- 00:00:54season pass but the developers are
- 00:00:55internally screaming thinking uh guys we
- 00:00:58can't actually do that the problem
- 00:00:59though is that means that customers we
- 00:01:01get burned and guess who also gets
- 00:01:03burned big Mr Gabe because if you're
- 00:01:05running Steam and VI incompetence or
- 00:01:08malice your dabs and Publishers are
- 00:01:10messing around your customers well guess
- 00:01:12what now that's your problem so this is
- 00:01:14very much a steam consumer protection
- 00:01:16story and it's one that is very valve
- 00:01:19because they've not went and hired a
- 00:01:20small army right of of enforcers who are
- 00:01:23going to be patrolling steam no valve
- 00:01:25are a games design company right now the
- 00:01:28thing is steam the the actual platform
- 00:01:31well it's game designed they want to
- 00:01:33incentivize behaviors that are in their
- 00:01:35best interest and that means yeah things
- 00:01:37that mean that customers feel
- 00:01:39comfortable purchasing but it also means
- 00:01:41developers and Publishers acting right
- 00:01:43so let's get yeah that's the thing is
- 00:01:45anytime somebody has a bad experience
- 00:01:47with a game on Steam they have a bad
- 00:01:49experience with
- 00:01:50steam so like they have to manage their
- 00:01:53own reputation inside of these
- 00:01:55Publishers doing different things that
- 00:01:57could be good or bad that's why they
- 00:01:59have the re fund window that's why for
- 00:02:01example whenever the day before came out
- 00:02:03and like it didn't go well steam gave
- 00:02:06everybody
- 00:02:08refunds into this today's story is all
- 00:02:10about selling an idea selling a promise
- 00:02:12of future content and how it goes wrong
- 00:02:15what's cool though right is the last few
- 00:02:16times we've covered steam stories
- 00:02:18especially policy ones it's valve being
- 00:02:20forced by some sort of outside influence
- 00:02:23as an example there were the terms of
- 00:02:24service changes which basically were to
- 00:02:27try to comply with a Californian law
- 00:02:29there was all the stuff with the big
- 00:02:31class action lawsuits and that was all
- 00:02:33valve responding to external stuff but
- 00:02:35here this is valve designing their own
- 00:02:37game changing the rules and it's all
- 00:02:39about the Battle passes now this was
- 00:02:40first botted by Powell jenck who is the
- 00:02:43steam DB guy who does awesome work over
- 00:02:45there so what they've done is they've
- 00:02:47changed their policies on how season
- 00:02:48passes work and for the sake of
- 00:02:50simplicity so that we all understand
- 00:02:52what valve actually means here is how
- 00:02:54valve defines them a pack of current and
- 00:02:57future content brackets DLC that c
- 00:02:59customers can buy with a single purchase
- 00:03:02that's a that's really broad because
- 00:03:05what does content even mean that could
- 00:03:08mean like
- 00:03:11skins yeah cuz I mean are skins content
- 00:03:14for a game I would say their content
- 00:03:16yeah for sure they
- 00:03:17are that's
- 00:03:19massive so what's of note here is that
- 00:03:22battle passes where you've got to unlock
- 00:03:24rewards through gameplay and like
- 00:03:26individual dlc's those don't actually
- 00:03:29count here what counts is when you buy a
- 00:03:31season pass right a whole package of
- 00:03:33things that is purchased before all
- 00:03:35those things release and what's really
- 00:03:37cool is that we have got the full policy
- 00:03:39document all of valves demands and
- 00:03:41requirements that developers and
- 00:03:43Publishers have got to meet and on face
- 00:03:46value this absolutely looks like a
- 00:03:48humongous win for consumer rights but as
- 00:03:50always it gets far more interesting when
- 00:03:52we dive into the details and that's
- 00:03:54possible because of today's sponsor who
- 00:03:56keep me protected online so here's the
- 00:03:57deal data progress exist they
- 00:04:00way that they can and then they sell it
- 00:04:02and that means we get Robo calls we get

- 00:05:39the difference between beta early access

- 00:05:45terms are kind of used interchangeably
- 00:05:48and it's very hard to know like which
- 00:05:50one are being used in this
- 00:05:53circumstance from now on before the
- 00:05:56purchase of a season pass products must
- 00:05:58clearly detail these things a complete
- 00:06:01list of all DLC included in the pass so
- 00:06:03a listing for each of the four DLCs that
- 00:06:05are included there must be a basic
- 00:06:07description of the content included in
- 00:06:09each pass valve says and by the way I'm
- 00:06:11reading their policy document here for
- 00:06:13example the first content release might
- 00:06:15be the glitter lands expansion new area
- 00:06:18to explore two new weapons and new
- 00:06:20enemies fa's document goes on to say
- 00:06:23it's not required for DLC to have a
- 00:06:25final name at the launch of the season
- 00:06:27pass they say that information about
- 00:06:31to detailed so you can just say as a
- 00:06:34developer new we or two new we or new Z
- 00:06:37that is acceptable you don't have to
- 00:06:39list these specific like itemized things
- 00:06:42now they also say and this is where it
- 00:06:43gets big expected release date for each
- 00:06:46DLC quarter and year I.E January to
- 00:06:49March 2025 or season year is acceptable
- 00:06:53of course a date that's more precise is
- 00:06:55also fine as an example just any
- 00:06:57specific date in the year and then
- 00:06:58there's a bit that I think yeah thank
- 00:07:00[ __ ] God that way it's actually
- 00:07:02explained and people know what's going
- 00:07:04on you know imagine that huge right a
- 00:07:09product must have at least one of its
- 00:07:10constituent dlc's actually released
- 00:07:13whenever it is offered so that means
- 00:07:15that a season pass cannot be sold in
- 00:07:18such a way that if you buy the season
- 00:07:20pass that's it right there there's no
- 00:07:22content right now all that you've done
- 00:07:24is pre-ordered a bunch of future DLCs
- 00:07:26that's actually not going to be allowed
- 00:07:28now that being said preorder ERS of a
- 00:07:29deluxe edition of a game do get their
- 00:07:32own specific carving out in the rules so
- 00:07:34obviously valve aren't going to
- 00:07:35Publishers and saying hey guys no more
- 00:07:37deluxe editions cuz that would lose all
- 00:07:38of the money right yeah that would be
- 00:07:40stupid I have to treat that as a
- 00:07:41separate thing but there's an other rule
- 00:07:43that is massive for us as as Gamers as
- 00:07:46customers steamer codifying that if any
- 00:07:48listed DLC is cancelled valve will
- 00:07:51mandate refunds for the comparative
- 00:07:54value of the cancel DLC to customers now
- 00:07:58wow
- 00:08:02God damn that's a lot holy [ __ ] it's
- 00:08:07amazing yeah oh my
- 00:08:10God now this is really good because look
- 00:08:13generally there would be some form of
- 00:08:16refund if a plan changed substantially
- 00:08:19but the thing that actually matters is
- 00:08:21can you trust that refund is it backed
- 00:08:23up by valve's own rules here it is going
- 00:08:26to be backed up by those rules and that
- 00:08:28matters now what we can do is take a
- 00:08:30look at some recent video games to see
- 00:08:32who passes these rules the fails the
- 00:08:36devil is always in the details ex Star
- 00:08:38Wars Outlaws just came
- 00:08:41out and it does actually pass the reason
- 00:08:43why is they have clear descriptions of
- 00:08:45the expected dates there are clear
- 00:08:47expectations for the content and there's
- 00:08:49a full list of everything that you get
- 00:08:51then we've got Space Marine 2 it also
- 00:08:53passes the new test again it's got all
- 00:08:55of the detail even though they are just
- 00:08:57describing the Cosmetic pack content in
- 00:08:59generic terms but then we've got Tekken
- 00:09:018 it actually fails the test it violates
- 00:09:04valve's rules now don't Tekken 8 players
- 00:09:07hate the game now like I've heard that a
- 00:09:09lot of teeken 8 players are like unhappy
- 00:09:12with I guess like microtransactions and
- 00:09:14certain types of additions to the game
- 00:09:15that they've done that's what I've heard
- 00:09:18a lot of
- 00:09:19though tech8 came under a hell of a lot
- 00:09:22of criticism from fans because of what
- 00:09:24is actually in its season pass now
- 00:09:27actually that's not why they failed the
- 00:09:29here obviously you're allowed to sell a
- 00:09:31season pass that's [ __ ] as long as it
- 00:09:33complies with the rules but what they
- 00:09:34don't comply with is that while there is
- 00:09:37detail of the content available that
- 00:09:38fits valve standards there's uh no time
- 00:09:41frame right no time frame for delivery
- 00:09:43and valve are not letting developers
- 00:09:45sell undated promises in their store
- 00:09:48anymore
- 00:09:50wow so it's not just like something can
- 00:09:53be an early access Purgatory forever
- 00:09:56that's kind of a really big deal
- 00:10:01holy
- 00:10:02[ __ ] and we've got stalker 2 which sadly
- 00:10:06fails on all counts here actually the
- 00:10:08only thing that they describe whenever
- 00:10:10you purchase the ultimate edition is
- 00:10:12quote season pass guaranteeing two
- 00:10:14additional expansions and any future DLC
- 00:10:17now of course detail-wise steam has left
- 00:10:20enough slack here so that as long as
- 00:10:21each DLC is labeled with new weapons new
- 00:10:24enemies new map that would be acceptable
- 00:10:27and that does mean that most developers
- 00:10:28are like going to be fine on that front
- 00:10:31and for the developers of stalker 2 well
- 00:10:33they basically just need to get their
- 00:10:35ducks in the row so that they are in
- 00:10:37compliance with this of course it's
- 00:10:39crazy how many abstract promises that
- 00:10:41developers have made and how long it's
- 00:10:44taken for this to actually happen
- 00:10:47because like this has been a problem for
- 00:10:48a long time
- 00:10:50now say on a personal level I mean I
- 00:10:54know that stalker 2 has came out it's
- 00:10:55had performance issues and all of that
- 00:10:57but my God like very few games are
- 00:10:59developed and also like another
- 00:11:01component for like what this is going to
- 00:11:03do is that if you make a service that is
- 00:11:06primarily putting customers first like
- 00:11:09so earlier today some people might not
- 00:11:11have been watching then but earlier
- 00:11:13today I thought of the idea to try out
- 00:11:16something like this game right so this
- 00:11:18is a game that people said was like not
- 00:11:20letting people play it because of DLC
- 00:11:23well I downloaded the entire 90 Gig file
- 00:11:26and then I find out that in order to
- 00:11:28play the game I have to log into a
- 00:11:29Ubisoft account I immediately
- 00:11:32uninstalled
- 00:11:33it like I wish steam would make it a
- 00:11:36rule that if you want your game on Steam
- 00:11:39you cannot require a login to a
- 00:11:42secondary launcher and or a login into a
- 00:11:45secondary account it can be optional it
- 00:11:48can be um you know advised or suggested
- 00:11:53but for it to be mandatory suck my
- 00:11:56[ __ ] dick and at the end of the day
- 00:11:58it's just an annoying cuz you're buying
- 00:12:01something and like here's the truth I'm
- 00:12:03going to refund this
- 00:12:04game I'm going to refund the game
- 00:12:07because I don't want to have to make
- 00:12:08another
- 00:12:10account it's just obnoxious it's a
- 00:12:13mandatory skip button yes and so like
- 00:12:16and at the end of the day where did I
- 00:12:18have a bad experience guys I had a bad
- 00:12:21experience on
- 00:12:23Steam I did because I bought this game
- 00:12:27and now it's annoying
- 00:12:29what about account linking account
- 00:12:31linking is totally fine the the problem
- 00:12:34is when it becomes
- 00:12:38mandatory that is the issue it's not
- 00:12:41about it being a uh a a possibility or a
- 00:12:45suggestion or even a like you know hey
- 00:12:48you're going to get a little bit extra
- 00:12:49stuff if you do this but if you have to
- 00:12:52do it [ __ ] that that sucks I hate that
- 00:12:57the you know broader environment stalker
- 00:12:592 was develop tired of everything being
- 00:13:01a service I am too I'm so tired of
- 00:13:03having to make an account for everything
- 00:13:06I don't want I don't need an account to
- 00:13:09to download my drivers like just let me
- 00:13:12log in automatically detect what the
- 00:13:14drivers are and just give me the give me
- 00:13:17the
- 00:13:18software like why do I need to make an
- 00:13:21account for a mount yeah I have to have
- 00:13:23an account for razor sign
- 00:13:26apps why why can't I just have this save
- 00:13:29locally onto my
- 00:13:32PC where is the value that I as a
- 00:13:35customer am getting by having an having
- 00:13:38a mandatory
- 00:13:40account and that's the thing is I have
- 00:13:42no problem if they say hey you want to
- 00:13:44save your settings and have them on
- 00:13:46another computer well we have this
- 00:13:48account that you can make I think that's
- 00:13:50great but I [ __ ] hate it being forced
- 00:13:53it makes me so
- 00:13:55mad there is literally no value to me as
- 00:13:58a customer and in fact there is a
- 00:14:01negative value because now I have to
- 00:14:03keep up with another password I have to
- 00:14:05give another person my information and I
- 00:14:08have to keep up with another username I
- 00:14:10have to remember
- 00:14:12this it's completely
- 00:14:15anti-consumer you are the product well
- 00:14:17that's the thing is that the old the old
- 00:14:19meme was if you're not paying for a
- 00:14:21product you are the product now you pay

- 00:14:26product it it it's like there's a

- 00:14:50to be completely ruthless with
- 00:14:51developers here they are giving
- 00:14:53developers flexibility to allow for
- 00:14:55delays and development problems because
- 00:14:57well valve are also game developers I'm
- 00:14:59pretty sure they understand that keeping
- 00:15:01to a development timetable is uh is hard
- 00:15:04you know they run in valve time so they
- 00:15:06take that into account but they do have
- 00:15:07rules in punishment so here it is if
- 00:15:10developers cannot make the three-month
- 00:15:12window that they set for their DLC they
- 00:15:14are allowed to move that DLC to the next
- 00:15:17thre Monon window but if it's anything
- 00:15:19more than that they can't do it in the
- 00:15:20steam back end they can't
- 00:15:23wow so if you have to delay more than
- 00:15:25three months you have to give out
- 00:15:26refunds
- 00:15:31you know what's really funny about this
- 00:15:34is that valve shouldn't be doing
- 00:15:38this because the government should have
- 00:15:41already done
- 00:15:43it this should already be a consumer
- 00:15:46protection
- 00:15:50policy it's insane that like this even
- 00:15:52have pre-orders will be cooked that
- 00:15:54would be six am I misunderstanding you
- 00:15:56guys said
- 00:15:57six I want to go back and look at this

- 00:16:03can pick a new date up to 3 months later
- 00:16:05than you originally s suggested
- 00:16:15yeah one time only during the season

- 00:16:30they are allowed to move that DLC to the
- 00:16:32next 3month window but if it's anything
- 00:16:34more than that they can't do it in the
- 00:16:36steam back end they can't click a button
- 00:16:37basically six months

- 00:16:50they basically need to uh get a meeting
- 00:16:52with the principal and explain
- 00:16:54themselves and if that DLC is delayed

- 00:17:01valve will actually consider action and
- 00:17:04of course that is action that yeah will
- 00:17:07hurt the developer bottom line that
- 00:17:09means that there are clear consequences
- 00:17:11valves framing to
- 00:17:13devel I understand what you guys are
- 00:17:15saying now you're saying that
- 00:17:17theoretically inside of a 3-month window
- 00:17:20because it's based off of Seasons that
- 00:17:22you could release at the later half of
- 00:17:24the Season rather than the beginning of
- 00:17:25the season so 6 months would be a
- 00:17:28theoretical out come but realistically
- 00:17:30it would be 3 months is that what people
- 00:17:32are trying to
- 00:17:37say yes
- 00:17:41okay I I I I don't that that's not six
- 00:17:44months I I I don't agree with that
- 00:17:45thinking but like it could be
- 00:17:47theoretically right so basically it is
- 00:17:50less than 6 months no matter what and in
- 00:17:52some cases only three months

- 00:18:03that's in a best case scenario so like
- 00:18:06so for example right like holiday season
- 00:18:09ends in December so if your planning was
- 00:18:12to release it in December and you said
- 00:18:14holiday
- 00:18:16season you would actually only have
- 00:18:18three months that you
- 00:18:20could uh that you could extend it to
- 00:18:22because it would because you'd already
- 00:18:24be in December to begin with you see
- 00:18:26what I'm saying
- 00:18:30so like I I that's just an example right
- 00:18:33okay so so all right now we're all on
- 00:18:34the same page because I I was getting
- 00:18:36really confused what people were saying
- 00:18:37I was like what the [ __ ] you talking
- 00:18:38about but okay yeah I I I can see what
- 00:18:40the the very very stupid Nuance but

- 00:18:49than six months always but sometimes

- 00:19:08means that there are clear consequences
- 00:19:10Val scaming to developers and Publishers
- 00:19:11is clear well the reason why there's
- 00:19:13consequences to the developers because
- 00:19:15there's consequences to steam when
- 00:19:17people get refunds on Steam steam has to
- 00:19:20probably pay like every refund that
- 00:19:22steam does cost them
- 00:19:25money there is some form of transaction
- 00:19:28that it costs steam in order to give
- 00:19:31somebody a
- 00:19:35refund season pass is a commitment to
- 00:19:39Future releases and it's one that they
- 00:19:41want as a contractor here's a quote if
- 00:19:44you aren't ready to clearly communicate
- 00:19:46about the content included in each DLC
- 00:19:49and when each DLC will be ready for
- 00:19:51launch you shouldn't offer a season pass
- 00:19:54on Steam
- 00:20:05damn damn bro don't make promises you
- 00:20:09can't keep or if you do we're gonna
- 00:20:12refund
- 00:20:15everybody oh my [ __ ] god that's not
- 00:20:18too much to ask it's really not
- 00:20:21basically saying you can't sell vague
- 00:20:23promises anymore they're going to make
- 00:20:24some enemies well here's the thing is
- 00:20:27that
- 00:20:30a platform that puts consumers first
- 00:20:33will create a pressure on developers to
- 00:20:37have have developers use that
- 00:20:39platform a lot of developers probably
- 00:20:42don't like steam they probably don't
- 00:20:45like how it's designed they don't like
- 00:20:46the cut that they take they don't like a
- 00:20:48lot of things but it doesn't matter
- 00:20:50because that's where the fish
- 00:20:52are that's the
- 00:20:55truth so a six-month window for release
- 00:20:58isn't enough valve will a breach of
- 00:21:01contract between developers valve and
- 00:21:03customers and as a punishment they will
- 00:21:06actually take action here are valves
- 00:21:08punishments the season pass may be
- 00:21:10removed from sale they also say all
- 00:21:13unreleased content may be refunded or
- 00:21:16customers may get the option of a refund
- 00:21:18for the whole pass and oh my
- 00:21:23God bro they're laying it
- 00:21:26down that's insane
- 00:21:29and the same will actually apply if the
- 00:21:31season pass hasn't released for one year
- 00:21:33as well and the ultimate Point here is
- 00:21:35that customers will not lose what's this
- 00:21:37here somebody says what about small
- 00:21:38Indie developers who struggle more than
- 00:21:40AAA
- 00:21:42developers why would no so you you you
- 00:21:45so so let me get this straight you think
- 00:21:47that because you ran into a production
- 00:21:49problem now the consumer needs to pay
- 00:21:52for
- 00:21:53that that's not how it works you're
- 00:21:56selling a product the only thing that
- 00:21:58matters is whether your product hits the
- 00:22:00market or
- 00:22:01not you're thinking about empathy but
- 00:22:04what about whenever you take somebody's
- 00:22:05money and you don't give them what you
- 00:22:06told them that you were going to give
- 00:22:07them where's the empathy there it's
- 00:22:11completely
- 00:22:12one-sided now you're not going to trick
- 00:22:14me with that [ __ ]
- 00:22:17uh-uh yeah it's not yeah it's not it's
- 00:22:20not a Kickstarter exactly man yeah
- 00:22:21people don't want to get scammed like if
- 00:22:23you can't release a game and you don't
- 00:22:26know when it's going to come out then

- 00:22:31and also triaa devs [ __ ] up like this
- 00:22:33all the
- 00:22:35time I feel like this is mainly for the
- 00:22:38triaa devs not for the Indie guys the
- 00:22:40Indie guys generally everything's
- 00:22:43fine I mean yeah you have like bad there
- 00:22:46there are bad games right we all know
- 00:22:47like the you know very uh notorious bad
- 00:22:51indie games but I feel like they're few
- 00:22:53and far
- 00:22:55between out because a developer cannot
- 00:22:58meet their Promises of course promises
- 00:23:00the developer has sold to a customer
- 00:23:02that to a lot of developers will sting
- 00:23:04it will feel harsh but you know what
- 00:23:06this industry has been damaged so much
- 00:23:09by commitments to players just being
- 00:23:11fast and loose and not being respected
- 00:23:14at the end of the day people are
- 00:23:16spending money on things that they're
- 00:23:17not getting like if you want to base if
- 00:23:20you want to break this down on like a
- 00:23:23super super rudimentary contract level
- 00:23:28the company said they were going to give
- 00:23:30you something within a time frame and it
- 00:23:33didn't happen now if somebody charges
- 00:23:36you money for something and then you
- 00:23:38don't get what you paid for you should
- 00:23:41get your money
- 00:23:45back this is not it's not
- 00:23:49complicated it's not like this is some
- 00:23:51kind of like you know wizard
- 00:23:54analysis it's common
- 00:23:57sense why games discussion and culture
- 00:24:00is such a flipping mess these days so
- 00:24:04let's talk about games that will fail
- 00:24:05this criteria redfall yeah redfall
- 00:24:08remember that that's a recent example
- 00:24:10where because Microsoft shut down the
- 00:24:11development Studio there was simply no
- 00:24:13plan to make the season pass DLC now
- 00:24:16obviously Microsoft did offer refunds
- 00:24:18there but it was initially unclear if
- 00:24:20that would be the case as Microsoft
- 00:24:22framed that a make good offer was being
- 00:24:25worked on which uh you know in that case
- 00:24:28be money or I'm saying no now it's also
- 00:24:31because they're worried about getting
- 00:24:32sued and this is another really big
- 00:24:35component is that do you remember when
- 00:24:36steam this is like kind of like maybe
- 00:24:38like I don't know three four months ago
- 00:24:40do you remember when steam kind of late
- 00:24:42at night pushed an update that everybody
- 00:24:44had to agree to do you guys remember
- 00:24:48that like everybody had to agree to some
- 00:24:51update it was about like AI or some kind
- 00:24:53of thing like that I don't remember
- 00:24:54exactly only USA it was in the
- 00:24:56USA uh yeah yeah that must be it because
- 00:24:59I think it was a response to a
- 00:25:00California law or like a lawsuit that
- 00:25:02had happened yeah for licenses and so
- 00:25:05anyway
- 00:25:08arbitration steam doesn't want to get
- 00:25:10roped into a lawsuit when a company puts
- 00:25:13out a video game and then they don't
- 00:25:15deliver it and now steam gets named in
- 00:25:18the lawsuit and now they're involved in
- 00:25:20a class action lawsuit for
- 00:25:23fraud you see what I'm
- 00:25:26saying this is how like
- 00:25:29and this has been their perspective on
- 00:25:31AI as well steam does not have a problem
- 00:25:34with AI but they do have a problem with
- 00:25:36saying that you don't have ai they're
- 00:25:39always looking at Trying to minimize
- 00:25:41their own risk and that's what they're
- 00:25:43doing
- 00:25:46here dude just stop watching Bell his
- 00:25:49content has fallen off so much that he
- 00:25:51is now uh in uh Ireland his content is
- 00:25:55just a commercial I was a big fan of his
- 00:25:59uh of his but then he started to be more
- 00:26:01commercial and his content started to be

- 00:26:12he's actually been getting substantially
- 00:26:14more successful like if you look at this
- 00:26:16one this has like 900,000 views this is
- 00:26:19450,000 views like his approach the he's
- 00:26:22taking the content now has been
- 00:26:24incredibly successful and he's doing an
- 00:26:26amazing job this is probably the most
- 00:26:28successful his news channel has ever
- 00:26:30been so I understand that maybe he
- 00:26:32banned you in the comment section so
- 00:26:34you're coming in here and complaining to
- 00:26:35me but um you're just factually
- 00:26:43wrong yeah you're just
- 00:26:52wrong there's probably a wow player
- 00:26:54that's mad that he's not playing wow
- 00:26:56that's probably what's going on here

- 00:27:15removed right removed from sale because

- 00:27:24commit to releasing their DLC regardless
- 00:27:26with all of the season pass owners get
- 00:27:28that as a part of their purchase plus
- 00:27:30everybody in the community actually got
- 00:27:31the first DLC and then season pass
- 00:27:33holders got a free Ubisoft game to make
- 00:27:36up the cost that was them trying to
- 00:27:38navigate the situation but obviously
- 00:27:40here with valve well a developer doesn't
- 00:27:42just get to say oh yeah well that's a
- 00:27:45bad solution because like if they
- 00:27:49say like let's say you go to Taco Bell
- 00:27:53and you want to buy something and then
- 00:27:55they take your money and then they tell
- 00:27:56you oh okay well you can have something
- 00:27:58else on the menu well I don't want
- 00:28:00something else on the menu I wanted that
- 00:28:02thing give me my money
- 00:28:05back like it it's just
- 00:28:09like
- 00:28:10uh some people like I don't know why
- 00:28:14like this has happened is
- 00:28:16that so many so many people and like

- 00:29:21past water fronts completely meets all
- 00:29:23the criteria for listing a season pass
- 00:29:25product on Steam right they've got clear
- 00:29:27descriptions of what the content is
- 00:29:29actually far more detailed than is even
- 00:29:31required and they do have clearly marked
- 00:29:33dates for uh you know the initial sale
- 00:29:35of it as an example right the bridges
- 00:29:37and ports DLC was marked as releasing in
- 00:29:40Q2 of 2024 however the astute among you
- 00:29:43may notice that it's actually Q4 of 2024
- 00:29:46right now and uh that expansion has not
- 00:29:49released in fact in February to ensure
- 00:29:52wider game stability it was updated to
- 00:29:54have a release window of Q2 2025 o which
- 00:29:58I will say is what that developer should
- 00:30:00have done because look if your
- 00:30:02foundations are absolutely shot through
- 00:30:05destroyed what business another example
- 00:30:08of this happening another example of
- 00:30:10this happening was uh Warcraft 3
- 00:30:13reforged is they said it was going to be
- 00:30:16ready at the end of the year and it
- 00:30:17wasn't and like a lot of people are
- 00:30:19bringing that up they said well we
- 00:30:21pre-ordered and you said it would be
- 00:30:22ready by then and now it's not like what
- 00:30:26the [ __ ] what about wayfinder I don't
- 00:30:29know what happened exactly with
- 00:30:30wayfinder I can't comment on that you
- 00:30:33think they give you a brand new game of
- 00:30:34their choice they probably gave you a
- 00:30:35shitty one right that nobody's playing
- 00:30:36anyway I I don't know but never be
- 00:30:39precise unless you've already finished
- 00:30:41all the work or you're experienced in
- 00:30:43what you're doing and you know how long
- 00:30:44the work is going to take I mean that's
- 00:30:45fine because you have to you you have to
- 00:30:48make projections everybody makes
- 00:30:50projections

- 00:30:54massive W for like an average game

- 00:31:35like I I think it's important to just
- 00:31:37like to focus on actions rather than
- 00:31:40individuals because like this action
- 00:31:42that steam is doing is really good now
- 00:31:44steam could make a mistake or do
- 00:31:45something in the future and then I'd be
- 00:31:47like this is bad they shouldn't do this
- 00:31:49but steam does usually make good good
- 00:31:52decisions money has a Time Value too
- 00:31:55these companies are holding large sums
- 00:31:56of money for an indefinite amount of
- 00:31:58time exactly yeah it's like inflation
- 00:32:00Etc yeah of course that's
- 00:32:03true fix the real problem first but you
- 00:32:07can't have it both ways and so in doing
- 00:32:08that you should hand people their money
- 00:32:10back with the plan to ear back later and
- 00:32:13this actually means that what they've
- 00:32:14done in City skylines 2 would land
- 00:32:17squarely within steam's policy of being
- 00:32:19more than 12 months since the intended
- 00:32:21release date if it doesn't hit by then
- 00:32:23now the reasons why the DLC is delayed
- 00:32:26is obviously that's stuff that we've
- 00:32:27covered in
- 00:32:28a lot of detail here and I think broadly
- 00:32:31everyone watching this video understands
- 00:32:32they've got to fix the real problem
- 00:32:34first I mean don't sell people's stuff
- 00:32:36when the thing they've already got is
- 00:32:38[ __ ] but the pro yeah none of that is
- 00:32:40the problem of the consumer and I've
- 00:32:42been seeing this a lot recently where
- 00:32:44you have companies and individuals like
- 00:32:47this is especially true with streamers
- 00:32:49is that streamers like to explain to
- 00:32:52their viewers why certain types of
- 00:32:54content are going to be bad and they
- 00:32:57they're like kind of expecting some sort
- 00:32:59of like parasocial level of uh you know
- 00:33:03accommodation for that I find it to be
- 00:33:05so [ __ ] cringe where people are
- 00:33:08constantly like oh yeah no this is this
- 00:33:11is just the way it has to be or whatever
- 00:33:13no like a a user a consumer a buyer only
- 00:33:19the relationship is about what they're
- 00:33:21buying and I think that people let
- 00:33:24themselves be taken advantage of way too
- 00:33:26much with this kind of stuff
- 00:33:29validation yeah unconditional trust
- 00:33:31exactly it's insane like the
- 00:33:34relationship that you have with a
- 00:33:36content creator or with a company that
- 00:33:37makes video games is that they put out a
- 00:33:40product that you like and then you
- 00:33:42consume the product if you don't like it
- 00:33:43then you stop consuming the product the
- 00:33:46amount of like emotional like kind of
- 00:33:49implications that people try to put on
- 00:33:51that are done purely in order to make
- 00:33:54more money they don't really give a [ __ ]
- 00:33:56about you they just want you to feel
- 00:33:58like they do so you'll give them more
- 00:34:00money problem of a season pass is that
- 00:34:03many people have already paid for that
- 00:34:04DLC and so if we take a look at Val's
- 00:34:06rules guess what you got to give some of
- 00:34:09that money back that's going to sting
- 00:34:11but guess what it is godamn right and
- 00:34:13because Val are the biggest Marketplace
- 00:34:15in PC gaming well they are setting the
- 00:34:18terms of the market they are drawing a
- 00:34:20red line about what is acceptable a lot
- 00:34:23of develop and this should be very
- 00:34:25concerning by the way bellor is looking
- 00:34:27at this from a from a positive
- 00:34:29perspective and I think that it is
- 00:34:31positive but at the end of the day when
- 00:34:33steam can make unilateral decisions
- 00:34:36about how an entire Market behaves that
- 00:34:39is a level of control that one company
- 00:34:41should never
- 00:34:43have if you just take a step back and
- 00:34:46you think about this objectively you
- 00:34:48would see how this is a very dangerous
- 00:34:50precedent to exist in these should be
- 00:34:53policies that are like laws it shouldn't
- 00:34:56be steam making these
- 00:34:59decisions do you think it's because Sony
- 00:35:01has a practical Monopoly on consoles and
- 00:35:03steam on PC games I don't think so
- 00:35:07no are going to I think look at this and
- 00:35:10say right in spirit as a developer of
- 00:35:12games a player of games this is really
- 00:35:14good but they will then think about the
- 00:35:17currently broken funding model of video
- 00:35:20games which is completely biased towards
- 00:35:22Publishers is completely biased against
- 00:35:24developers and they will be fearful and
- 00:35:28In Their Fear they may blash out
- 00:35:30Publishers have a lot of oh like
- 00:35:33Publishers have a lot of control and the
- 00:35:34reason why Publishers are still so
- 00:35:36powerful because like you would assume
- 00:35:38that Publishers aren't as powerful now
- 00:35:40because of like how easy it is to get a
- 00:35:42game out to Market but the problem now
- 00:35:45is that you have so many games going out
- 00:35:47to Market that you can make an insane
- 00:35:50game like Among Us is a great example of
- 00:35:52this Among Us was released for over a
- 00:35:55year before it got really popular when
- 00:35:57soda played it but before that nobody
- 00:36:01was talking about this game nobody was
- 00:36:03thinking about it it was basically dead
- 00:36:04in the water and so there have been a
- 00:36:06lot of examples of that too like
- 00:36:08fortnite is another example whenever
- 00:36:10they came out with the BR mode the BR
- 00:36:12mode wasn't fortnite fortnite was like a
- 00:36:14survival game and then they added the BR
- 00:36:15mode later on so what ends up happening
- 00:36:19is
- 00:36:20that I I is this good covid-19 game yeah
- 00:36:23yeah sure but like Publishers now can
- 00:36:26like provide a platform for marketing
- 00:36:29for a game and that's why for example I
- 00:36:32like doing the show that I did pixel
- 00:36:33pitch and I also like you know like on
- 00:36:35my Reddit if there's a game that comes
- 00:36:37out that's good that people want to see
- 00:36:39I'll just play the game that's it I'll
- 00:36:42just play the game and try it out and I
- 00:36:44think that's really
- 00:36:45what I I wish more platforms would do
- 00:36:49because basically right now we have
- 00:36:53a
- 00:36:55so let me see if I can describe this or
- 00:36:58explain it in a way that makes sense
- 00:37:00visually so right now we have so many of
- 00:37:04these
- 00:37:05games um these are just games right m s
- 00:37:10games that this I I'm not very good at
- 00:37:13spelling and so all of these games need
- 00:37:15to go into like a filter which is
- 00:37:23marketing right this is
- 00:37:26marketing and this includes ads it
- 00:37:29includes streamers it includes
- 00:37:32everything else and then the actual
- 00:37:34things that the public sees and the
- 00:37:36public
- 00:37:39awareness uh public
- 00:37:43awareness I I just I can't um anyway so
- 00:37:48I just I cannot [ __ ] write anyway uh
- 00:37:52basically what happens is that there are
- 00:37:55so few marketing channels that are are
- 00:37:57fair and that are not overpriced or
- 00:38:01massively beneficial for existing
- 00:38:04companies like for example uh you know
- 00:38:06like television ads and stuff like that
- 00:38:08or like existing you know relationships
- 00:38:10with like different brands all of these
- 00:38:13things happen and the marketing here
- 00:38:17this is really where the Publishers come
- 00:38:18in and that's where they create the
- 00:38:21value for these games so it would be
- 00:38:23really good if more people tried to
- 00:38:26promote smaller games
- 00:38:28that way you didn't have Publishers that

- 00:38:54company because things are expensive a
- 00:38:57company has to do things that are bad
- 00:38:59for a consumer it's like oh well we need
- 00:39:02to make money yeah that's right if you
- 00:39:05need to make money in a way that's
- 00:39:07damaging or detrimental to other people
- 00:39:09then maybe you don't deserve to make
- 00:39:11money maybe your business isn't viable
- 00:39:15if you have to do stuff like that that's
- 00:39:17just
- 00:39:20me other changes valve made have very
- 00:39:23much been responding to things I mean
- 00:39:24hell even take a look at steam's
- 00:39:26industry leading refund policy because
- 00:39:29of Australia so uh I suppose for once in
- 00:39:33video games thanks Australia because
- 00:39:35you're an Australian gamer oh there was
- 00:39:37a long time where if you wanted an 18
- 00:39:39rated game oh the government weren't
- 00:39:40going to let you have it but on

- 00:39:49saying no Senator no Senator getting up
- 00:39:52in I don't know the Senate and saying
- 00:39:54season passes are messing up Gamers

- 00:40:00gaming still like the problem is that
- 00:40:02like the voting base is primarily so old
- 00:40:05that they don't understand these
- 00:40:07problems at all I think that in 20 years
- 00:40:09this is going to be completely defined
- 00:40:11it'll be no problem but right now
- 00:40:13because like the people that are making
- 00:40:15decisions in government are so
- 00:40:16disconnected and also in 20 years it's
- 00:40:19just going to be a new group of people
- 00:40:20this is going to be solved but the new
- 00:40:23issue of the time in 20 years will not
- 00:40:25be solved this this issue will just
- 00:40:27repeat itself again from an authority
- 00:40:30valve absolutely are motivated by an
- 00:40:32external force and that external force
- 00:40:34is bad behavior and do you know what
- 00:40:36matters here it's not a slap in the
- 00:40:38wrist it's a clear Financial punishment
- 00:40:42I don't know if this turn phrase that's
- 00:40:43the thing too is because if they if the
- 00:40:45company can stand to lose
- 00:40:47money that is [ __ ] insane because
- 00:40:51that's why they're doing it in the first
- 00:40:53place is if you want people to change
- 00:40:55their behavior pay them a different
- 00:40:57amount of money LS in your country but
- 00:41:00you know we we would over here in
- 00:41:02Northern Ireland call someone a bit of a
- 00:41:03chancer you know if uh they were sort of
- 00:41:05Wheeling and dealing you know being a we
- 00:41:07bit Publishers have often been like that
- 00:41:10they've been planning to you know
- 00:41:13planning to sell you something and
- 00:41:14taking the money early you don't always
- 00:41:16deliver or it's not always to spec
- 00:41:18that's damaged the hobby that we love
- 00:41:20and it has normalized bad behavior such
- 00:41:23the it's and what what I find to be
- 00:41:25especially frustrating to me is not the
- 00:41:29fact that the Publishers do it it's the
- 00:41:31fact that Gamers allow it to happen and
- 00:41:33they don't hold the companies
- 00:41:35accountable that's what's so annoying to
- 00:41:38me because like I can easily see oh yeah
- 00:41:40you're a publisher you're doing things
- 00:41:42that are bad because you just want to
- 00:41:44take advantage of people yeah sure of
- 00:41:47course you're doing that but why the
- 00:41:50[ __ ] are players going along with this
- 00:41:54why are they defending it how do we
- 00:41:56attack back
- 00:41:58stop supporting companies that do things
- 00:42:02that are consumer
- 00:42:05unfriendly if you buy a game and the
- 00:42:08game is doing something that you think
- 00:42:10is consumer
- 00:42:11unfriendly stop playing that game leave
- 00:42:14a negative review and refund
- 00:42:19it stop supporting
- 00:42:23garbage it's that
- 00:42:25simple but your viewers are like 1% of
- 00:42:28the entire player basee worldwide no
- 00:42:29we're not we're like
- 00:42:310.1% we're nothing but what I'm saying
- 00:42:34is
- 00:42:36that I think that a more of a focus on
- 00:42:40customers and consumers understanding
- 00:42:42that they have
- 00:42:44power I I feel like we've had a lot of
- 00:42:46instances of this happen like with
- 00:42:48throne in Liberty for example right they
- 00:42:50totally redid the game because of how
- 00:42:52badly uh it was received I think gamers
- 00:42:57Gamers need to have higher
- 00:42:59standards and if something is existing
- 00:43:01in a way that they think is unfair or
- 00:43:04predatory then the main problem is that
- 00:43:08video gaming is primarily for a lot of
- 00:43:10people a
- 00:43:11Indulgence and whenever you're dealing
- 00:43:14in the economy of
- 00:43:15indulgences it's very hard to get people
- 00:43:17to control
- 00:43:19themselves so what happens is that a
- 00:43:22company will do something that's awful
- 00:43:24and then they'll release a game or that
- 00:43:25you know I've said every gamer boycott
- 00:43:27is one 3 minute cinematic away from
- 00:43:29being
- 00:43:29over it happens every single time it's
- 00:43:35exhausting soon people will just expect
- 00:43:39[ __ ] they will expect to be treated
- 00:43:41badly that has got to end and the only
- 00:43:44way to make it end is clear Financial
- 00:43:48punishment this will lose dev's money it
- 00:43:49will lose Publishers money and I am
- 00:43:52happy about that actually I am too I'm
- 00:43:54very happy if you have to shut down your
- 00:43:56studio and put everybody out of a job
- 00:43:58because you couldn't deliver a product
- 00:44:00that could come to Market and you know
- 00:44:03deliver in a way that consumers wanted
- 00:44:05then you don't deserve to have a
- 00:44:08job if you can't if you can't exist in
- 00:44:11the free market then you don't deserve
- 00:44:12to exist in the free market it's that
- 00:44:15simple winners win and losers
- 00:44:19lose that simple I think it is good and
- 00:44:22that's going to piss people off but the
- 00:44:24point is pretty damn clear incentives
- 00:44:26matter delivery matters execution
- 00:44:28matters at the end of the day if you
- 00:44:30plan to sell a video game with a season
- 00:44:33pass and then you [ __ ] up the video game
- 00:44:35and you [ __ ] up the season pass you know
- 00:44:37what the Mark should punish you such
- 00:44:38that you may actually go under because
- 00:44:40that's the entire godamn Point bad
- 00:44:42companies should die because all they
- 00:44:45are doing is trading surviving of bad
- 00:44:49behavior what I suppose economists might
- 00:44:50call like rent seeking Behavior or the
- 00:44:53sort of thing where if you've ever heard
- 00:44:54of the concept of an unpriced negative
- 00:44:56externality
- 00:44:57that is the [ __ ] that they thrive on
- 00:44:59that's what my spirit my soul says but
- 00:45:01I'm also a pragmatist right there is
- 00:45:04another incentive here you know the way
- 00:45:05sometimes you design a system to
- 00:45:07incentivize a certain Behavior but you
- 00:45:08can accidentally have the opposite
- 00:45:10effect well Publishers may end up having
- 00:45:12Choice here do they release a broken DLC
- 00:45:15for money money of course that they've
- 00:45:17uh well probably already taken because
- 00:45:19it's a season pass will they just put
- 00:45:21that out to hit valve's deadline to
- 00:45:23dodge valve's you know refunds and stuff
- 00:45:26uh saying okay we either if we don't
- 00:45:28release this DLC a massive amount of
- 00:45:30refunds will happen and we'll be in a
- 00:45:32lot of trouble or do we just shoot it
- 00:45:35out right now except that we're going to
- 00:45:36get [ __ ] reviews but you know what
- 00:45:39that's fine because uh they already
- 00:45:41bought the season pass and if we put out
- 00:45:43some slop uh it'll be slop but at least
- 00:45:46it will comply with I think that if a
- 00:45:49company does that they won't be a
- 00:45:50company for very long bellor brings up a
- 00:45:53really good point here in malicious
- 00:45:54compliance and I think that this
- 00:45:56definitely could happen
- 00:45:57but I don't think it's probably as
- 00:45:59common as you might imagine because if a
- 00:46:01company does that a lot of people are
- 00:46:03going to refund it anyway because
- 00:46:05they're going to play it and see that
- 00:46:06it's bad so if you're worried so like
- 00:46:09and and here's the logic right is that
- 00:46:12yeah you won't get as many refunds but
- 00:46:14you will get a lot of refunds if you're
- 00:46:16releasing something that's problematic
- 00:46:18and at the same time you're also going
- 00:46:21to damage your reputation a lot and so
- 00:46:23if a company wants to tank their
- 00:46:24reputation to release a bad unfin
- 00:46:27product that people can refund anyway
- 00:46:29then I say let him do it that's fine
- 00:46:32because there's no way that you can stop
- 00:46:34anybody from releasing a bad like
- 00:46:35sometimes people just release bad games
- 00:46:37right but the best thing that you can do
- 00:46:39is to make sure that the people that are
- 00:46:41buying those bad games have a recourse
- 00:46:43to get a refund if they think that it's
- 00:46:45that if it's that
- 00:46:47bad I don't think you can refund DLCs
- 00:46:50can you I'm not
- 00:46:54sure the letter of the law if not the
- 00:46:57spirit of the law I absolutely can't
- 00:46:59wait to see the ramifications of this

- 00:48:09level no company should have regulatory
- 00:48:12control on an industry I'll give you
- 00:48:15some examples so the way that Apple and
- 00:48:18Google basically have a duop on all
- 00:48:22smartphone applications this is bad for
- 00:48:25consumers now there can be positives
- 00:48:28with duopolies or with monopolies there
- 00:48:31absolutely can be but eventually those
- 00:48:34positives turn into negatives and the
- 00:48:36problem is that when these people
- 00:48:38control a free market you can't expect
- 00:48:40other people to come in and compete with
- 00:48:42them essentially a corporate government
- 00:48:45yes exactly like I had a lot of people
- 00:48:47push back on me people were unhappy at
- 00:48:49me for saying that I supported Elon Musk
- 00:48:52in filing a lawsuit against this because
- 00:48:55companies operating as a quasa
- 00:48:56government in order to compel Behavior
- 00:48:57should concern everyone so a lot of
- 00:49:00companies now and this has been a
- 00:49:02problem with social media companies for
- 00:49:03a while I'll link the video again it's
- 00:49:05been a huge problem with social media
- 00:49:07companies but it's also a problem with
- 00:49:09credit processing companies it's a
- 00:49:11problem with steam it's it the only
- 00:49:14reason why people don't care about steam
- 00:49:16is because steam is doing the right
- 00:49:17things basically steam is doing
- 00:49:20something that they shouldn't be able to
- 00:49:22do but because they're doing it for the
- 00:49:24right reasons people are okay with it
- 00:49:26it's like bat or something right and so
- 00:49:28that's the reason why uh like I I would
- 00:49:31say like these smartphone apps that I
- 00:49:33gave an example for earlier
- 00:49:36um I feel like those are like those are
- 00:49:38the ones that
- 00:49:40immediately that they immediately come
- 00:49:42to mind yeah a benevolent dictator yeah
- 00:49:44right exactly because I've talked to
- 00:49:45guys here's the
- 00:49:48truth I've talked to guys in Saudi
- 00:49:50Arabia and I've been like bro you guys
- 00:49:54can't even elect anybody like what the

- 00:50:43that people can Thrive like good things

- 00:50:49will always eventually happen in bad
