and it is anti-democratic from a

government that continually protest

there for freedom and democracy where

they're taking democracy away from

approximately six million people the

though the Heritage party has been

challenging this and our fantastic

General Secretary meline hunt has been

writing letters and uh requesting

information through Freedom of

Information requests and writing to even

the government Barrister who is trying

to defend this decision in order to make

a challenge as to the legality of this

election

cancellation and the government has
00:01:29
written back and it's very very
00:01:32
interesting uh what they've said now

meline on behalf of the Heritage party

wrote to the government on the 6th of
00:01:40
February um requesting information
00:01:43
within the normal 14-day period but they
00:01:46
said well we can't answer within 14 days
00:01:48
we can answer within about six not six
00:01:51
weeks four weeks so they responded
00:01:54
actually finally on the 6th of
00:01:57
March and uh there's some very
00:02:00
interesting things in the letter which I
00:02:02
will just go through here not that one

um one of the first things they said in
00:02:11
the letter was just to to set the scene
00:02:13
and say that what happened was the
00:02:16
Secretary of State um for local
00:02:20
authorities um sorry made the local
00:02:24
authorities uh changes to years of
00:02:26
ordinary elections England order 2025
00:02:29
which was laid before Parliament on the
00:02:32
11th of February and came into force on
00:02:34
the 4th of March now the 11th of
00:02:36
February is an important day to remember
00:02:39
for um just a few minutes
00:02:42
time
00:02:44
and they went on to say well the local
00:02:47
government act includes Powers available
00:02:51
to the Secretary of State to alter
00:02:54
elections uh to by order the scheme of
00:02:57
Elections to local authorities and the
00:02:59
years in which elections are held so
00:03:02
this power has been in law under the
00:03:08
local author Local Government Act 2000
00:03:11
uh since the year 2000 and then they say
00:03:14
well this has been used before in a
00:03:16
number of cases in 2018 in some
00:03:20
districts in buckinghamshire and Dorset
00:03:22
there was some local government
00:03:24
rearrangement there uh Northampton share
00:03:27
which was in financial collapse so the
00:03:30
the county uh was you know was no longer
00:03:34
viable so they changed the structure of
00:03:36
government in Northampton sh in 2018 as
00:03:39
well and also then they say Cumbria
00:03:41
North Yorkshire and Somerset in 2021 the
00:03:45
thing with these is that apart from
00:03:48
Northampton Shire which was in financial
00:03:50
collapse the other places there were
00:03:53
already consultations and discussions
00:03:57
going on for a very long long time
00:04:00
before that for example in Somerset they
00:04:03
postponed the elections from 2021 to
00:04:06
2022 but there were already
00:04:09
consultations going on as to what would
00:04:11
happen in Somerset from 2018 so they'd
00:04:14
already had three years of discussions
00:04:16
about what was going to happen in
00:04:18
Somerset they postponed the elections
00:04:20
for a year but they knew what was going
00:04:22
to happen afterwards or was pretty
00:04:24
certain what was going to happen
00:04:26
afterwards anyway in terms of
00:04:28
restructuring the local government now
00:04:30
the thing the difference between then
00:04:33
those examples that they've just given
00:04:34
and now is that they've just suddenly
00:04:38
said we're going to cancel elections in
00:04:40
these nine areas um but there's been no
00:04:44
discussion as to what's going to take
00:04:46
place the the government's Minister
00:04:49
Angela Raina has just been saying well
00:04:51
we're going to have unitary authorities
00:04:53
here but they don't know what the uni
00:04:56
authorities are going to be are they
00:04:57
going to be councils are they going to
00:04:59
be districts are they going to be uh a
00:05:02
mix of the two larger districts are they
00:05:04
going to get rid of the councils and
00:05:06
have four or five unitary authorities
00:05:09
within each Council or are they going to
00:05:10
just have the county as the unitary
00:05:13
Authority no one knows no one's been
00:05:16
consulted in the public at all they've
00:05:18
had some you know very very uh
00:05:21
rudimentary consultations with
00:05:24
counselors and a lot of them we
00:05:26
understand are acting out of their own
00:05:28
self-interest because some of them think
00:05:30
well we're County councilors we'll go
00:05:32
along with this because we're going to
00:05:34
be in control of more and then we'll get
00:05:37
a larger stien and more power and
00:05:39
particularly the leaders of the councils
00:05:41
who actually believe that they're going
00:05:43
to be these new mayors they're going to
00:05:46
have to have a position as the new
00:05:47
Regional mayors of the council and
00:05:50
they're going to be able to employ lots
00:05:51
of staff so a lot of people are angling
00:05:55
to get a job and a position and finance
00:05:57
and a salary in whatever comes
00:06:00
afterwards not acting in the interests
00:06:02
of the people and providing the best
00:06:04
public services to um the people who are
00:06:07
going to be affected by these changes in
00:06:10
the council areas where they have
00:06:12
postponed as they say but actually
00:06:15
cancelled the elections because we don't
00:06:17
know what's going to come afterwards if
00:06:19
these uh local County authorities are
00:06:22
even going to exist afterwards anyway
00:06:26
section 87 just to to show you this
00:06:29
actually is um a law this is section 87
00:06:32
of the Local Government Act 2000 it does

actually say here the Secretary of State

May by order make provision uh which
00:06:41
changes the years in which the ordinary
00:06:43
elections of councils of any specified
00:06:46
local Authority are to be held but which
00:06:48
does not change the scheme which
00:06:50
prevails bar for the ordinary elections

of those councilors the thing is if they
00:06:55
they're replacing the councils you know
00:06:57
you could argue that the scheme is going
00:06:59
to change you know if they're going from
00:07:03
um you having thirds and halves
00:07:08
elections every year apart from one two
00:07:10
elections every four years but um you
00:07:12
know that's a moot
00:07:14
point um the order that's been made as
00:07:17
you can see it here it's the local
00:07:19
authorities changes to years of ordinary
00:07:22
elections England order 2025 and it
00:07:25
actually says there they're postponing
00:07:27
the elections for one year the the
00:07:29
elections that would have been held in
00:07:31
2025 are going to be held in 2026 but we
00:07:34
don't know that that's the thing we
00:07:37
don't actually know this because there
00:07:39
hasn't been any consultation as to
00:07:41
whether these councils are actually
00:07:43
going to have even exist in 2026 to have
00:07:47
elections or or not or even if the
00:07:51
changes to the local government are
00:07:52
going to be ready by 2026 because there
00:07:55
hasn't been any consultation with the
00:07:57
public whatsoever as to what public
00:07:59
wants so if there were to be a judicial
00:08:03
review and that could happen then you
00:08:07
may be able to challenge this order on
00:08:10
the basis that we don't know whether
00:08:12
these councils are still going to exist
00:08:14
and there's been absolutely no
00:08:16
discussion and consultation as to what
00:08:19
will replace them so we don't know if
00:08:22
the local government reorganization that
00:08:25
Angela Raina wants will actually be
00:08:27
complete in time to hold
00:08:30
elections in whatever new or unitary
00:08:32
Authority she said she wants by 2026
00:08:35
because the discussions and
00:08:37
consultations may not have finished by
00:08:39
then so then you may have to have
00:08:42
another delay in elections until 2027 or
00:08:46
2028 which would really um make a
00:08:49
mockery of democracy I mean I don't
00:08:51
think that this order should should
00:08:52
stand if there were a judicial review um
00:08:56
on the basis that they don't actually
00:08:57
know what they're going to to replace
00:09:00
these councils with because it's all
00:09:02
chaotic and up in the air and just being
00:09:04
done essentially on a whim without any
00:09:07
plan whatsoever it's being rushed
00:09:09
through without any plan or any thought
00:09:11
for local people um the trouble with
00:09:14
judicial reviews of course is that
00:09:16
they're very expensive to do I think
00:09:18
they cost at least
00:09:20
£5,000 um you know I don't have the
00:09:22
money to actually enact a judicial
00:09:25
review but you would think you know
00:09:26
people who try to speak out of about
00:09:29
this who've got a bit more money might
00:09:31
actually you know challenge this with a
00:09:33
judicial review there's still time
00:09:36
because the nomination period for the
00:09:39
2025 elections uh doesn't begin
00:09:42
officially until the 26th of March or
00:09:45
thereabouts and closes on the 2nd of
00:09:48
April so you could have a judicial
00:09:51
review um before the election process
00:09:55
begins the other thing about this that
00:09:57
they wrote which is very interesting

interesting is that they said well this

order has been
00:10:04
laid under a statutory instrument so the
00:10:07
Local Government Act 2000 allows Angela

Raina who's the Secretary of State to

make an order that I just showed you

which is a statutory instrument a piece

of secondary legislation and the
00:10:19
statutory instrument is subject to the
00:10:22
negative procedure and as it is there is

a 40-day period in which the order can
00:10:27
be prayed against in in
00:10:30
Parliament so remember I said Remember

the 11th of February which is when the
00:10:35
order was was laid uh and it came into
00:10:39
effect on the 4th of March so there are
00:10:42
40 days and this is a 40 sitting days

with a five day sitting week in
00:10:48
Parliament that actually gives you eight

weeks to challenge the order so an MP or
00:10:56
a lord can challenge this order

and seek a motion with a vote in

Parliament and if the vote has more

votes against it then for it then the
00:11:09
order will become null and void from the
00:11:13
parliament's website this sort of

explains the procedure a negative

procedure it's a type of parliamentary

procedure that applies to statutary

instruments Etc um a statutory

MPS and Lords have the power

collectively to overturn the

cancellation of the elections now I

haven't heard anyone talking about this

at all um and that there is a

possibility to overturn this in

Parliament and you know you have other
00:13:35
parties after the Heritage party such as

reform they say oh this is terrible the
00:13:41
elections are being cancelled it affects
00:13:43
us well it affects all the Challenger
00:13:45
parties it's very clear that the reason
00:13:47
that they're doing this is because they
00:13:50
don't want any Challenger parties to to
00:13:52
make ground and get counselors in this
00:13:56
year's elections the Heritage party is
00:13:58
very very affected by this because we
00:14:01
had a lot of candidates in the areas
00:14:04
where the elections have been cancelled
00:14:05
like Sussex and Su and Hampshire and
00:14:08
Essex for example uh we we still do have
00:14:11
a lot of candidates in Kent and Devon
00:14:13
and other places but we had a lot in
00:14:15
those areas where the elections are
00:14:17
being cancelled a reform have said the
00:14:19
same but they seem to be more interested
00:14:21
in fighting each other now they've
00:14:23
collapsed into you know fighting like
00:14:27
rats in a sack that they're not really
00:14:29
focused on the game but it's not the
00:14:32
game but they're not focused on the
00:14:33
political process even though they're
00:14:35
they're saying that they are so it's
00:14:37
taken the Heritage party it's taken uh

our general secretary meline to write uh

government I mean if you know the

Parliamentary process very well yeah you

they can be in the chamber and vote

against it but I haven't heard any MP

from any party in Parliament uh actually

make any noise at all not a single

statement about the possibility of

getting these elections cancelled but

you know if people have spoken about it

and just you spoken about it on social

media there who are MPS and who are

Lords um

then they can actually take action uh so

it would be very interesting to see you

know the people who do have those

positions whether they will decide to uh

pre against this uh statutory instrument

and try to get our elections reinstated

and uncancelled because there has to be

done now um because if they leave it

gets its way the government which is

we know uh we wouldn't waste a second in
