- 00:00:15came to the construction site only to be
- 00:00:17confronted by the builder and his
- 00:00:20contractors get ready to see what
- 00:00:22happens next there are some people out
- 00:00:25there that do not want me to publish
- 00:00:27this video but for the rest of you let's
- 00:00:35go life is full of conflict and that's
- 00:00:37normal builders and homeowners disagree
- 00:00:40all the time again that's normal and in
- 00:00:42Australia we have a system to help
- 00:00:44resolve these conflicts that system
- 00:00:46includes the government the regulators
- 00:00:49the courts the law and the police now
- 00:00:52I'm the first to admit that the system
- 00:00:54is flawed i see that every day working
- 00:00:58as an inspector but does that mean you
- 00:01:00can ignore it and do whatever you want
- 00:01:02isn't that
- 00:01:04called chaos what you're about to see is
- 00:01:07a conflict between the builder and the
- 00:01:09homeowner that seems to go completely
- 00:01:12off the grid of civilized society and
- 00:01:15into lawlessness
- 00:01:18we're going to share some footage so you
- 00:01:20guys can make your own mind but before
- 00:01:22we do here's the
- 00:01:28backstory last December I was engaged by
- 00:01:30a homeowner in Strathmore to do what we
- 00:01:32call a construction stage inspection on
- 00:01:35their home to see how things were
- 00:01:36progressing the homeowner was concerned
- 00:01:39they believed things were going wrong
- 00:01:41and the builder wasn't cooperating to
- 00:01:43rectify them they had already spent over
- 00:01:46$3 million the homeowner has asked a
- 00:01:50representative from the cladding
- 00:01:52manufacturer to attend the site to check
- 00:01:54the cladding installation he'd given it
- 00:01:58a thumbs down the builder was not happy
- 00:02:00with this i then attended site and
- 00:02:02conducted my own inspection i found a
- 00:02:05number of non-compliant items that
- 00:02:07needed rectification and I submitted my
- 00:02:09report to the homeowners the builder
- 00:02:11then claims later on that the job has
- 00:02:15been rectified so then I show up but
- 00:02:18before I can even get out of my car I
- 00:02:20get a text message from the homeowner
- 00:02:22saying "Hi Zaha do not approach site
- 00:02:24today at 2 p.m." So I pack up and I go
- 00:02:28then last week the homeowner decides to
- 00:02:31terminate the contract with the builder
- 00:02:34and on the day of termination the
- 00:02:36homeowner comes to the job site to
- 00:02:39retake possession of their own property
- 00:02:41as is their right that is until he his
- 00:02:44colleagues and some of his trades have
- 00:02:47removed what they believe is still
- 00:02:50theirs now we haven't seen the contracts
- 00:02:52transactions or communications between
- 00:02:54the homeowner and the builder so I'm not
- 00:02:57making any claims about any of those
- 00:02:59things but when you watch this footage
- 00:03:01just ask yourself is this really how
- 00:03:04conflict should be resolved and is our
- 00:03:06system working is this sort of thing
- 00:03:08allowed to happen with no consequences
- 00:03:11for anyone and this gentleman in the
- 00:03:14black t-shirt who's trying to access his
- 00:03:16own home is the other
- 00:03:19homeowner the clip starts when the
- 00:03:21police first attend site to supposedly
- 00:03:24resolve the conflict but you won't
- 00:03:26believe what happens next
- 00:03:33again like I'll say it's still very
- 00:03:36civil and this will still go through a
- 00:03:38civil litigation as to what hasn't
- 00:03:40hasn't been paid for okay so I've got
- 00:03:43proof that I've paid for every item he's
- 00:03:45taken he probably has proof as well he
- 00:03:46doesn't i've got Please move your car

- 00:03:52in that hour why can't we be told i can
- 00:03:54remove whatever I want i was working can

- 00:11:20knew they were in there removing stuff
- 00:11:22cuz they said we need time to remove our
- 00:11:24equipment and I knew they weren't

- 00:11:26to go in there to to film what was going
- 00:11:28on yeah he bled me over into there so if
- 00:11:30you're worried about safety how does you
- 00:11:32bowling me over into there help you

- 00:12:04had all these cars lined up at the front
- 00:12:06to take everything but but you guys
- 00:12:07didn't know about that no you guys
- 00:12:09didn't know that they were doing this no
- 00:12:10no cuz they making out that and there
- 00:12:12wasn't any agreement that hey man all
- 00:12:14right we're going to end the contract
- 00:12:15you could take this no yeah yeah okay
- 00:12:18all of this was fitted off as you know
- 00:12:20oh this is all those lights were in this
- 00:12:23is how he's left them we got lights we
- 00:12:24got power here wasn't that all fitted
- 00:12:26when I was here
- 00:12:27doors cabinets um lights switches
- 00:12:30everything we paid for these direct we
- 00:12:33paid ENS direct for all this stuff we
- 00:12:35paid Harvey Norman so bad are you
- 00:12:37disappointed with that building you seen
- 00:12:39something like this what about the down
- 00:12:40lights were they connected
- 00:12:43my goodness
- 00:12:45so you caught them in time yeah pretty
- 00:12:47much and where's the light switches now
- 00:12:50they're gone they're not here in the
- 00:12:51garage no no took them we're telling the
- 00:12:53cops they're not taking tools we're
- 00:12:55telling the police they're not taking
- 00:12:56tools they're They're dismantling the
- 00:12:57plate they wouldn't believe it they They
- 00:12:59tried to take this 100% yeah they took
- 00:13:01the Yeah look look see that look yeah
- 00:13:04look it's um Look it's off it's
- 00:13:06disconnected all these taps were fitted
- 00:13:08so yeah all these taps were fitted the
- 00:13:10showers were fitted all of these were
- 00:13:12fitted we stole them all
- 00:13:18that's I've never ever seen that in my
- 00:13:20life
- 00:13:22finally it was time for me to do what
- 00:13:25I've been waiting to do for over a month
- 00:13:28reinsspect the house it was pretty weird
- 00:13:31feeling walking around the house that
- 00:13:33had been recently stripped by the
- 00:13:35builder as you can see beautiful view
- 00:13:37guys really nice location here in
- 00:13:39Strathmore massive home this is
- 00:13:42basically a reinspection of the stuff
- 00:13:45that we picked up last time from our
- 00:13:47initial inspection the builder denied
- 00:13:49access as you know and I couldn't
- 00:13:51actually came to the job here a
- 00:13:52homeowner said "Hey we don't want to
- 00:13:53escalate this please leave the job." So
- 00:13:55we cancelled the job when I was
- 00:13:56literally here so we couldn't reinspect
- 00:13:58the works that he's done so this is the
- 00:14:00first time that I've come to the job
- 00:14:02after our initial inspection so this is
- 00:14:04like just the raw findings of what I'm
- 00:14:07about to show you guys and I'm going to
- 00:14:08show you screenshots of how the job was
- 00:14:10before and what they've done now i'm
- 00:14:12going to show you some of the things
- 00:14:13that they said they've rectified in
- 00:14:15terms of the non-compliant works and I'm
- 00:14:17going to start with the roof when we
- 00:14:18initially came to the job we found a lot
- 00:14:21of roofing items and some of the things
- 00:14:22that I've never seen before we look at
- 00:14:23this sump here at the start of an
- 00:14:25inspection when we done it there was an
- 00:14:28a high capacity overflow setup like this
- 00:14:30you can see what's going on here he's
- 00:14:32got this and he's also got a side duck
- 00:14:34overflow this was undersized so they've
- 00:14:36increased the length of it uh and and
- 00:14:38looks like the width my complaint was
- 00:14:40about hey man this is never seen this
- 00:14:43before can you please explain what's
- 00:14:44going on so these guys just uh chucked
- 00:14:46in this uh oversized overflow left this
- 00:14:49high capacity overflow setup which
- 00:14:51discharges into the rain head and I said
- 00:14:54"Hey look there's an overflow here
- 00:14:55that's discharging into the rain head
- 00:14:57how's the homeowner going to know that
- 00:14:58this is blocked?" They've just changed
- 00:15:00this have a look at this finish guys
- 00:15:03they just smashed it like that put it on
- 00:15:05we had some spreaders that were not half
- 00:15:08capped so they were spreading to the
- 00:15:10opposite direction of flow and it wasn't
- 00:15:12sealed they've sealed it they've done
- 00:15:13that condensation drain there that was
- 00:15:15not discharging into the drainage outlet
- 00:15:18they fixed that there's another section
- 00:15:19as well this is actually incorrect and
- 00:15:21it's in breach of
- 00:15:23AS3500.3 they've modified this overflow
- 00:15:27to obviously make it longer and the high
- 00:15:29capacity setup this is this is not
- 00:15:31compliant it's got to be 600 mil minimum
- 00:15:33and it's undersized so this whole
- 00:15:35section and you utilizing this is not
- 00:15:37compliant extending this to the rain
- 00:15:39head as well not seeing it discharge
- 00:15:41atmosphere is also non-compliant you've
- 00:15:43got this slide duct overflow has to be
- 00:15:46installed to a measurement that is
- 00:15:48within the sump so now you can see the
- 00:15:50sump is about 500 mil so this has to be
- 00:15:54central to it so this setup here the
- 00:15:57whole thing is still non-compliant
- 00:15:59another issue that we picked up on the
- 00:16:00previous report is that uh the capping
- 00:16:03did not have enough grade towards the
- 00:16:05roof line it has to be minimum of 5°
- 00:16:09angle to the roof these guys have lifted
- 00:16:11this lip up which caused like a little
- 00:16:13dip here and water is still ponding and
- 00:16:16you can see it's at three degrees here
- 00:16:18and you can see the water ponding where
- 00:16:20the penetration is here that's still
- 00:16:22non-compliant you can see all the dirt
- 00:16:23as well have a look guys i said to them
- 00:16:26also you got to put a expansion joint
- 00:16:28between two fixing point of 6 m anything
- 00:16:31over 6 m between two fixing points which
- 00:16:33is lump as well you got to put put an
- 00:16:35expansion joint these guys have done
- 00:16:37this
- 00:16:38i'm guessing I don't even know what the
- 00:16:40hell is this guys but they've done that
- 00:16:41so still the expansion joint requirement
- 00:16:43has not been attended to yet so still
- 00:16:46non-compliant if we measure the fall of
- 00:16:50this overflow duct 3500.3 it's got a
- 00:16:55detail that a lot of people don't know
- 00:16:56about and uh sometimes I measure this
- 00:16:59sometimes I don't because I can't fit my
- 00:17:02level inside but the thing is this one I
- 00:17:04could you can see that it's 17 mil out
- 00:17:07there's a fall towards the sump like
- 00:17:10backwards down there 17 mil down instead
- 00:17:13of towards atmosphere so that's also
- 00:17:16non-compliant as we look at the lower
- 00:17:18roof these rain heads are supposed to be
- 00:17:20installed to the other side of the wall
- 00:17:22it's kind of like a design thing where
- 00:17:25the homeowner probably didn't want to
- 00:17:26see these rain heads when they're
- 00:17:28sitting around here um so I picked up on
- 00:17:31that they haven't fixed that they didn't
- 00:17:32come back and tell me why they why they
- 00:17:34did that the rain heads were non
- 00:17:35compliant so you can see how they've cut
- 00:17:37them out to attempt to make them
- 00:17:38compliant and we're going to see if they
- 00:17:39are the box gutter projects into the
- 00:17:42rain head basically when it's projecting
- 00:17:44like that it can activate the overflow
- 00:17:47that's why the standard shows that it's
- 00:17:50supposed to be folded all the way around
- 00:17:52and stitched every 40 mil that wasn't
- 00:17:54done like that and it's still
- 00:17:55non-compliant you can see that they
- 00:17:57haven't sealed the bottom it's a
- 00:17:59requirement to seal the bottom as well
- 00:18:00they've just put silicon it's supposed
- 00:18:02to be flashed properly overlapped so
- 00:18:04they haven't done that so all we all we
- 00:18:06want to do is hey I came to the job
- 00:18:08before we didn't do any videos we picked
- 00:18:10up a a bunch of items we forward it to
- 00:18:13the builder for him to fix he's
- 00:18:15attempted to fix a lot of the items and
- 00:18:17that's what we're showing now and uh all

- 00:18:29you don't follow the plans and you just
- 00:18:31got to attend to it it's really simple
- 00:18:33not trying to stuff anyone up but now
- 00:18:36this guy here has escalated the it went
- 00:18:38out of control and now it's going to go
- 00:18:40to court it's a massive battle now now
- 00:18:42if we look at the capping here supposed
- 00:18:44to be five degree fall i can tell
- 00:18:47already it's not even five it's one they
- 00:18:49haven't done this they haven't done this
- 00:18:50one as well 1.75 so there's a lot of
- 00:18:53things that they haven't attended to
- 00:18:54here here 4.85 all right so big box
- 00:18:59cutter as well you can see how they've
- 00:19:01tried their best and cork the rest here
- 00:19:04let's have a look underneath as well
- 00:19:06same thing not sealed same thing over
- 00:19:08there non-compliant as well so the box
- 00:19:12cutters on this side are all still
- 00:19:13non-compliant they're not sealed to the
- 00:19:16rain head we've already forwarded our
- 00:19:18report to the VBA so the VBA have got
- 00:19:20our report now and uh let's see what
- 00:19:23they're going to do we got this as well
- 00:19:25here where the water just ponding
- 00:19:26instead of running off to the drainage
- 00:19:28system here the box cutter and then to
- 00:19:30the sump the sump here is also
- 00:19:34non-compliant no performance solution
- 00:19:36has been provided reverse pop going on
- 00:19:40here now if we look behind this massive
- 00:19:42shroud here that looks really nice let's
- 00:19:45have a look what's going on under here
- 00:19:47guys look piece of
- 00:19:51timber another piece of timber
- 00:19:53there have a
- 00:19:56look look at that guys
- 00:19:59so the homeowner should be really
- 00:20:01careful just about 70 mil which is
- 00:20:04non-compliant at the high end uh
- 00:20:07according to
- 00:20:10AS3500.3 so this whole box cutter needs
- 00:20:13to be lower that this uh section or they
- 00:20:15have to get a performance solution to
- 00:20:16tell us how this is going to perform the
- 00:20:18flashing is still non-compliant here
- 00:20:20doesn't extend past the reveal they've
- 00:20:22extended the condensation drain all the
- 00:20:25way to here but it has to go to the
- 00:20:27downpipe so that's also non-compliant
- 00:20:29let's have a look what they've got under
- 00:20:30here check it out guys you can see a
- 00:20:32timber frame
- 00:20:38wow one of the main issues that the
- 00:20:41homeowner was complaining about
- 00:20:42regarding this home is that the cladding
- 00:20:45installation here did not meet the
- 00:20:48requirements of the manufacturer and I'm
- 00:20:51going to show you some shots of how the
- 00:20:53cladding was before it is still
- 00:20:55defective by the way but have a look at
- 00:20:57the way they've installed it this was
- 00:20:59the actual finished product until we
- 00:21:02came on site that would that's what
- 00:21:04triggered the whole inspection the whole
- 00:21:06inspection was triggered by the cladding
- 00:21:08did not look like what was intended to
- 00:21:11it looked so bad like just us looking at
- 00:21:13it right now like you can see all these
- 00:21:16butt joints how they're how they're
- 00:21:18being patched up and painted i mean look
- 00:21:21at this guys really bad workmanship and
- 00:21:24you might you might be saying like "Yeah
- 00:21:26man that's normal." But it's not as per
- 00:21:29the manufacturer's installation manual
- 00:21:30the way they've advised to install it
- 00:21:32i'm going to go through the items that
- 00:21:34we picked up so let's get right into
- 00:21:36it so the cladding that you see behind
- 00:21:39me it's actually a hardwood product it's
- 00:21:42silver top ash and it's an Australian
- 00:21:45hardwood product often used for cladding
- 00:21:49because of its durability and aesthetic
- 00:21:51grain now they've painted it white as
- 00:21:54you can see but uh the homeowner just
- 00:21:57wanted a nice hardwood home you know
- 00:22:00painted it white that that's what they
- 00:22:01wanted now if they would have followed
- 00:22:03the installation manual they would have
- 00:22:06installed it as per the standards and
- 00:22:09the manufacturers's installation manual
- 00:22:10now the manufacturer did come to site
- 00:22:12and he deemed it defective and I'm going
- 00:22:15to show you an extract from some of his
- 00:22:16stuff that he said there hi Iran thanks
- 00:22:20for your time on site yesterday after
- 00:22:22seeing the job here are some points that
- 00:22:25I have taken away item one screw fixing
- 00:22:29still unsure how this was fixed 110 mm
- 00:22:33should be a face fix with either one and
- 00:22:36one secret fix screw or two screws
- 00:22:39across the face as per installation
- 00:22:41guide item two batterns in behind the
- 00:22:45cladding are these spaced at 450 mm
- 00:22:49centers and do you have a spacer in
- 00:22:52behind the bats and in between the
- 00:22:54sacking to allow for air to travel
- 00:22:56freely and moisture to escape from in
- 00:23:00behind the boards item three flashings
- 00:23:04required 10 mm minimum gap from end
- 00:23:07grains to flashing to allow any moisture
- 00:23:10in behind the boards a way to escape
- 00:23:12from in behind the building item four
- 00:23:16joins on each join a filler has been
- 00:23:19used which is leaving a bump box ray
- 00:23:22section which really shows up when the
- 00:23:24light hits it joints should have been
- 00:23:27done as per the below recommendation
- 00:23:29using sealer and not a filler item four
- 00:23:34paint when painting timber cladding this
- 00:23:37should always be done prior to
- 00:23:39installation to completely seal the
- 00:23:41boards when painting after installation
- 00:23:44there will be areas especially after
- 00:23:46seasonal movement that will be exposed
- 00:23:49with no paint and moisture can get in
- 00:23:52behind the paint and cause issues such
- 00:23:55as warping excessive movement or peeling
- 00:23:58paint i have cut back boards and
- 00:24:00attended to items however there is no
- 00:24:03movement or moisture getting into
- 00:24:06boards i think you have missed the point
- 00:24:08and issue with the boards
- 00:24:11when the sun hits at a particular time
- 00:24:14of day all filler shows up where the
- 00:24:16boards but
- 00:24:18join you mentioned that that is the way
- 00:24:20it is with the boards when paint is
- 00:24:22applied to them especially white you
- 00:24:26also mentioned that had you known we
- 00:24:29were painting them you wouldn't have
- 00:24:31sold us the product hi Imran with all
- 00:24:35due respect some of these things I have
- 00:24:37seen on site can cause issues with
- 00:24:40excessive movement and poor performance
- 00:24:42of the boards i said I would always
- 00:24:46recommend another product not that I
- 00:24:48wouldn't sell you the product just due
- 00:24:50to the cost when it's being painted as a
- 00:24:53flat white but some people prefer timber
- 00:24:56as it's a natural product things to do
- 00:24:59to try rectify
- 00:25:01one fix flashings with correct opening
- 00:25:04two carefully sand back joints to the
- 00:25:08raw timber no filler bumps being careful
- 00:25:12not to make noticeable gouges in the
- 00:25:14timber and repaint three might be worth
- 00:25:17scraping off any excess paint in the
- 00:25:19joints and making sure this is
- 00:25:21completely sealed painted again with no
- 00:25:24drip lines and excess paint which can
- 00:25:27create water traps hi Luke I met with
- 00:25:30Ned and Cat my clients and owners of the
- 00:25:33property and they mentioned they have
- 00:25:35been in touch and that the issue with
- 00:25:37boards is an installation issue is this
- 00:25:41correct can you please confirm what you
- 00:25:43mentioned is the same issues as you
- 00:25:46identified below however we both know
- 00:25:48that it is not the case and that this is
- 00:25:50just the nature of the product none of
- 00:25:53the items identified relate to carpentry
- 00:25:56or install method and the install was
- 00:25:59done as per install guide and done by
- 00:26:02experienced carpenters the boards have
- 00:26:04not come and undone and are perfectly
- 00:26:06flush and intact there is no splitting
- 00:26:09and there is no movement in boards or
- 00:26:11cracks in butt
- 00:26:12joints below is what you identified to
- 00:26:15be issues on site i have put comments in
- 00:26:18brackets one fix flashings with correct
- 00:26:22opening this has been now cut back and
- 00:26:25was only done this way as we were
- 00:26:27advised to put boards to windows with no
- 00:26:29stops two carefully sand back joins to
- 00:26:34the raw timber no filler bumps being
- 00:26:37careful not to make noticeable gouges in
- 00:26:39the timber and
- 00:26:40repaint this has been refilled sanded
- 00:26:44and painted and has never been the issue
- 00:26:46or an issue
- 00:26:48the paintwork has been finished to above
- 00:26:50standard and we have done everything we
- 00:26:53can to achieve the right finish if you
- 00:26:55want no filler then every single butt
- 00:26:58join will show
- 00:26:59correct three might be worth scraping
- 00:27:03off any excess paint in the joints and
- 00:27:05making sure this is completely sealed
- 00:27:07and painted again with no drip lines and
- 00:27:09excess paint which can create water
- 00:27:11traps this has also been done and can
- 00:27:14still be done however natural timber is
- 00:27:16always going to expand and contract due
- 00:27:18to its nature i may again definitely
- 00:27:21disagree and your response is a
- 00:27:24deflection glad you agree that white
- 00:27:26paint shows all imperfections would be
- 00:27:29good to see you agree on your comment on
- 00:27:31site when you chuckled and said "If you
- 00:27:33knew this would be painted white you
- 00:27:36would not have sold us the product." I
- 00:27:38would have recommended another product
- 00:27:40we have done many painted projects and I
- 00:27:43will always recommend a panel style
- 00:27:45product as it's a lot less labor cost
- 00:27:49when the timber is just going to be
- 00:27:50painted anyway and it will be more
- 00:27:53stable item one you wrote incorrect
- 00:27:57flashing setup which has caused
- 00:27:59excessive swelling around all windows
- 00:28:01agreed to this and we were told to
- 00:28:03install flush with no stops and have
- 00:28:06since cut back and can cut the rest it's
- 00:28:09not only linked to the bottom of boards
- 00:28:11but this does raise the moisture of the
- 00:28:13total board as it sucks it up through
- 00:28:16the end grains just because you can't
- 00:28:18see any movement up top dosent mean it's
- 00:28:22not having an adverse effect on the
- 00:28:24boards we have done testing on this in
- 00:28:26our yard by putting lengths in a bucket
- 00:28:29and measuring moisture at the top of the
- 00:28:32board and it can raise the moisture
- 00:28:34content which can cause excessive
- 00:28:36movement and possible degradation of
- 00:28:39boards item two you wrote 110 by 19 mm
- 00:28:45board is recommended to be face fixed we
- 00:28:47have face fixed on joins and secret
- 00:28:50screwed if you want every screw to show
- 00:28:53i will go over each board and ensure two
- 00:28:56screws are installed and all filler will
- 00:28:58again show which will also prove my
- 00:29:00point of the board is not suited for a
- 00:29:02seamless finish would love to see your
- 00:29:05response then please let me know if you
- 00:29:08would like me to do this your
- 00:29:11recommendation also shows it can be
- 00:29:13secret fixed those decisions aren't up
- 00:29:15to me all we can do is recommend it's up
- 00:29:19to you guys to work out the best course
- 00:29:21of action and raise issues when things
- 00:29:24go against the supplers's
- 00:29:26recommendation most people would leave
- 00:29:28the screws showing or choose a profile
- 00:29:31that is a better option for concealed
- 00:29:34fixing item three you wrote paint or
- 00:29:38finish should be done pre-installation
- 00:29:40on all sides of the board for a nice
- 00:29:42clean finish and to seal the whole board
- 00:29:45properly the paintwork is finished
- 00:29:47correctly and is not causing any issues
- 00:29:50to the board which is evident on
- 00:29:52site this is not the issue and we have
- 00:29:55certification from Dulix to back this
- 00:29:59up all boards are sealed and painted
- 00:30:01correctly and this is evident as there
- 00:30:04is no sign of bleeding again we can
- 00:30:06agree to disagree but I have seen this
- 00:30:09exact problem many times when you paint
- 00:30:12after install as soon as the timber
- 00:30:14shrinks slightly there is raw timber
- 00:30:16lines which can cause water trap issues
- 00:30:19plus is just dosent give you a nice
- 00:30:23finish the paint job was also pretty
- 00:30:26poor in the grooves which wasn't giving
- 00:30:29you clean lines and also not allowing
- 00:30:32proper water runoff is that item four
- 00:30:35you wrote joins filled with py rather
- 00:30:37than a flexible sealant if we do it as
- 00:30:40you are suggesting the every single butt
- 00:30:42join will show please confirm that no
- 00:30:45join will show once this method is
- 00:30:47applied and then I will do accordingly
- 00:30:51you are always going to see a join line
- 00:30:54i think you are missing the point here
- 00:30:57the join line isn't the issue to my
- 00:31:00knowledge it's the massive amount of
- 00:31:02putty used that's causing a huge bubble
- 00:31:06like look on every join like the timber
- 00:31:08is raised when done properly you should
- 00:31:11just have a small seam running
- 00:31:13horizontally not a raised section item
- 00:31:17five you wrote no confirmation on
- 00:31:20whether there is a spacer in behind the
- 00:31:22bats on the wall to allow for proper air
- 00:31:24flow and moisture dissipation yes all
- 00:31:27done correct and the boards are not
- 00:31:29swelling or moving or cracking the
- 00:31:31issues are only relating to swelling
- 00:31:33where they butt into windows and boards
- 00:31:35butt into each other you had some photos
- 00:31:38of the boards going up with the cavity
- 00:31:39setup showing is it possible you can you
- 00:31:42send those
- 00:31:46through now when we came to site we
- 00:31:49wanted to document further defects what
- 00:31:50we can find for example for uh the
- 00:31:54product for 110 mil boards as per the
- 00:31:57installation manual it says that you
- 00:31:59have to go maximum of 450 mil battens in
- 00:32:04terms of the spacing behind it and not
- 00:32:07only that behind the ben between the ben
- 00:32:10and the sacking there's supposed to be a
- 00:32:12packer to allow for ventilation cuz if
- 00:32:14you don't do that there's going to be a
- 00:32:15lot of moisture buildup and because this
- 00:32:17is hardwood on the back it's going to
- 00:32:19start swelling and cause all sorts of
- 00:32:22issues now I've taken some measurements
- 00:32:25here and there's a BN right here and
- 00:32:29then 450 up is here now if we look
- 00:32:32inside here the BN actually terminates
- 00:32:34around 600 mil right there so that's
- 00:32:36already in breach of the manufacturer's
- 00:32:38installation manual they've um they've
- 00:32:41breached that so they got to rip out all
- 00:32:43the cladding and start again just
- 00:32:45because of this item now the other item
- 00:32:47that I've picked up as well when we were
- 00:32:49here that uh flashing installed here
- 00:32:52when we were here last time the flashing
- 00:32:55was hard up on the cladding so the
- 00:32:58cladding extended all the way down and
- 00:33:00all the joints were just swelling up and
- 00:33:03the painting was all just deteriorating
- 00:33:05so they've cut that however if we if we
- 00:33:09take a closer look look what happened
- 00:33:11let me show you you can see
- 00:33:14where the flashing finishes supposed to
- 00:33:16be 110 mil past the opening and then
- 00:33:20have a closer look guys didn't I mention
- 00:33:23that the cladding was hard up so they've
- 00:33:26actually grinded it and you can see
- 00:33:30how they grinded it well they use some
- 00:33:32kind of mechanical tool i'm not sure if
- 00:33:34it's a reciprocator or something like
- 00:33:36that but the fleshing is all scratched
- 00:33:40up which can lead to rust have a
- 00:33:47look have a look
- 00:33:56guys so we don't know if the fleshing is
- 00:33:59actually cut have a look it's all that's
- 00:34:02from the blade or the reciprocator which
- 00:34:04can lead to rust so we don't know if
- 00:34:06they've cut it right through but you can
- 00:34:08see there they've actually damaged the
- 00:34:10flashing and they kind of just wanted to
- 00:34:13smash it and yeah man let's go have a
- 00:34:16look guys really just the poor
- 00:34:18workmanship here
- 00:34:20overall this part of the home when we
- 00:34:23came and inspected the job before there
- 00:34:26was swelling occurring to the bottom of
- 00:34:28those boards
- 00:34:30now we listed that as a defect because
- 00:34:34the manufacturer for this hardwood
- 00:34:35states that there's supposed to be a
- 00:34:37clearance and there was no clearance and
- 00:34:40from the photos you can see the actual
- 00:34:41damage that happened before and the way
- 00:34:44to fix this what these guys have done is
- 00:34:45they've just slapped on some membrane
- 00:34:47class 2 waterproofing uh the problem
- 00:34:50with this is that now the moisture is
- 00:34:53going to be sealed behind the
- 00:34:55cladding it's not going to escape
- 00:34:56anymore and you can see here how it's a
- 00:34:59bit squishy here in this section um not
- 00:35:02sure if it's actual corking or something
- 00:35:04but you can see from the prior photos
- 00:35:06that there was evidence of swelling and
- 00:35:08deterioration of the timber because of
- 00:35:10the contact to the ground listed that as
- 00:35:13a defect and this is how they rectified
- 00:35:15it now the top of the membrane here is
- 00:35:16unprotected and check at the grooves as
- 00:35:18well if this gets damaged later on water
- 00:35:21can bypass the waterproofing and start
- 00:35:23to delaminate so there's a lot of
- 00:35:24problems with this setup here they
- 00:35:26didn't address it properly they just
- 00:35:28kind of did a band-aid
- 00:35:29job manufacturer has to be consulted
- 00:35:33with prior to the acceptance of this
- 00:35:36rectification method like I wouldn't
- 00:35:39agree on it the other thing is that
- 00:35:41there's supposed to be a 300 by300
- 00:35:43drainage pit here they haven't installed
- 00:35:46that i've picked that up before and you
- 00:35:48can see it they haven't attended to this
- 00:35:50and then there's supposed to be also a
- 00:35:52pit here which I've picked up on it as
- 00:35:54well 300 by 300 mil pit here as well and
- 00:35:58then we go around this section here
- 00:36:01there's supposed to be a pit there now I
- 00:36:03know the builder hasn't finished but I
- 00:36:05just wanted to make them aware of it so
- 00:36:07they don't do any mistakes during the
- 00:36:09build and we've notified them about
- 00:36:13it so the retaining wall here you can
- 00:36:15see it hasn't been finished
- 00:36:17yet hasn't been core filled a drain is
- 00:36:21not installed a lot of incomplete works
- 00:36:24here cladding has to all come off lost
- 00:36:27manufacturers's um warranty
- 00:36:31already have a look guys a lot of work
- 00:36:34to be done
- 00:36:43here now other items that we found here
- 00:36:46are all the bathrooms did not have any
- 00:36:49water stops installed
- 00:37:10and these tiles are really expensive
- 00:37:12it's they're actually 20 mil 20 mil
- 00:37:15tiles have a look guys and what they've
- 00:37:18done to rectify this is that they
- 00:37:20retrofitted the actual uh water stop now
- 00:37:25and they've actually removed they
- 00:37:28removed a couple of tiles and they've
- 00:37:30installed it now the bad thing about
- 00:37:33that is that when you remove this tile
- 00:37:35the tile has is has got glue that's
- 00:37:36stuck on the waterproofing and what
- 00:37:39happens with that is that as soon as you
- 00:37:41remove that it's going to rip the
- 00:37:42membrane off and it might compromise the
- 00:37:44waterproofing to the adjacent tile and
- 00:37:46it's a continuous effect throughout the
- 00:37:48whole bathroom that's why they always
- 00:37:49recommend to remove everything and start
- 00:37:51again there was no water stop in the
- 00:37:53shower area as well they retrofitted one
- 00:37:56as well like this have a look
- 00:37:58guys have a
- 00:38:00look so that's what's going on here
- 00:38:04they've done that to all the bathrooms
- 00:38:06and you can see how they've just removed
- 00:38:09all the fixtures and fittings even
- 00:38:10though the homeowner has paid fixing
- 00:38:13stage payment they've taken it off have
- 00:38:16a look even the Oh my god they've even
- 00:38:21taken the fan and the down lights have a
- 00:38:24look guys light switches they just cut
- 00:38:30it every single bedroom's like that
- 00:38:34this is a big home
- 00:38:37guys have a look at
- 00:38:41this the laundry was non-compliant as
- 00:38:43well i don't even know what they did
- 00:38:46here i don't know if they removed the
- 00:38:48tile or just slapped on an angle like
- 00:38:50this but so
- 00:38:52far I would
- 00:38:54not this is actually still non-compliant
- 00:38:57you can see the actual uh door jamb is
- 00:39:00still embedded into the tiles and it's
- 00:39:02not connected to the perimeter flashing
- 00:39:03so that's still non-compliant rip all
- 00:39:05the tiles
- 00:39:07out mate a lot of items all the switches
- 00:39:10are gone you can see no barrier you can
- 00:39:14fall more than 2 m where's work safe
- 00:39:16mate where is work safe mate look at
- 00:39:19these guys every single outlet they've
- 00:39:21just taken it they're taking it man
- 00:39:24every dollar counts
- 00:39:26bro every dollar counts look at this wow
- 00:39:31oh my god lucky they didn't take the
- 00:39:34sink oh my goodness i've never ever in
- 00:39:37my life guys seen something like this a
- 00:39:40registered building practitioner with
- 00:39:42his trades on site taking everything
- 00:39:45taken whatever they
- 00:39:47can you can see this bathroom as well
- 00:39:50the heated tower rails take a look guys
- 00:39:53they've taken that they've taken the
- 00:39:55taps here and the mixer have a look
- 00:40:00the attraction
- 00:40:03fan down
- 00:40:05light the shower rail oh my god let's
- 00:40:09check the
- 00:40:10waterproof
- 00:40:14actually so light switches and the
- 00:40:19craziest thing about this whole thing
- 00:40:22which I don't understand is that this
- 00:40:24LED strip lighting
- 00:40:26here they have just pulled it out from
- 00:40:29his track these are pretty cheap LEDs
- 00:40:34like why would you cut it like
- 00:40:36this and just you know look it's like
- 00:40:39they've just caused damage like it's
- 00:40:41literally not that expensive they just
- 00:40:43wanted to cause damage that's that's
- 00:40:44what it looks like like they just
- 00:40:45smashed it out look at these guys
- 00:40:49see that pulled it
- 00:40:52out like why would you do that i don't
- 00:40:54understand like all right if you want to
- 00:40:56take some things uh because you didn't
- 00:40:58get paid for it whatever but when you
- 00:41:00start causing damage it's a different
- 00:41:02story here and now this is the main on
- 00:41:06suite here really nice view check it out
- 00:41:08guys have a look guys beautiful bathtub
- 00:41:12here and there was no water stop here so
- 00:41:15obviously they couldn't fit a water stop
- 00:41:17here
- 00:41:19um so they've installed one here in this
- 00:41:22shower area and they installed Oh
- 00:41:24there's nothing there so they've
- 00:41:25installed it
- 00:41:26here they retrofitted it that wasn't
- 00:41:28there before and you can see look check
- 00:41:30out the gap there i'm really curious
- 00:41:32about how they've actually uh did this
- 00:41:35how they've connected the water stop
- 00:41:38because it has to connect to the
- 00:41:40perimeter flashing i would not trust the
- 00:41:43way this is fixed at
- 00:41:45all like they're going to get leaks for
- 00:41:47sure these
- 00:41:50guys taking every single one have a look
- 00:41:55guys they've taken all the lights
- 00:41:58extraction fans wow they've taken this
- 00:42:03tap as
- 00:42:05well whatever was laying around they had
- 00:42:08to get it done unbelievable guys
- 00:42:13um the water stopped to the door opening
- 00:42:16was non-compliant as well and if we look
- 00:42:18at
- 00:42:20it it's still
- 00:42:23non-compliant because the water stop
- 00:42:26finishes
- 00:42:28below around five uh around 5 mil it
- 00:42:32finishes around 5 mil below the finished
- 00:42:35floor level so that's non-compliant you
- 00:42:37got to remove all the tires to fix this
- 00:42:38sorry you can't do that
- 00:42:41these are some of the things that we
- 00:42:43found here and all he had to do is
- 00:42:45rectify the items and obviously the
- 00:42:46homeowner wants this beautiful home to
- 00:42:49be done at least to the minimum
- 00:42:52standards that's all they're asking
- 00:42:55for and they didn't they're not getting
- 00:42:58that this is one of the main reasons
- 00:43:00that they wanted to terminate this guy
- 00:43:02and say "You know what i'm going to get
- 00:43:04somebody i'm going to engage a builder
- 00:43:05that really cares about my home my home
- 00:43:08this is my life savings and I want to
- 00:43:09get a really nice home that meets the
- 00:43:11minimum standards i don't want any leaks
- 00:43:14i don't want leaks to occur i just want
- 00:43:16my home built properly and when you see
- 00:43:19things like that like they retrofitting
- 00:43:20a water stop that's an extremely
- 00:43:22difficult thing to do you need to be
- 00:43:24really professional and you have to get
- 00:43:26an inspector during the process to see
- 00:43:27how it's done because we don't know if
- 00:43:29to damage the membrane we we don't know
- 00:43:31how they've done this
- 00:43:35another thing that we've picked up as
- 00:43:38well that's going to be hard to rectify
- 00:43:39here is it's the plan state stormtech or
- 00:43:43similar storm water grate with threshold
- 00:43:45drain with seal tile insert and if we
- 00:43:50get a closer look at what they've
- 00:43:51installed here we can see they've got a
- 00:43:54strip drain here and it's a tile insert
- 00:43:57which they've done
- 00:43:59that now if we take a closer look on
- 00:44:04what these guys have done is that if we
- 00:44:07bring up the detail from the Stormtech
- 00:44:09uh manufacturer we can see that there is
- 00:44:13a tray that goes underneath the track
- 00:44:16underneath this track and uh goes all
- 00:44:19the way up and there's also supposed to
- 00:44:21be waterproofing now here they have not
- 00:44:23done that we can see the bottom of the
- 00:44:26door here look at this door you can see
- 00:44:28here that the door uh there's no um
- 00:44:32there's no channel here going up there
- 00:44:33should be like a lip going up here from
- 00:44:35the drain which doesn't encapsulate the
- 00:44:37whole track and there's no waterproofing
- 00:44:40so this is common throughout the whole
- 00:44:42section here for these two sliding doors
- 00:44:44so it's not done as per plan which is a
- 00:44:46breach of the uh building contracts act
- 00:44:48995 section 8 and also the building act
- 00:44:519993 section 16 i want to make this
- 00:44:54clear this video is not about whether
- 00:44:57the homeowner or the builder is in the
- 00:44:59right when it comes to money paid money
- 00:45:02owed contracts variations or anything
- 00:45:04like that it's not my place to comment
- 00:45:06on that stuff because I haven't seen the
- 00:45:08details but either way is this really
- 00:45:11how conflict should be resolved and as
- 00:45:13for the system how can a homeowner rely
- 00:45:16on it because here we have the police
- 00:45:19officer who seemed to be more interested
- 00:45:21in whether the homeowner had parked in
- 00:45:23his own driveway
- 00:45:27he just needs reason why there's
- 00:45:29draining the process that's all then
- 00:45:32whether a terminated builder was
- 00:45:34potentially stealing the homeowner's
- 00:45:36possessions out of his own house in
- 00:45:40broad daylight
- 00:45:42police officers who seemed to be fine
- 00:45:44with the fact that a terminated builder
- 00:45:47was preventing a homeowner from lawfully
- 00:45:50accessing his own freaking house what
- 00:45:53the hell is going on man you can hear
- 00:45:56the shock in the homeowner's voice how
- 00:45:59can this be happening and I'm just as
- 00:46:02shocked i'll leave you with this though
- 00:46:06it's all very well to say this is a
- 00:46:08civil matter but that only works if
- 00:46:11everyone actually agrees to be civil let
