- 00:00:00what's the AI learning from is it really
- 00:00:02original and that's like part of the big
- 00:00:04problem AI is learning from the stuff
- 00:00:06that was made by humans do you legally
- 00:00:08own the stuff that you make using AI do
- 00:00:11you have copyright protection these are
- 00:00:13the bigger questions that I haven't seen
- 00:00:15anyone answer and I'm a music attorney
- 00:00:17so I'm going to talk about it today
- 00:00:19while I'm going to focus on udio
- 00:00:21specifically which is right now just
- 00:00:23everyone is so excited about this
- 00:00:25platform its capabilities I mean people
- 00:00:27are just freaking out and it's allegedly
- 00:00:29better than soon know and we're going to
- 00:00:30go through its terms of service and I'm
- 00:00:32going to possibly accidentally kind of
- 00:00:35expose them a little bit what I'm trying
- 00:00:38to do is have a bigger conversation and
- 00:00:39to walk you guys through how this works
- 00:00:41so that when you make music if you make
- 00:00:43music in any kind of way from this
- 00:00:45platform or AI in general and then you
- 00:00:47release it and then you sell it what do
- 00:00:49you need to know so you can stay legally
- 00:00:52protected in their terms of service they
- 00:00:54kind of reveal what is coming and right
- 00:00:56now for the beta version and the stuff
- 00:00:58that it does it's really amazing but
- 00:01:00what I kind of accidentally uncovered as
- 00:01:02part of the things that I accidentally
- 00:01:03uncovered looking into this is what
- 00:01:06they're going to be doing which I'm
- 00:01:07going to walk you through so where I
- 00:01:09thought I would kind of start with this
- 00:01:10and let me share my screen udio it's
- 00:01:13funny I actually went to their website
- 00:01:14and I was trying to you know because I
- 00:01:17haven't actually used the product yet
- 00:01:18but I'm like preparing for this video
- 00:01:19I'm like all right let's whatever I went
- 00:01:21to the website and my virus protection
- 00:01:23was like don't go to this website it's
- 00:01:25terrible I don't know why I don't know
- 00:01:27why but I just ignored it and I got on
- 00:01:29the platform from I use it so where I
- 00:01:30want to stop start is with just the the
- 00:01:32question in regards to copyright because
- 00:01:34this is what you guys are concerned
- 00:01:35about you go if I make the the thing on
- 00:01:37this platform in any kind of way do I
- 00:01:39own the copyright in the song that I
- 00:01:42created and so this came out in March of
- 00:01:4520123 and so basically the copyright
- 00:01:47office was saying that AI is essentially
- 00:01:51being excluded from any possible
- 00:01:55registration that you try to file so if
- 00:01:57we remember under us copyright law when
- 00:02:00you make something when you make
- 00:02:01something you automatically have
- 00:02:04copyright ownership in that thing okay
- 00:02:06that's the beauty of copyright law but
- 00:02:08the copyright office came out and they
- 00:02:10go this policy they they' made a big
- 00:02:12statement they go look we have explained
- 00:02:14that human authorship is required for
- 00:02:17copyright protection and that they will
- 00:02:19refuse to register any Works any music
- 00:02:22right any videos anything that is made
- 00:02:24from Ai and so we go okay so then when
- 00:02:27it comes to just like realistically if
- 00:02:30we can utilize these platforms and I've
- 00:02:31had people ask me in regards to I'm
- 00:02:33using AI to help with my cover art it's
- 00:02:35a great tool I kind of like what it's
- 00:02:37coming up with but what are the reasons
- 00:02:38why I shouldn't do this we're going to
- 00:02:40touch on that but so this is what the
- 00:02:41copyright say they go you're not going
- 00:02:42to own the stuff that is made from Ai
- 00:02:44and we go okay well why is that the
- 00:02:46reason why is under 17 USC Section 102
- 00:02:49this is what it says it goes copyright
- 00:02:51protection subsists in accordance with
- 00:02:53this title and it is required that it be
- 00:02:56an original work of authorship okay so
- 00:02:59an original work work of authorship
- 00:03:01assumes that it's made by a human okay
- 00:03:03and we've had cases litigated about this
- 00:03:05with things that may or may not have
- 00:03:06been made by a machine or a device and
- 00:03:09all of this so we start with just a
- 00:03:11general kind of premise of under
- 00:03:13copyright law great news when you make
- 00:03:14something and put pen to paper you do a
- 00:03:17little voice memo you record in your
- 00:03:19studio you actually have automatic
- 00:03:21copyright great and the reason why we go
- 00:03:23and we register with the copyright
- 00:03:25office is because it's a prerequisite if
- 00:03:27you want to sue someone if you hire me
- 00:03:29and you're like need to assume they
- 00:03:30stole my song you have to have the piece
- 00:03:31of paper that says you actually
- 00:03:33registered with the federal government
- 00:03:34so those are the two steps we keep in
- 00:03:36mind so again if we are using AI in any
- 00:03:39part of the musical development if not
- 00:03:41the entire thing what does that mean for
- 00:03:44you all right so with that being said
- 00:03:45let's bounce on over real quick to udo's
- 00:03:48terms of service all right so last
- 00:03:51revised March 18th 2024 I'm going to
- 00:03:54very specifically focus on a couple of
- 00:03:56things one of which is that they
- 00:03:57identify themselves as Uncharted labs
- 00:03:59Incorporated we're going to keep that in
- 00:04:01the back of our minds because I really
- 00:04:02like to stock out companies I like to
- 00:04:05know where are they who are they who are
- 00:04:07they owned by what are they doing all
- 00:04:09that stuff now in the very beginning of
- 00:04:11this they go hey just a quick heads up
- 00:04:13in section n there is a waiver of class
- 00:04:16action rights there's an arbitration
- 00:04:18Clause just so you know this is coming
- 00:04:19but we do give you the right to opt out
- 00:04:22now I'm G to I'm going to talk about
- 00:04:23this in a sec and I kind of like that
- 00:04:25and I'll explain why but what I really
- 00:04:27want to just hyper focus on is going to
- 00:04:29be there's two things that happen on
- 00:04:32udio right those two things are one you
- 00:04:35get on the platform and you give it some
- 00:04:37kind of instruction you give it some
- 00:04:39kind of prompt and pursuant to the terms
- 00:04:42it says this is defined as input content
- 00:04:45right so the services will allow you to
- 00:04:46prompt direct and to provide other
- 00:04:50content this is how we know that there's
- 00:04:52other stuff coming from this platform
- 00:04:54which may include lyrics and audio files
- 00:04:57as inputs which is collectively defined
- 00:04:59as input content so that's one of the
- 00:05:01things that are happening here the next
- 00:05:03thing that happens here is that it's
- 00:05:04going to generate stuff for you it's
- 00:05:06going to generate sound recordings
- 00:05:07musical composition lyrics text visual
- 00:05:10content so then this is defined as the
- 00:05:12output now one thing that I kind of want
- 00:05:13to keep in mind is that they go on to
- 00:05:16say for the stuff that you put into US
- 00:05:18plus the stuff that pops out so the
- 00:05:21input and the output content you give us
- 00:05:25rights to use so it says you acknowledge
- 00:05:27and agree that we may use your input
- 00:05:30content and output to train or otherwise
- 00:05:33improve our services now as we go
- 00:05:35through this you I'm going to point out
- 00:05:37all the places where it talks about how
- 00:05:39you know you might provide third party
- 00:05:41material or material to it and I go
- 00:05:43right now from what I can see there's no
- 00:05:45way to like upload a track because I had
- 00:05:47that thought I'm like well what if I
- 00:05:48make a great instrumental and I want it
- 00:05:49to help me write a Topline I understand
- 00:05:51there's different platforms that do that
- 00:05:53but specifically with this one I go well
- 00:05:54it doesn't look like you can do it it's
- 00:05:56more of you just give it prompts I want
- 00:05:58this kind of thing with this kind of
- 00:05:59vocal and this kind of styling and it
- 00:06:01could you know pop out a great song so
- 00:06:03the services may allow you to download
- 00:06:05copies of another user's output so
- 00:06:08someone else who makes a song or more
- 00:06:10importantly if you make a song someone
- 00:06:12else can download what you made your
- 00:06:15output and similarly Others May download
- 00:06:18copies of your output you may only use
- 00:06:20another output for personal and
- 00:06:22non-commercial purposes and you can only
- 00:06:26do it you know as far as actually
- 00:06:28utilizing someone else's song with their
- 00:06:30consent so again this goes back to from
- 00:06:32what currently you can use the platform
- 00:06:34for I don't see that this is in any kind
- 00:06:36of place there's no like Community I can
- 00:06:38go to right um or post my song publicly
- 00:06:41so that it would be shared but I think
- 00:06:43that's that's coming but just so you
- 00:06:45know whenever you were watching this
- 00:06:48that anything that you make on this
- 00:06:50platform not only may be re-produced by
- 00:06:54someone else so if you're like oh I'm
- 00:06:56going to sneakily like make my music on
- 00:06:58this platform and release it and no
- 00:06:59one's ever going to know what they
- 00:07:01actually say in their terms is that
- 00:07:03someone may put in the combination of
- 00:07:04things that you put in and the exact
- 00:07:06same song may get spit out for someone
- 00:07:08else so just from a kind of you know how
- 00:07:11you want to play this keep that in mind
- 00:07:13they do set forth a bunch of stuff in
- 00:07:14here and they're just like look you
- 00:07:16can't reverse engineer our platform you
- 00:07:18can't learn how to do what we're doing
- 00:07:20and all that but also from the stuff
- 00:07:21that you make here's the things that
- 00:07:23we're just going to kick you off the
- 00:07:24platform for you know stuff that's
- 00:07:25defamatory obscene pornographic it
- 00:07:28violates privacy it's harassing
- 00:07:30threatening so they say this a bunch of
- 00:07:31times all right that's all fine you know
- 00:07:33you have to be at least 13 years of age
- 00:07:35to use the platform where I kind of want
- 00:07:37to jump in is with Section I think it
- 00:07:38was six so go all the way down oh yeah
- 00:07:41this made me laugh so they go the beta
- 00:07:43offerings are as is and they say a
- 00:07:44couple times or like if you get a bug on
- 00:07:46your computer because of us that's on
- 00:07:48you all right so six ownership and
- 00:07:51content so we go back to all right if
- 00:07:53you use this platform the stuff that is
- 00:07:56generated that you do not already own
- 00:07:58you don't Magic own it so you might be
- 00:08:01thinking you're like well if we said
- 00:08:02under copyright law that authorship is
- 00:08:05when you you know fix an idea into a
- 00:08:07tangible medium wasn't it my idea to put
- 00:08:10together all of these great things these
- 00:08:12great descriptors like it wouldn't have
- 00:08:14come up with this thing except for me
- 00:08:16telling it what to do so doesn't that
- 00:08:17entitle me to the copyright under the
- 00:08:19law the answer is no your input was so
- 00:08:21minimal and it's basically just
- 00:08:23disregarded so you don't have copyright
- 00:08:24so we're keeping that in mind but it
- 00:08:25still goes back to the question of well
- 00:08:27you're going to use this stuff for what
- 00:08:29something right it's not just this
- 00:08:30platform and so then it's well if you do
- 00:08:32use it and then you sell it or you
- 00:08:34stream it or you do these things how
- 00:08:36does that potentially backfire on you so
- 00:08:39here in section six they go here's all
- 00:08:41stuff in regards to ownership and
- 00:08:43content using this specific platform so
- 00:08:46whenever you know pertains to the
- 00:08:48services they Define their platform with
- 00:08:51the look and feel so example meaning
- 00:08:54text Graphics images logos as
- 00:08:56proprietary content information and
- 00:08:58other material
- 00:09:00and any technology use for any output
- 00:09:02this is our copyrighted stuff these are
- 00:09:04our trademarks this is our IP I'm a
- 00:09:06trademark attorney I'm a copyright
- 00:09:08attorney so I know how to look this
- 00:09:09stuff up I was like hm you say that
- 00:09:11you're a trademark owner let's take a
- 00:09:13look so I went on the trademark office
- 00:09:15website and I did a little search so
- 00:09:18this is their filing right here on the
- 00:09:20right and so you can see they filed for
- 00:09:23the trademark udio in the class of nine
- 00:09:26as well as the class of 42 we know that
- 00:09:29because remember we said it was
- 00:09:30Uncharted labs and so they are
- 00:09:31registered in Delaware now just so you
- 00:09:33guys know the reason why a lot of
- 00:09:35companies register in Delaware there's
- 00:09:37many of reasons but sometimes they do it
- 00:09:39because you can't look up who owns a
- 00:09:42company in Delaware also Wyoming and so
- 00:09:45sometimes people will register there
- 00:09:47because they don't want anyone knowing
- 00:09:49who the owner is I don't know if that's
- 00:09:50the case here I'm just saying I just
- 00:09:52noticed they are in effect registered in
- 00:09:54Delaware but the other thing I also
- 00:09:55noticed is that there's another udio and
- 00:09:58not only is there another udio which is
- 00:10:00okay we can have trademarks we can have
- 00:10:02trademarks for the exact same name as
- 00:10:04long as that name is in a totally
- 00:10:06different category we call them classes
- 00:10:08so if there is Metallica and Metallica
- 00:10:11does music Metallica Metallica does live
- 00:10:13shows and sells merchandise so they have
- 00:10:15all these categories but there could be
- 00:10:17Metallica I'm trying to think of
- 00:10:19something that' be so unrelated I don't
- 00:10:20know knitting there's Metallica knitting
- 00:10:22services or something like that that
- 00:10:24actually is okay so there's an udio in
- 00:10:26class 42 and there's a udio here right
- 00:10:29right in class 42 so they actually do
- 00:10:31the same thing and I go okay that's
- 00:10:32interesting so I look at the owners okay
- 00:10:34so here in the owners it goes this udio
- 00:10:36which is registered meaning this person
- 00:10:39this company already got this trademark
- 00:10:41and it's owned by udio systems LTD
- 00:10:44proprietary limited company which is
- 00:10:45based in Australia and so I go did we
- 00:10:48just uncover that the owner of udio is
- 00:10:51based in Australia or is this really a
- 00:10:52different company because one of two
- 00:10:54things is happening here either the
- 00:10:56attorney for udio the AI music Creator
- 00:11:00didn't do their research to see that
- 00:11:01there's another registration in the
- 00:11:02exact same class which is going to be
- 00:11:04very problematic they're not going to
- 00:11:06get it or this is actually the same
- 00:11:07company anyway let's move on just to
- 00:11:09show you guys what this looks like so it
- 00:11:10shows class n so this is what the AI
- 00:11:13udio applied for so class 9 so they go
- 00:11:16for nine we do computer software we have
- 00:11:18downloadable AI software apps for
- 00:11:21discovering creating storing music and
- 00:11:23then class 42 so this is AI software for
- 00:11:27discovering creating generating storing
- 00:11:28music that
- 00:11:30okay we're fine with all of that we're
- 00:11:31just kind of curious about some of that
- 00:11:32additional information and then also the
- 00:11:35udio that we're talking about the terms
- 00:11:36of service here's kind of the backd door
- 00:11:38stuff you guys don't get to see which is
- 00:11:40they filed this in March so just a month
- 00:11:43ago so they are just brand new on all
- 00:11:46things they're brand new on filing for
- 00:11:47their trademark so back to the terms of
- 00:11:49service so they go look in regards to
- 00:11:51our copyrights in regards to how we do
- 00:11:54stuff on this platform it's our
- 00:11:55proprietary stuff you can't come and
- 00:11:57reverse engineer our stuff otherwise
- 00:11:59you're going to get into trouble fine no
- 00:12:00problem what we care about more than
- 00:12:02anything is for the output as it's
- 00:12:05defined here how does it affect you if
- 00:12:08you use it all right so moving on 6.3
- 00:12:10your content in connection with your use
- 00:12:13of the services you may be able to post
- 00:12:16upload or submit the content and other
- 00:12:20information owned and controlled by you
- 00:12:21such as your input content which again
- 00:12:24guys remember we were just talking about
- 00:12:25this and we're like it's not just the
- 00:12:27instructions that you give this platform
- 00:12:29but it actually does Define that you may
- 00:12:31it you may be able to upload stuff onto
- 00:12:33this platform at some point and they
- 00:12:35covered this at length to be like hey in
- 00:12:38regards to the stuff that you upload
- 00:12:39onto our our platform you agree you own
- 00:12:41it this isn't like infringe stuff from
- 00:12:43someone else so that's why I'm like I
- 00:12:45think that's where this platform is
- 00:12:46going which is going to be really
- 00:12:48interesting because now it's this idea
- 00:12:50of merging your original stuff with the
- 00:12:53AI component which is going to make this
- 00:12:55so complicated legally and from the
- 00:12:57standpoint of of copyright but anyway so
- 00:12:59as between you and the company company
- 00:13:02does not claim ownership in what you
- 00:13:04make I was like Ah that's interesting so
- 00:13:06the company does not claim ownership in
- 00:13:08your content so anything you give to the
- 00:13:11platform including any output so any
- 00:13:13stuff any songs that you create which
- 00:13:15are generated by you in response to the
- 00:13:18submission of your input content to the
- 00:13:20services provided to the company its
- 00:13:22Affiliates all people that work you know
- 00:13:24there own the services and the
- 00:13:26technology itself okay we're fine with
- 00:13:28that you may may use your output for
- 00:13:30both this is so important this is the
- 00:13:32big question here how can you use what
- 00:13:34you make this is what they say you can
- 00:13:36use the music that you make for both
- 00:13:40personal and Commercial purposes and we
- 00:13:43permit you to download a copy of the
- 00:13:44output that consists of an audio file
- 00:13:46for such purposes so at least as it
- 00:13:49relates to the question of if you make
- 00:13:52something and then you want to sell it
- 00:13:54right because you know we'll we'll we'll
- 00:13:55talk about all the ways that we think
- 00:13:57this is going to impact a lot of
- 00:13:58people's jobs in the music business but
- 00:14:01if you generate music for a film and
- 00:14:04then you sell or put on music platforms
- 00:14:06right a soundtrack for the film you make
- 00:14:09a song you put the song on your album
- 00:14:11like all this stuff pursuant to at least
- 00:14:13this contract these terms of services
- 00:14:16you are okay to do that from a legal
- 00:14:18standpoint that's one thing we at least
- 00:14:19have Clarity on now in order to operate
- 00:14:21the services we may need to obtain from
- 00:14:24you certain license rights in your
- 00:14:26content that actions we take in the
- 00:14:29operating I'm sorry I'm saying that
- 00:14:30weird in your content so that actions we
- 00:14:34take in operating the services are not
- 00:14:37considered legal violation so that's
- 00:14:38another place we're seeing in regards to
- 00:14:41your content I'm thinking they're going
- 00:14:43to have you you know be able to upload
- 00:14:46some of your stuff onto this platform
- 00:14:47and I don't see why that would be a
- 00:14:48logical progression I literally had that
- 00:14:50thought I go what if I just put my
- 00:14:52instrumental because producers do all
- 00:14:54this all the time right and we go this
- 00:14:55would be one of the jobs that's going to
- 00:14:56get affected right so one of my clients
- 00:14:59she gets hired to do top lines for
- 00:15:01producers right so she comes up with the
- 00:15:03words she comes up with The Melodies and
- 00:15:05stuff like that and other platforms do
- 00:15:06this it's just will this platform do it
- 00:15:08it kind of seems that they're going to
- 00:15:10all right so you grant to us and all of
- 00:15:12our you know Associates we can reproduce
- 00:15:15transmit publish display and modify your
- 00:15:18content to operate improve and promote
- 00:15:20the services so this is just meaning
- 00:15:22they can study your stuff right so the
- 00:15:25AI can learn from what you upload to the
- 00:15:29platform which kind of goes back to my
- 00:15:30whole as you guys are making music on
- 00:15:33these platforms and then selling it or
- 00:15:35Distributing it and also how it can be
- 00:15:37used not only by this platform but by
- 00:15:41other people on the platform so that's
- 00:15:43where we're paying attention to stuff
- 00:15:44where it's like you give us the right to
- 00:15:48promote your content your output the
- 00:15:51stuff that you make on this platform so
- 00:15:52don't think that you know at least as of
- 00:15:54now that what you're doing is going to
- 00:15:56be kept completely private and that no
- 00:15:58one's going to know or that someone's
- 00:15:59not going to come up with the exact same
- 00:16:01thing that you came up with we're going
- 00:16:03to do all these things including we can
- 00:16:04reproduce we said this publish we can
- 00:16:06distribute your output based on your
- 00:16:08input content so right if you uploaded
- 00:16:10something at some point also the
- 00:16:12instructions you gave it to train or
- 00:16:14otherwise improve or modify our
- 00:16:15artificial intelligence for clarity this
- 00:16:17grant of right includes a grant of All
- 00:16:19rights necessary for company and our
- 00:16:21Affiliates successors assigns right so
- 00:16:23all the people that work with us to be
- 00:16:24able to do the same thing that's
- 00:16:26essentially what it is so and we not
- 00:16:28only that but we can do it in any media
- 00:16:30now knowing or here after developed in
- 00:16:33regards to monetizing right so if we
- 00:16:35want to make money from it if we want to
- 00:16:36promote it if we want to Market it so
- 00:16:38they go on to basically just be like
- 00:16:39look understand that there's a couple
- 00:16:41things that are going to happen here one
- 00:16:43is and this is a big one okay so we're
- 00:16:46going to get to this where they say in
- 00:16:48in regards to credit you have to tell
- 00:16:51the public that you're using this
- 00:16:53platform do I think all of you are going
- 00:16:54to do that no do I think that even some
- 00:16:57people ethically feel
- 00:16:59okay using this platform because they're
- 00:17:01like and we'll talk about this but
- 00:17:02pursuant to this contract which is what
- 00:17:04this is if you use this platform you are
- 00:17:06required to give credit and say I use
- 00:17:09this platform and then guess what udio
- 00:17:12is going to repost it or they reserve
- 00:17:13the right to repost it and be like oh my
- 00:17:14gosh this big song it was made using our
- 00:17:17platform and of course they would but
- 00:17:19you give them the right pursuant to
- 00:17:21these terms to do that so as part of the
- 00:17:23forgoing license you grant to us the
- 00:17:26right to also comment to tag to publish
- 00:17:28to display to copy and also to create
- 00:17:31like little derivative works we can do
- 00:17:32it for any reason we can do it for
- 00:17:34advertising by posting and submitting
- 00:17:36your content through the services you
- 00:17:38represent warrant that you have all
- 00:17:40necessary rights okay so this is where
- 00:17:42it's going to get really muddy we have
- 00:17:44um so many problems already with people
- 00:17:46who utilize music distribute music sell
- 00:17:49music and they actually don't have all
- 00:17:50the rights just because of who they
- 00:17:52worked with they're like we don't have
- 00:17:53an agreement and I think I should be
- 00:17:54able to own it like someone did this to
- 00:17:55me I went to their Studio one time and
- 00:17:58we just recorded and just tried some
- 00:18:00stuff and we were just you know
- 00:18:01around and something like years later
- 00:18:04this person released a song using some
- 00:18:06of the stuff that we had recorded and I
- 00:18:08like didn't give permission person did
- 00:18:10not own it lots of issues and so things
- 00:18:13can happen and maybe someone can be
- 00:18:14confused and you know they end up doing
- 00:18:17something with the music so that's what
- 00:18:18they're saying here and that's what a
- 00:18:19lot of these companies do anyway that
- 00:18:21deal with your music they're like just
- 00:18:22so you know you're supposed to get all
- 00:18:24the permissions and consents and all the
- 00:18:26stuff so that if something bad happens
- 00:18:28guess who's going to have to pay the
- 00:18:29attorney's fees it's you that's what
- 00:18:31that's what this says all right so um
- 00:18:326.4 talks about attribution so this is
- 00:18:34where it goes you give us permission to
- 00:18:37well and this is after the credit but
- 00:18:38this basically says you will credit them
- 00:18:40so you will credit not only us on
- 00:18:43anything that is made right you are
- 00:18:45required to that's a distinction it's
- 00:18:47not a hey we kind of want you to you are
- 00:18:49actually required to so you know
- 00:18:50technically it would be a breach of
- 00:18:51contract if you use this platform and
- 00:18:54then you don't reasonably credit them
- 00:18:56for the creation so keep that in mind I
- 00:18:58don't know is udio going to come after
- 00:19:00you and sue you because you don't give
- 00:19:02them credit pursuant to this they could
- 00:19:04all right so this is kind of interesting
- 00:19:05right here they get into dmca takedowns
- 00:19:08so basically what this says here they go
- 00:19:09look under the Digital Millennium
- 00:19:11Copyright Act of 2018 and this specific
- 00:19:15statute if someone files a dmca takedown
- 00:19:19because they go you stole something from
- 00:19:23us and so they have a a copyright claim
- 00:19:25under the Copyright Act in the dmca what
- 00:19:27it says is that there's safe Harbor for
- 00:19:29companies so in this case it' be udio so
- 00:19:31so basically what that means is that
- 00:19:32they have built in a mechanism to be
- 00:19:35like if there's a copyright claim we
- 00:19:36have the ability to not get sued pursu
- 00:19:38to the Copyright Act and this is how and
- 00:19:40I go that's really interesting because
- 00:19:42I'm like again this is all AI generated
- 00:19:44stuff so I go one of the big questions
- 00:19:46here is well where's you know what's the
- 00:19:48AI learning from is it really original
- 00:19:51is it really and that's like part of the
- 00:19:53big problem and you know we have a lot
- 00:19:54of people who are just like no it's not
- 00:19:56AI is learning from the stuff that was
- 00:19:58made by humans and then it's using these
- 00:20:00just incredible algorithms and
- 00:20:02Technology you know all this stuff to to
- 00:20:04come up with these new songs and all
- 00:20:06this stuff instantaneously like it's
- 00:20:07insane but in any case they do go well
- 00:20:09we are going to give ourselves Safe
- 00:20:10Harbor here and again I don't know if
- 00:20:12that's for purposes of now or that's
- 00:20:13because in the near future they're going
- 00:20:15to be giving people the ability to
- 00:20:17upload their original stuff and it will
- 00:20:19be now integrated into the AI every
- 00:20:22dream of getting your music into TV film
- 00:20:24and games well it's easier than you
- 00:20:26think and here's what I put together for
- 00:20:28you a music library database of 90 plus
- 00:20:31music libraries email templates and a
- 00:20:33license agreement all so it's done for
- 00:20:35you go to topmusic attorney.com for stin
- 00:20:38licensing Made Easy and guys let me just
- 00:20:41touch on this for like two seconds going
- 00:20:42back to the copyright stuff please
- 00:20:45memorize this remember this write this
- 00:20:47down when it comes to you filing
- 00:20:49something for copyright remember in the
- 00:20:51beginning I said if you're going to file
- 00:20:54to copyright your music your original
- 00:20:56music that you made you want to make
- 00:20:57sure that you file it with the federal
- 00:20:58government write the copyright office
- 00:21:00get a piece of paper you got to do it to
- 00:21:02file a lawsuit to hire me to get your
- 00:21:04attorney's fees like all this stuff to
- 00:21:05file the lawsuit very important and you
- 00:21:08want to do it before the infringement
- 00:21:09happens if there's infringement because
- 00:21:10then you can get statutory damages up to
- 00:21:12$150,000 per infringements all great
- 00:21:14stuff but the copyright office and the
- 00:21:16reason why I showed you that at the
- 00:21:17beginning was the copyright office has
- 00:21:19said that if you make some portion of
- 00:21:21your song using AI you have to disclaim
- 00:21:24it to the copyright office with your
- 00:21:25application when you file and if you
- 00:21:28don't what can happen is that the
- 00:21:29copyright office will revoke your
- 00:21:31registration so it'll be like it never
- 00:21:33happened again for those of you who are
- 00:21:34thinking well how will they know why
- 00:21:36would you risk it and there's so many
- 00:21:39platforms now that are popping up to
- 00:21:41help you know teachers for example you
- 00:21:44know figure out how to how to you know
- 00:21:45catch the kids who are you know using AI
- 00:21:48to write their essays and things like
- 00:21:49that there's just as many like Solutions
- 00:21:51coming up with with with figuring this
- 00:21:53out so I just I want to put it out there
- 00:21:55you do have to disclaim whatever portion
- 00:21:57was written by AI and if the whole thing
- 00:21:59was written by Ai and you didn't do
- 00:22:01anything so other than put in the
- 00:22:03instructions if it was totally made by
- 00:22:05AI you can't get a federal registration
- 00:22:07in the United States all right so moving
- 00:22:09on they have all the mechanisms for the
- 00:22:11dmca takedowns the the ability to do
- 00:22:13counter notifications all kinds of you
- 00:22:15know things we won't get too far into
- 00:22:17okay and then the output right so the
- 00:22:19stuff that is made using the udio
- 00:22:22platform generated by the surface is for
- 00:22:24entertainment purposes only they're like
- 00:22:26hey you can sell it you can do all kinds
- 00:22:28of things but we're saying it's for
- 00:22:29entertainment purposes only due to the
- 00:22:32nature of artificial intelligence and
- 00:22:34machine learning your output may not be
- 00:22:37unique and the services May generate the
- 00:22:40same or similar output for a third party
- 00:22:44so for those of you who like your hair
- 00:22:46is blowing back and you're like this is
- 00:22:47the most amazing thing I'm going to put
- 00:22:49out the best music ever and you know
- 00:22:51you're not maybe being honest about your
- 00:22:52use of it just understand there's just
- 00:22:54going to be different ways that this
- 00:22:55kind of burns you and so I'm focusing on
- 00:22:57the legality of it I'm focusing on the
- 00:22:59copyright issues and all of that however
- 00:23:01I do want to reiterate this they are
- 00:23:03telling you that there is a potential
- 00:23:06that someone who uses the platform may
- 00:23:09have the exact same song generated for
- 00:23:12them so don't think that again you might
- 00:23:14not get discovered right okay so as we
- 00:23:16continue though because remember the
- 00:23:17beginning I go I'm I'm curious about
- 00:23:20this company who is this we'll get to
- 00:23:22that a little bit more so they go uh the
- 00:23:24laws the jurisdiction is basically going
- 00:23:27to be we do have of liability and this
- 00:23:29is how it's all going to work so let me
- 00:23:30go to this 8.2 remember with the tune
- 00:23:32core terms of service we were talking
- 00:23:35about the limitations of liability I'm
- 00:23:36like guys I will literally go to war for
- 00:23:40weeks over these words that there's a
- 00:23:43limitation of liability in order for you
- 00:23:45to seek your special exemplary
- 00:23:48incidental consequential or punitive
- 00:23:50damages and then they also go on to say
- 00:23:53if there is liability so you sue us and
- 00:23:56we lose the total amount that you can
- 00:23:59get cannot exceed it can't be more than
- 00:24:01$100 or the amount that you paid to our
- 00:24:04company if any amount in the past six
- 00:24:07months for the services and I pointed
- 00:24:09out I just go look a lot of companies do
- 00:24:11this because it practically prevents you
- 00:24:14from ever getting a meaningful outcome
- 00:24:17okay so just meaning like you can't get
- 00:24:18your attorney's fees because they said
- 00:24:20that word consequential damages it's a
- 00:24:22consequential damage that you will incur
- 00:24:24to pay $50,000 to file a lawsuit and pay
- 00:24:26an attorney and they're like also also
- 00:24:28by the way you not only don't get
- 00:24:30reimbursed for your attorney's fees but
- 00:24:31if you if we lose the mostly you could
- 00:24:34get is $100 this stuff makes me laugh
- 00:24:36we'll come back to this but I just want
- 00:24:37to transition the conversation really
- 00:24:39quickly back to more of the Practical
- 00:24:41stuff so let me bring Orco back in so we
- 00:24:43can just kind of jump into this this
- 00:24:45whole conversation has just been you
- 00:24:47know crazy I know you haven't gotten
- 00:24:49into udio or any of these things like
- 00:24:52you know working with it but I I checked
- 00:24:54it out I looked at it and I I did it a
- 00:24:57couple days and just every time did it I
- 00:24:58just felt like you know what is the
- 00:25:01point anymore like music is over music
- 00:25:03is done and then I was like uh you know
- 00:25:06but it's here and like what are we going
- 00:25:08to do AI is here AI is you know has
- 00:25:13really think about your lifetime
- 00:25:14everybody that's been alive that's you
- 00:25:15know watching this video has gone
- 00:25:17through a couple of eras just how fast
- 00:25:19the world has adapted to AI just in
- 00:25:22their everyday lives I mean even on meta
- 00:25:25and Facebook now you can't avoid they
- 00:25:26have their AI That's built in that you
- 00:25:28can't even get rid of your phones they
- 00:25:30all have ai in them chat GPT everybody
- 00:25:33uses chat GPT everybody is using some
- 00:25:36form of AI now an aspect of it is like
- 00:25:39you know it's here what do we do like it
- 00:25:42it's just here what can we do I've seen
- 00:25:44Talk of the government really needs to
- 00:25:45regulate AI how the technology is out
- 00:25:48there it's here it's it's in existence
- 00:25:50it's a matter of fact yeah and in
- 00:25:52regards to this if you've written the
- 00:25:54lyrics right so let's say you were using
- 00:25:56udio and you wrote the lyrics well did
- 00:25:58you write all the lyrics did you just
- 00:26:00give it you know maybe some sentences
- 00:26:02and then it built the remainder do you
- 00:26:04have copyright protection in the
- 00:26:06original elements that you provided yes
- 00:26:08for sure it gets really tricky if you go
- 00:26:11that was my sole input and then for
- 00:26:13practically for each of you watching
- 00:26:14this you now know and you can better
- 00:26:16protect yourself on how to do this how
- 00:26:18to register what you need to disclaim
- 00:26:20things like that but then going back to
- 00:26:21the question of someone you know just
- 00:26:22being like so what what if you know so
- 00:26:24what if I don't have the copyright
- 00:26:26ownership here's the Practical effect
- 00:26:28because we talk a lot about you know I
- 00:26:30really want you guys to think like
- 00:26:31record labels so that you can build your
- 00:26:32own companies and not necessarily just
- 00:26:34give ownership of your music to another
- 00:26:36company because maybe they can do
- 00:26:38something for you that you don't know
- 00:26:39that you can actually just do for
- 00:26:40yourself setting that aside I'm always
- 00:26:42like remember that these companies are
- 00:26:44making millions of dollars from your
- 00:26:46music because they end up selling it
- 00:26:48especially if they can get a song or a
- 00:26:51few songs to go viral like something
- 00:26:53happens these become really valuable
- 00:26:55assets and that's what record labels
- 00:26:57make a a lot of their money from and so
- 00:27:00the reason I say all that is because the
- 00:27:01only reason that they can sell this
- 00:27:03stuff is because it's original music
- 00:27:05you're not going to be able to do
- 00:27:06something with this long term so as far
- 00:27:08as it being kind of like part of your
- 00:27:09business plan do you want to utilize
- 00:27:10some of this stuff like cool do it but
- 00:27:13as far as utilizing it and then trying
- 00:27:15to sell and stream and all this like in
- 00:27:17the short term it might have some
- 00:27:19benefit long term it it could really
- 00:27:21backfire for all the reasons we talked
- 00:27:23you know copyright issues you can't
- 00:27:26enforce right so if you're if your song
- 00:27:28was made with AI you can't take that to
- 00:27:30court because you don't own it you don't
- 00:27:32own the copyright in it you also can't
- 00:27:34sell it because when you sell it you
- 00:27:35have to provide paperwork to the buyer
- 00:27:38showing that you have the copyright
- 00:27:39registration that you made all the
- 00:27:41things those are the problems that are
- 00:27:43going to come up for you but I think
- 00:27:45also you know as time goes on and you
- 00:27:48know in just the short time how advanced
- 00:27:49the technology has gotten and it's and
- 00:27:51it's pretty Advanced I mean we're going
- 00:27:53to be talking about this for a while
- 00:27:54because it's crazy I see that it's it
- 00:27:57it's just it is going to be like
- 00:27:58everywhere and maybe some of these laws
- 00:28:00are going to have to change you know you
- 00:28:02know a lot of these laws are so old so
- 00:28:04they're going to have to adapt and I
- 00:28:06don't know if they they'll never catch
- 00:28:07up but I just think of like sync
- 00:28:09licensing who cares if they have to you
- 00:28:11know say that we used it for AI or if
- 00:28:13they're developing their own technology
- 00:28:16because this is these are just you know
- 00:28:17these sunos and and udio are just like
- 00:28:19two companies you don't think record
- 00:28:20labels are designing or their own like
- 00:28:23AI software there's so much different AI
- 00:28:26software I think that you're going to
- 00:28:27have a flooding of AI generated music I
- 00:28:31think that we're going to have another
- 00:28:32huge surge in rappers and singers and
- 00:28:35producers that are using AI for their
- 00:28:38social media because now they have
- 00:28:39backing tracks and so now they can get
- 00:28:41into music so easy just like how when
- 00:28:43Daws were made to everybody can just
- 00:28:46record their own songs at home and then
- 00:28:47everybody was a rapper or producer and
- 00:28:49now it's just even more so because now
- 00:28:51just casual fans of Music are going to
- 00:28:54get the industry the market is going to
- 00:28:55get so overly saturated and it's just
- 00:28:58it's just going to it's just a matter of
- 00:29:00how you're going to adapt into it so I
- 00:29:03think I love this so actually there was
- 00:29:05the when I was talking earlier about
- 00:29:07this um there were two examples that
- 00:29:08came to mind and this was one so when we
- 00:29:10had a non-human make a thing and there
- 00:29:13was the argument of does the monkey who
- 00:29:15accidentally took the or not even
- 00:29:16accident the monkey who took the selfie
- 00:29:18did the monkey own the copyright and the
- 00:29:21courts found no because he's not human
- 00:29:24right but then another instance where um
- 00:29:27a live streamer
- 00:29:28he accidentally turned on the camera and
- 00:29:31it accidentally started live streaming
- 00:29:34and then someone used that video and so
- 00:29:36he sued and he goes That's My
- 00:29:38copyrighted content and he lost because
- 00:29:41the court said you didn't intentionally
- 00:29:43make it yes it was made by a human but
- 00:29:44you didn't intentionally make so there's
- 00:29:46lots of like gray areas and Nuance
- 00:29:48things but the one thing that we do know
- 00:29:49under the Copyright Act is that work of
- 00:29:52authorship suggests that it's made by a
- 00:29:54human it has to be made by a human
- 00:29:56people are going to always want people
- 00:29:57to perform live people are going to
- 00:29:59always want that aspect so although
- 00:30:02there's a lot of holograms that are out
- 00:30:03there now at
- 00:30:04shows so we'll see we'll see what
- 00:30:07happens but what so so one thing I
- 00:30:09didn't finish my thought on in regards
- 00:30:11to the terms of service and I'll just
- 00:30:12show you guys this really fast because I
- 00:30:13go in the terms of service it always
- 00:30:15says what choice of law like if there's
- 00:30:17a dispute where are we going to Duke it
- 00:30:19out in the terms right here it goes the
- 00:30:21terms are governed by the state of New
- 00:30:23York without regard to conflict of rules
- 00:30:26proper venue so if a dispute that the
- 00:30:30state and federal courts located in New
- 00:30:32York County New York shall control so I
- 00:30:35go back to my little you know remember
- 00:30:37we were looking at the trademark filings
- 00:30:41and we go H this is interesting they're
- 00:30:43saying that they are registered in
- 00:30:44Delaware Delaware but then they have New
- 00:30:46York law so I actually tried looking up
- 00:30:48the company and I searched in the you
- 00:30:51know New York Secretary of State website
- 00:30:53they're not there so they are registered
- 00:30:55in Delaware I'm like is it this
- 00:30:58Australian company who are they it's
- 00:31:00very mysterious but I'm sure that you
- 00:31:02know with all of this technology I'm
- 00:31:05sure these companies are also kind of
- 00:31:06nervous when they release it just
- 00:31:07because they don't know what the laws
- 00:31:08are going to be and so they're trying to
- 00:31:10throw everything they can to protect
- 00:31:11themselves that's the other thing that
- 00:31:13blows me away about everything is the
- 00:31:15fact that anybody has access to this
- 00:31:18like anybody can do this it's not like
- 00:31:20you have to already be involved in music
- 00:31:23or you're paying for something or this
- 00:31:25is an exclusive technology that's only
- 00:31:27available to like the upper echelon or
- 00:31:30labels or whatever your grandma could
- 00:31:33literally make an AI generated song make
- 00:31:36a little IG with it or whatever and go
- 00:31:39super viral off this song yeah in
- 00:31:41regards to just training AI right and I
- 00:31:43go how do you guys feel about this so if
- 00:31:45at some point udio and really any of
- 00:31:48these platforms but udio allows you to
- 00:31:49upload your music because maybe you're
- 00:31:51just trying to get inspired you know and
- 00:31:53they go not only if you upload the music
- 00:31:54you give us a license to use that and
- 00:31:58any of the final things that you know
- 00:32:00you come up with but also that they have
- 00:32:03access and you know will have access it
- 00:32:05doesn't look like it's you know a thing
- 00:32:06right now but that they'll have the
- 00:32:08ability for other people to be able to
- 00:32:11also view the stuff that you make and to
- 00:32:13download the stuff that you make now
- 00:32:14they say if someone else downloads what
- 00:32:17you make they're not supposed to use it
- 00:32:19commercially right to distribute it sell
- 00:32:21it that kind of thing but but but I'm
- 00:32:23also going like okay cool that's what
- 00:32:24you say but practically speaking what
- 00:32:27would people do they'll do whatever the
- 00:32:28hell they want well I'm just it's just
- 00:32:30you know I just see people using it a
- 00:32:32lot for sampling just taking you know
- 00:32:34generating some you know 70 Soul
- 00:32:37trumpets or something like that and and
- 00:32:39you know we already we we talked about a
- 00:32:41little bit before output how you just
- 00:32:44kind of uh on their website you type in
- 00:32:46what kind of stems you want and it'll
- 00:32:47Pro it's essentially doing the same
- 00:32:49thing it's giving you a type of beat
- 00:32:50that you get the stems from I think when
- 00:32:52udio releases stems and just these
- 00:32:55different abilities or can go you know
- 00:32:57from song to MIDI and then you're just
- 00:32:59kind of taking chords or whatever
- 00:33:00there's just it's going to be harder to
- 00:33:02catch but to your point of just not
- 00:33:03owning your music some people are just
- 00:33:05looking for the clout and the short the
- 00:33:07short ride companies are looking just to
- 00:33:09save money and not hire musicians think
- 00:33:12about just all the jobs that these AI
- 00:33:14companies are you know potentially
- 00:33:16eliminated like session musicians like I
- 00:33:19don't really there's so many things I
- 00:33:21just I need a baseline I don't need a
- 00:33:22session musician to play it I'll get a
- 00:33:23clean Baseline stem that I have sound
- 00:33:26Engineers when you hear these udio songs
- 00:33:28and there Sound MP3 and beta and stuff
- 00:33:30but if you know if they get higher
- 00:33:32quality whatever these songs sound like
- 00:33:33they're mixed they sound pretty good
- 00:33:36anybody that's like kind of attached
- 00:33:37with kind of mastering Engineers
- 00:33:39songwriting is going to be totally
- 00:33:41affected by these because you don't need
- 00:33:42it and if I'm making a movie or a short
- 00:33:45film or I'm looking for something
- 00:33:48background music for my YouTube video
- 00:33:50like why am I not just generating the AI
- 00:33:53music that I want and just putting it on
- 00:33:55my video like or my short form content
- 00:33:58of Tik Tok and now I have a I'm wrapping
- 00:34:01My My lyrics over it or I'm not I'm
- 00:34:03using AI lyrics The world is changed
- 00:34:06though that's the main takeaway is it's
- 00:34:08changed and we either accept it go with
- 00:34:10the flow or we sit there and complain
- 00:34:13about it but people are going to be
- 00:34:14making money on this people are going to
- 00:34:15be using these tools well on one thing
- 00:34:18that I do want to just point out because
- 00:34:19you guys remember they had said at the
- 00:34:21beginning of the terms of service and
- 00:34:22they go uh you reserve the right to opt
- 00:34:26out so I just want to make sure sure to
- 00:34:28give you guys this because I always give
- 00:34:29you the contact information so if you do
- 00:34:31sign up to be on this platform you have
- 00:34:3230 days after you register to be on the
- 00:34:35platform to send them an email which you
- 00:34:38want to send to
- 00:34:40info.com and you want to say I do not
- 00:34:42want to be bound by the arbitration
- 00:34:46provision and I wanted to point this out
- 00:34:49because I saw this with when I bought
- 00:34:50one of my cars and it said that because
- 00:34:53I actually read the terms of service
- 00:34:55it's it's a thing like you do want to
- 00:34:57opt out of these things so if you're
- 00:34:59newer to the platform if you want to
- 00:35:00utilize that make sure you do it you
- 00:35:01have 30 days from the time you register
- 00:35:03and the reason why I wanted to point out
- 00:35:05is a you guys should know this but be
- 00:35:07with with udio terms of service I always
- 00:35:08want to highlight something where I see
- 00:35:10a company doing something like giving an
- 00:35:12option to its users to artists to
- 00:35:15producers like and that's why I just you
- 00:35:16know had such a problem with toun cores
- 00:35:18terms of services because I'm like I get
- 00:35:20it you're a company you were here to
- 00:35:21make money that is so abundantly clear
- 00:35:25and you know you have no obligation to
- 00:35:27care about your artists whatsoever but
- 00:35:29like when I see a company giving some
- 00:35:30option of something I'm like good for
- 00:35:32you it's the process not the results now
- 00:35:35I don't know which which direction
- 00:35:37you're taking because you could see from
- 00:35:38both coins from that statement people
- 00:35:40thought that also the end was going to
- 00:35:41come when cassette tapes came and they
- 00:35:43they were going to end the music
- 00:35:44business but you could record songs off
- 00:35:45the radio and dub them and you know one
- 00:35:48could argue that that you know
- 00:35:49eventually came to streaming um but it's
- 00:35:52all about we're talking about like
- 00:35:53devaluing music you know photography has
- 00:35:56totally changed as far as as you know
- 00:35:58people aren't necessarily going to
- 00:35:59photographers for their head shot or
- 00:36:01whatever everybody's shooting everything
- 00:36:02on their phone or technology has been
- 00:36:04affecting every humans forever I mean
- 00:36:07it's just been kind of like a slow burn
- 00:36:09to get to where we are cuz even when I
- 00:36:12was kind of toying it around with it and
- 00:36:13just putting in like artist names it was
- 00:36:15coming pretty close to a lot of stuff
- 00:36:17which is the scary thing because it's
- 00:36:20still not there yet but it's it's so
- 00:36:23almost there in such a short time um
- 00:36:26we're going to be definitely covering
- 00:36:27more of this stuff going on just talking
- 00:36:29about just even like the ethics of it
- 00:36:31you know 30 years of now ai generated
- 00:36:34music it's like oh like you you listen
- 00:36:36to human made music that's so like 80
- 00:36:39years ago like is human history going to
- 00:36:41be erased is emotion because we're
- 00:36:43training it with our emotions we're
- 00:36:45training it with our Vibes every time we
- 00:36:47generate a song every time we release a
- 00:36:50song now apparently we are teaching AI
- 00:36:53our Human Experience our things it's now
- 00:36:56creating things to point where we're not
- 00:36:58going to be able to tell and we're be
- 00:36:59like I don't care that that song's a jam
- 00:37:01like what am I going to do about it it's
- 00:37:03it's a hit what do you want me to do I
- 00:37:04don't know robot wrote it robots are
- 00:37:05good what you want me to tell you this
- 00:37:06is what we're taking away from having
- 00:37:08looked at now the terms of service
- 00:37:09considered copyright law and number one
- 00:37:13in regards to purely AI created Music
- 00:37:17you do not own it and in fact even
- 00:37:19pursuant to udo's terms you have a
- 00:37:22license you're permitted to use it right
- 00:37:23you can use it commercially you can sell
- 00:37:25it you can license you can stream it you
- 00:37:26can do all the things that's that's okay
- 00:37:28so you are okay legally to use the music
- 00:37:30that you generate but under copyright
- 00:37:33law you don't own it now if you merge AI
- 00:37:37stuff into your music the AI stuff you
- 00:37:41don't own the original stuff that you
- 00:37:43made you own't if you go and file that
- 00:37:46with the federal government which you do
- 00:37:48want to do generally for your music you
- 00:37:50have to make sure you tell them the
- 00:37:51stuff that was made by AI otherwise it
- 00:37:53could result in your registration being
- 00:37:57revoked later on Curtis King I watched
- 00:38:00the Curtis King video when he was
- 00:38:01talking about this and he was talking
- 00:38:03about how don't be so afraid of it
- 00:38:05because what's the difference artists
- 00:38:07make producers make tight beats where
- 00:38:08they're literally studying a Drake album
- 00:38:11and copying his exact beat production
- 00:38:13and then trying to sell them on beat
- 00:38:14stars or whatever they're like they're
- 00:38:16emulating Styles already it's just AI is
- 00:38:19making it kind of easier for you I mean
- 00:38:21how many artists when Billy eish started
- 00:38:23to blow up started doing the whisper
- 00:38:26singing like you know what I'm saying so
- 00:38:29I I also see that as as as the thing to
- 00:38:32also not panic I'm trying not to panic
- 00:38:35because I got to tell you like my I felt
- 00:38:37nauseous when I started hearing some of
- 00:38:39the stuff that those those AIS were were
- 00:38:41pointing out for those of you who will
- 00:38:43argue that AI is a tool right it can be
- 00:38:46used as a tool to enhance creativity
- 00:38:49it's not meant to eliminate but it's
- 00:38:50like autotune or sound effects right
- 00:38:54distortions plugins all these things
- 00:38:57that enhance and manipulate and even
- 00:39:00sometimes will give you progressions we
- 00:39:03be like put in the court generators and
- 00:39:06so I go you know for for maybe people
- 00:39:08who are villainizing AI I go it's tough
- 00:39:11because you don't have a problem with
- 00:39:12any of the other stuff I just mentioned
- 00:39:15right yeah so what what's your guys's
- 00:39:17thought I mean
- 00:39:19sampling people that sample or they do
- 00:39:22remix or cover songs aren't you just
- 00:39:24exploiting another artist for clout like
- 00:39:26when you do those things when covering
- 00:39:27song you're using their song to for your
- 00:39:30own to put yourself on it like you
- 00:39:32didn't come up with that originally when
- 00:39:34you sample you didn't come up with that
- 00:39:36sample you're taking somebody else
- 00:39:38what's the difference between Ai and
- 00:39:40that you know what I mean like as as we
- 00:39:43go into nuances now I'm thinking more
- 00:39:45from a not just taking the song because
- 00:39:47people aren't just going to take the
- 00:39:48songs as a whole and release them
- 00:39:51necessarily they could be inspired they
- 00:39:53could be sampling they could be doing
- 00:39:54all kinds of things that you don't know
- 00:39:55like producers find tricks to to do
- 00:39:57whatever that's why you hear songs that
- 00:39:59get sued 5 years later because they hid
- 00:40:01the sample pretty good but not good
- 00:40:02enough and then they get caught and then
- 00:40:05they get sued just stay creative stay
- 00:40:07creative just remember this is why
- 00:40:09direct consumer it's the best time to do
- 00:40:12it it's the best time to try these
- 00:40:14things because there's going to be a
- 00:40:16huge sect of people that are looking for
- 00:40:18that Human Experience and maybe now your
- 00:40:20campaign is like for the next few years
