  • 00:42:43
found here and all he had to do is
  • 00:42:45
rectify the items and obviously the
  • 00:42:46
homeowner wants this beautiful home to
  • 00:42:49
be done at least to the minimum
  • 00:42:52
    standards that's all they're asking
  • 00:42:55
for and they didn't they're not getting
  • 00:42:58
that this is one of the main reasons
  • 00:43:00
that they wanted to terminate this guy
  • 00:43:02
and say "You know what i'm going to get
  • 00:43:04
somebody i'm going to engage a builder
  • 00:43:05
that really cares about my home my home
  • 00:43:08
this is my life savings and I want to
  • 00:43:09
get a really nice home that meets the
  • 00:43:11
minimum standards i don't want any leaks
  • 00:43:14
i don't want leaks to occur i just want
  • 00:43:16
my home built properly and when you see
  • 00:43:19
things like that like they retrofitting
  • 00:43:20
a water stop that's an extremely
  • 00:43:22
difficult thing to do you need to be
  • 00:43:24
really professional and you have to get
  • 00:43:26
an inspector during the process to see
  • 00:43:27
how it's done because we don't know if
  • 00:43:29
to damage the membrane we we don't know
  • 00:43:31
    how they've done this
  • 00:43:35
another thing that we've picked up as
  • 00:43:38
well that's going to be hard to rectify
  • 00:43:39
here is it's the plan state stormtech or
  • 00:43:43
similar storm water grate with threshold
  • 00:43:45
drain with seal tile insert and if we
  • 00:43:50
get a closer look at what they've
  • 00:43:51
installed here we can see they've got a
  • 00:43:54
strip drain here and it's a tile insert
  • 00:43:57
    which they've done
  • 00:43:59
that now if we take a closer look on
  • 00:44:04
what these guys have done is that if we
  • 00:44:07
bring up the detail from the Stormtech
  • 00:44:09
uh manufacturer we can see that there is
  • 00:44:13
a tray that goes underneath the track
  • 00:44:16
underneath this track and uh goes all
  • 00:44:19
the way up and there's also supposed to
  • 00:44:21
be waterproofing now here they have not
  • 00:44:23
done that we can see the bottom of the
  • 00:44:26
door here look at this door you can see
  • 00:44:28
here that the door uh there's no um
  • 00:44:32
there's no channel here going up there
  • 00:44:33
should be like a lip going up here from
  • 00:44:35
the drain which doesn't encapsulate the
  • 00:44:37
whole track and there's no waterproofing
  • 00:44:40
so this is common throughout the whole
  • 00:44:42
section here for these two sliding doors
  • 00:44:44
so it's not done as per plan which is a
  • 00:44:46
breach of the uh building contracts act
  • 00:44:48
995 section 8 and also the building act
  • 00:44:51
9993 section 16 i want to make this
  • 00:44:54
clear this video is not about whether
  • 00:44:57
the homeowner or the builder is in the
  • 00:44:59
right when it comes to money paid money
  • 00:45:02
    owed contracts variations or anything
  • 00:45:04
like that it's not my place to comment
  • 00:45:06
on that stuff because I haven't seen the
  • 00:45:08
details but either way is this really
  • 00:45:11
how conflict should be resolved and as
  • 00:45:13
for the system how can a homeowner rely
  • 00:45:16
on it because here we have the police
  • 00:45:19
officer who seemed to be more interested
  • 00:45:21
in whether the homeowner had parked in
  • 00:45:23
    his own driveway
  • 00:45:27
he just needs reason why there's
  • 00:45:29
draining the process that's all then
  • 00:45:32
    whether a terminated builder was
  • 00:45:34
    potentially stealing the homeowner's
  • 00:45:36
possessions out of his own house in
  • 00:45:40
    broad daylight
  • 00:45:42
police officers who seemed to be fine
  • 00:45:44
with the fact that a terminated builder
  • 00:45:47
was preventing a homeowner from lawfully
  • 00:45:50
accessing his own freaking house what
  • 00:45:53
the hell is going on man you can hear
  • 00:45:56
the shock in the homeowner's voice how
  • 00:45:59
can this be happening and I'm just as
  • 00:46:02
shocked i'll leave you with this though
  • 00:46:06
it's all very well to say this is a
  • 00:46:08
civil matter but that only works if
  • 00:46:11
everyone actually agrees to be civil let
  • 00:46:14
